AN ORDINANCE OF THE BAKERSFIELD CITY COUNCIL APPROVING AN
AMENDMENT TO TITLE 17 OF THE BAKERSFIELD MUNICIPAL CODE TO
CHANGE THE ZONE DISTRICT LOCATED WEST AND SOUTH OF THE
INTERSECTION OF SOUTH HEATH ROAD AND STOCKDALE RANCH DRIVE
IN SOUTHWEST BAKERSFIELD (ZC NO. 21-0084)
WHEREAS, Bolthouse Properties, LLC filed an application with the City of Bakersfield
Development Services Department requesting to change the zone district from OS (Open
Space) to RE (Recreation) on approximately 28 acres and to change the zone district
from R-2 (Limited Multiple Family) to R-2/CH ((Limited Multiple Family Church Combining)
on approximately 6 acres located west and south of the intersection of South Heath Road
and Stockdale Ranch Drive (the "Project"); and
WHEREAS, the City Council certified an Environmental Impact Report for General
Plan Amendment/Zone Change No. 09-0263 which encompasses the subject property
(Resolution No. 078-10); and
WHEREAS, CEQA Guidelines Section 15164 allows an addendum to a previously
certified environmental document to be prepared if some changes or additions are
necessary but none of the conditions described in CEQA Guidelines Section 15162 calling
for the preparation of a subsequent document have occurred; and
WHEREAS, the Planning Commission held a public hearing on August 19, 2021 and
approved Resolution No. 38-21, which recommended that the City Council approve the
Project; and
WHEREAS, the Clerk of the City Council set Wednesday, October 6, 2021 at 5:15
p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as
the time and place for the City Council to consider the Project; and
WHEREAS, the City Council considered all facts, testimony, and evidence
concerning the Project, including the staff report, and the Planning Commission's
deliberation and action.
SECTION 1.
NOW, THEREFORE, BE IT ORDAINED by the Bakersfield City Council as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The Project is consistent with the Metropolitan Bakersfield General Plan.
3. The Planning Commission's findings as contained in its Resolution No. 38-21
are hereby adopted.

4. The Addendum to the Environmental Impact Report for the Project is
hereby adopted subject to the mitigation measures in Exhibit "C" for the
Project located on the map as shown in Exhibit "A", both of which are
incorporated herein.
5. The Project is hereby approved incorporating the change into the official
zoning map as described in Bakersfield Municipal Code Section 17.06.020
located on the map as shown in Exhibit "A" and as specifically described
in Exhibit B, all of which are incorporated herein.
SECTION 2.
This ordinance must be posted in accordance with the Bakersfield Municipal Code
and will become effective not less than 30 days from and after the date of its passage.

AN ADDENDUM TO THE PREVIOUSLY CERTIFIED ENVIRONMENTAL
IMPACT REPORT FOR GPA/ZC 09-0263
August 4, 2021
CEQA Guidelines Section 15164 applies to Zone Change .(ZC) 21-0084. CEQA Guidelines Section
15164 allows an addendum to a previously certified environmental document to be prepared if some
changes or additions are necessary but none of the conditions described in CEQA Guidelines Section
15162 calling for the preparation of a subsequent document have occurred. The City of Bakersfield
certified an Environmental Impact Report (EIR) for General Plan Amendment/ Zone Change (GPA/ZC)
09-0263 and Annexation No. 548 by Resolution No. 078-10. Additionally, the City of Bakersfield
adopted a Mitigated Negative Declaration (MND) for GPA/ZC 18-0318 by Resolution No. 013-19 which
based environmental analysis on the analysis conducted for GPA/ZC 09-0263. Thus, the EIR for
GPA/ZC 09-0263 and Annexation No. 548, is hereby amended by this Addendum for ZC 21-0084 as
described below.
LOCATION:
West and south of the intersection of South Heath Road and Stockdale Ranch Drive in southwest
Bakersfield; also, being portions of the NE/4 of Section 4 and the NW/4 of Section 3, T30S, R26E,
MDB&M. More specifically, Lots 1 and 2 of Lot Line Adjustment (LLA) 20-0318 and Assessor's Parcel
Number (APN) 534-011-23.
BACKGROUND:
The EIR for GPA/ZC 09-0263 and Annexation No. 548 was certified by the City of Bakersfield on June
30, 2010 by Resolution No. 078-10. The EIR included mitigation for the following categories: Land Use,
Agriculture, Public Health and Safety, Aesthetics, Traffic/Circulation, Noise, Air Quality, Cultural
Resources, Public Services and Utilities, Geologic and Seismic Hazards, Hydrology and Water Quality,
and Mineral Resources.
The MND for GPA/ZC 18-0318 was adopted by the City of Bakersfield on January 23, 2019 by
Resolution No. 013-19. The MND did not include any additional mitigation measures for the project
beyond the mitigation required for the previously entitled GPA/ZC 09-0263 as the environmental effects
of GPA/ZC 09-0263 were analyzed/mitigated to the greatest extent practicable in the associated
certified EIR. GPA/ZC 18-0318 was therefore subjected to the Mitigation Monitoring and Reporting
Program (MMRP) outlined in the certified EIR for GPA/ZC 09-0263.
The current proposal requests to allow a Zone Change from Open Space (OS) to RE (Recreation) on
approximately 28 acres and a Zone Change from R-2 (Limited Multiple Family) to R-2/CH (Limited
Multiple Family Church Combining) on approximately 6 acres. For purposes of this Addendum, the

