AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE
BAKERSFIELD MUNICIPAL CODE BY CHANGING THE
LAND USE ZONING OF THOSE CERTAIN PROPERTIES
IN THE CITY OF BAKERSFIELD LOCATED NORTH OF
WHITE LANE APPROXIMATELY 500 FEET WEST OF
PARK VIEW DRIVE FROM AN R-3 (LIMITED MULTIPLE
FAMILY DWELLING) ZONE TO AN R-1 (ONE FAMILY
DWELLING) ZONE.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission has held a public hearing on
a petition to change the land use zoning of those certain proper-
ties in the City of Bakersfield located north of White Lane
approximately 500 feet west of Park View Drive; and
WHEREAS, by Resolution No. 3-89 on January 5, 1989,
the Planning Commission recommended approval and adoption of an
ordinance amending Title 17 of the Municipal Code to approve a
R-1 (One Family Dwelling) Zone, as delineated on attached map, by
this Council and this Council has fully considered the findings
made by the Planning Commission as set forth in that Resolution;
and
WHEREAS, the Planning Commission, as a result of said
hearing, did make several general and specific findings of fact
which warranted a negative declaration of environmental impact
and a change of zoning of the subject property from an R-3
(Limited Multiple Family Dwelling) Zone to an R-1 (One Family
Dwelling) Zone, and the Council has considered said findings and
all appear to be true and correct; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from the proposed pro-
ject; and
WHEREAS, the City Council has determined after due
consideration of said petition and the recommendations of the
Planning Commission herein on file, together with the reasons
advanced at the hearing for a change of zoning of said property,
that a zoning change should be authorized; and
WHEREAS, the City Council has determined and found that
the proposed zoning is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
1. All of the foregoing recitals are hereby found to be
true and correct.
2. An environmental assessment was made of the project,
and a Negative Declaration was adopted by the Planning Commission
after a public hearing thereon, and this Council hereby approves
and adopts the Negative Declaration.
3. Section 17.06.020 (Zoning Map) of the Municipal Code
of the City of Bakersfield be and the same is hereby amended by
changing the land use zoning of certain properties in said City,
the boundaries of which properties are shown on the map hereto
attached and made a part hereof, as follows:
FROM AN R-3 (LIMITED MULTIPLE FAMILY
DWELLING) ZONE TO AN R-1 (ONE FAMILY
DWELLING) ZONE:
A portion of the South half of the Southwest
Quarter of Section 8, Township 30 South, Range
27 East, M.D.B.&M., and a portion of the North
half of the Northwest Quarter of Section 17,
Township 30 South, Range 27 East, M.D.B.&M.,
in the City of Bakersfield, County of Kern,
State of California, more particularly described
as follows:
Commencing at the intersection of the centerline
of Doe Oak Run, 60 feet wide, and the centerline
of Huntsman Oak Court, 60 feet wide;
THENCE Easterly along the centerline of Huntsman
Oak Court, South 89017'24,, East, 50.00 feet;
THENCE at right angles South 00042'36" Wests,
30.00 feet to a point on the Southerly line of
Huntsman Oak Court and the True Point of Beginning;
THENCE Easterly along said Southerly line South
89017'24" East, 286.51 feet to the beginning of
a tangent curve concave to the Northwest and having
a radius of 330.00 feet;
THENCE continuing along said Southerly line and
curve through a central angle of 20011'50', an arc
length of 116.33 feet;

North 70030,46,, East, 13.06 feet to the
beginning of a tangent curve concave to the
Southwest and having a radius of 20.00 feet;
THENCE along said curve through a central
angle of 89014'42,, an arc length of 31.15 feet
to a point of the Westerly line of Mill Oak
Run, 76.00 feet wide, said point being a point
on a curve concave to the Northeast and having
a radius of 1498.00 feet, a radial line to said
point bears South 69045,28,, West;
THENCE along said Westerly line and curve
through a central angle of 17059'53,, an arc
length of 470.56 feet;
THENCE departing said Westerly line South
44°02'41" West, 404.76 feet to a point on the
Northerly line of White Lane, 110 feet wide,
said point being a point on a curve concave to
the Southwest having a radius of 2005.00 feet,
a radial line to said point bears North
26°16'51" East;
THENCE Northwesterly along said Northerly line
and curve through a central angle of 11°36'51,,
an arc length of 406.42 feet to the beginning
of a nontangent curve concave to the Southwest
and having a radius of 2010.00 feet, a radial
line to said point bears North 15030'08,, East;
THENCE continuing along said Northerly line
and curve through a central angle of 03048'45,,
an arc length of 133.75 feet;
THENCE departing said Northerly line and curve
along the Easterly boundary of Tract 4612 as
recorded in Book 33 of Maps at Page 21 in the
Office of the County Recorder of the County of
Kern, North 10050'49,, East, 163.62 feet to a
point on the Easterly line of Doe Oak Run, said
point being a point on a curve concave to the
Northwest and having a radius of 92.00 feets. a
radial line to said point bears South 25°51~59,,
East;

THENCE Northeasterly along said Easterly line
and curve through a central angle of 73012,23,,
an arc length of 117.54 feet to the beginning
of a reverse curve concave to the East and
having a radius of 25.00 feet;
THENCE continuing along said Easterly line and
curve through a central angle of 19°55'11,, an
arc length of 8.69 feet;
THENCE continuing along said Easterly line
North 10050'49,, East, 80.81 feet to the begin-
ning of a tangent curve concave to the North-
west and having a radius of 330.00 feet;
THENCE Northeasterly along said Easterly line
and curve through a central angle of 10°08'13',
an arc length of 58.38 feet;
THENCE continuing along said Easterly line
North 00042'36,, East, 95.00 feet to the
beginning of a tangent curve concave to the
Southeast and having a radius of 20.00 feet;
THENCE Northeasterly along said curve through
a central angle of 90o00'00,, an arc length of
31.42 feet to the True Point of Beginning.
CONTAINS 8.523 ACRES MORE OR LESS.
SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