CHANGES IN PROJECTS AND IMPACTS:
The previous environmental analysis conducted in the certified EIR for GPA/ZC 09-0263, on the
southern portion of the current project area (Lot 2 of LLA 20-0318 and APN 534-011-23) reserved the
site for "future development" of a community park to serve the surrounding neighborhoods. It was
assumed, for analysis purposes, that the community park could potentially include tall recreational
sports lighting on sports playing fields, community centers, aquatic facilities, group / family picnic
facilities, children's play areas, various playing courts (tennis, basketball, volleyball, arena games, and
skateboarding) with sports lighting, walking/jogging courses, off-street parking, security lighting, and
other associated improvements.
The initial environmental analysis conducted in the certified EIR for GPA/ZC 09-0263, on the northem
portion of the current project area (Lot 1 of LLA 20-0318) reserved the site for "future development" of a
regional commercial corridor. Subsequent environmental analysis conducted in the adopted MND for
GPA/ZC 18-0318 reserved the site for "future development" of limited multi -family residential units. The
subsequent environmental analysis conducted in the MND for GPA/ZC 18-0318 was based on the
analysis conducted for GPA/ZC 09-0263 as the request for GPA/ZC 18-0318 was to allow a "swap" in
location of previously entitled uses through GPA/ZC 09-0263.
As existing, the southern portion of the project area is currently zoned OS, and the northern portion of
the project area is currently zoned R-2. As mentioned above, the current proposal is a request to allow
a zone change from OS to RE on the southern portion, and to allow a zone change from R-2 to R-2/CH
on the northem portion. Specifically, the request includes:
Southern Portion: Community park amenities to include tall recreational sports lighting on sports
playing fields, community centers, aquatic facilities, group / family picnic facilities, children's play
areas, various playing courts (tennis, basketball, volleyball, arena games, and skateboarding)
with sports lighting, walking/jogging courses, off-street parking, security lighting, and other
associated improvements on the southern portion of the project area; and
Northern Portion: Addition of a church with the ability to request future permitting of a private
school facility.
An updated technical memo for traffic (Ruettgers & Schuler 2021), which compared the trip generation
for the approved project (GPA/ZC 09-0263) to a combination of existing and proposed conditions, was
prepared for the current request. Per the technical memo, the existing and proposed conditions of the
current request would decrease the daily trip generation from what was originally approved in the
certified EIR. The traffic memo indicated that trip generation stemming from the current request would
not increase the trip generation from what was originally approved for GPA/ZC 09-0263, therefore no
further analysis is required. Copies of the updated memo, certified EIR for GPA/ZC 09-0263, and
adopted MND for GPA/ZC 18-0318 are on file with the Development Services Department and are
available upon request.
It was determined that the proposed project would not result in any new significant environmental
impacts. All mitigation measures from GPA/ZC 09-0263 have been appended to this Addendum and
have been revised to reflect current standards. Please see the attached Mitigation Measures for
reference. These changes are considered minor technical changes per CEQA Section 15164. There
are no substantial changes with respect to the circumstances under which the ZC is undertaken that
require major revisions to the previous EIR due to the involvement of new environmental effects.
Likewise, there is no new information of substantial importance that results in new significant effects.

memo may be used to fill the environmental review requirements for the proposed ZC 21-0084. It has
been determined that the request would not result in significant impacts to any environmental subject

the project meet the conditions for the application of CEQA Guidelines Section 15164, preparation of a
subsequent or supplemental EIR is not required.

Biological Impact Mitigation Measures
1. Prior to ground disturbance, the developer shall have a qualified biologist survey the location for
species covered under the Metropolitan Bakersfield Habitat Conservation Plan incidental take
permit for urban development (Tipton kangaroo rat, San Joaquin kit fox, San Joaquin antelope
squirrel, & Bakersfield cactus) and comply with the mitigation measures of the permit. Survey
protocol shall be that recommended by the California Department of Fish and Wildlife. Developer
shall be subject to additional mitigation measures recommended by the qualified biologist. A copy
of the survey shall be provided to the Community Development Department and wildlife agencies
no more than 30 days prior to ground disturbance.
The current MBHCP expires on February 28, 2022. To ensure take of covered species does not occur
after the expiration date, fees must be paid no later than August 31, 2021 and all covered activities
must be completed by the MBHCP expiration date of February 28, 2022. As determined by the City,
only projects ready to be issued an urban development permit, grading plan approval, or building
permit will be eligible to pay fees under the current MBHCP. Early payment or pre -payment of
MBHCP fees shall not be allowed. The ability of the City to issue urban development permits is
governed by the terms of the MBHCP. Urban development permits issued after the 2022 expiration
date may be subject to a new or revised Habitat Conservation Plan, if approved, or be required to
comply directly with requests of the U.S. Fish & Wildlife Service (USFWS) and the California
Department of Fish and Wildlife (CDFW).
Mitigation measure.
2. The burrowing owl is a migratory bird species protected by international treaty under the Migratory
Bird Treaty Act (MBTA) of 1918 (16 U.S.C. 703-711). The MBTA makes it unlawful to take, possess, buy,
sell, purchase, or barter any migratory bird listed in 50 C.F.R. Part 10, including feathers or other parts,
nests, eggs, or products, except as allowed by implementing regulations (50 C.F.R. 21). Sections
3503, 3503.5, and 3800 of the California Department of Fish and Game Code prohibit the take,
possession, or destruction of birds, their nests or eggs. To avoid violation of the take provisions of
these laws generally requires that project -related disturbance at active nesting territories be
reduced or eliminated during critical phases of the nesting cycle (March 1 - August 15, annually).
Disturbance that causes nest abandonment and/or loss of reproductive effort (e.g., killing or
abandonment of eggs or young) may be considered "taking" and is potentially punishable by fines
and/or imprisonment.
a. To avoid impacts to burrowing owl, prior to ground disturbance, a focused survey shall be
submitted to California Department of Fish and Wildlife (CDFW) by the Project applicant of a
subdivision or site plan review, following the survey methodology developed by the California
Burrowing Owl Consortium (CBOC, 1993). A copy of the survey shall also be submitted to the City
of Bakersfield, Planning Division.
b. If the survey results the presence of burrowing owl nests, prior to grading; including staging,
clearing, and grubbing, surveys for active nests shall be conducted by a qualified wildlife
biologist no more than 30 days prior to the start of the of the Project commencing and that the
surveys be conducted in a sufficient area around the work site to identify any nests that are
present and to determine their status. A sufficient area means any nest within an area that
could potentially be affected by the Project. In addition to direct impacts, such as nest
destruction, nests might be affected by noise, vibration, odors, and movement of workers or
equipment. If the Project applicant identifies active nests, the CDFW shall be notified and
recommended protocols for mitigation shall be followed and a copy submitted to City of
Bakersfield, Planning Division.

(approximately February 1 through August 31), and potential burrowing owl burrows are present

REF: Trip Generation'Evaluation for Proposed Zone Change-(ZC) for Stockdale Ranch
Dear Mr. DeBranch:
.This letter is in response to your, request for a trip generation analysis for a proposed Zone
change at the above referenced, location. The zone change includes. two separate uses.
Following is.a summary of the proposed change:
22' acre park -site. Existing zoning is OS -P. Proposed -zoning is RE. The revised zoning
will allow for: organized sports events on four separate fields on approximately 14 acres.
The remaining 8 acres will, operate as a typical neighborhood park.
5 acre church .site. Existing zoning is R-2. Proposed zoning is R=2 with a Church
Overlay. Te.church building will be. approximately 14,500 square feet in.size: The'site
will also include a private elementary school associated with the church. It is anticipated
that the school will serve approximately 60 students.
The trip generation analysis will assess whether. there will be potential traffic impacts due to the
proposed .ZC. A comparison of the approved trip .generation �fiom the Traffic Impact Study for
Stockdale,Ranch, prepared by Mcintosh & Associates, June 2009, Revised September 2009 to
the trip .generation with the proposed zone change uses willbe prepared. According to City of
Bakersfield traffic study requirements, the threshold for requiring'a traffic study, due to potential
traffic impacts is .if the proposed revised zoning would increase vehicle trips by more than 50
trips in the PM peak hour.
Trip Generation Evaluation
A calculation of the trip generation for the existing and proposed conditions was prepared and is
shown in Tables 1 and. 2. It is noted that. the approved trip generation was calculated using the
Institute°,OFTransportation Engineers (ITE) Trip Generation, 9th Edition. In order to compare to
the proposed zone change use; the, trip. generation for the approved uses was -calculated using the
current' I Wh Edition. It is noted that the 10t1 Edition gives a smaller trip -generation and is
therefore more conservative and will give a more accurate comparison. The approved trip
generation is shown in Table 1.

As: Stockdale.Ranch has been developed, the number of dwelling units. that have been recorded
has been less than what was approved. The proposed trip generation is shown in Table 2 reflects
the current number of recorded lots .and approved projects (multi -family), and the maximum
density of units that are still available to develop. The retail and office land uses remain the
same.
For the proposed zone change ITE codes were used to calculate the anticipated trip generation.
For the 14 acre park site with proposed organized sports fields, ITE code 460 (Soccer Complex)
was used. Although this may not be all soccer fields, the trips generated appear to reflect the
trips that would be expected for other sports (baseball, softbafl, football, etc.). and are therefore
representative of whichever sport field is ultimately built.
