AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 5.12.220 OF
THE BAKERSFIELD MUNICIPAL CODE AND ADDING
SUBSECTIONS C. AND D. TO SECTION 5.12.110
OF THE BAKERSFIELD MUNICIPAL CODE RELATING
TO BINGO GAMES.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 5.12.220 of the Bakersfield Municipal Code is
hereby amended to read as follows:
5.12.220 Financial report required.
A. Each licensee shall keep a complete and accurate writ-
ten record in connection with its operation, conduct, promotion,
supervision and any other phase of bingo games.
B. City officers and employees shall be given access by
each licensee to and shall have the right to examine and audit
original records of each licensee pertaining to bingo, and shall
be furnished copies thereof during regular business hours.
C. Each licensee shall, not later than the 15th calendar
day of each month, file with the City's Treasurer a monthly income
and expense report on its bingo game operations. The form of
such report, identifying all required information, shall be pro-
vided by the City. The first such report due under this section,
as amended, shall be filed not later than May 15, 1989, and such
report. and each successive monthly report shall demonstrate com-
pliance with the provisions of subsection D. of Section 5.12.110
if an exemption from subsection C. of that section is claimed for
the month such report is filed.
D. At the time each licensee files its monthly report for
the month of April 1989, it shall file a report for each prior
unreported month using the form required for monthly reports, and
shall pay the fee for such months as required by subsection G. 2.
of Section 5.12.040.
SECTION 2.
Subsections C. and D. are hereby added to Section
5.12.110 of the Bakersfield Municipal Code to read as follows:
5.12.110
Maximum amount of prizes, number of games -
Prohibition on give-aways - Exception.
C. Except as provided in subsection D. of this section,
no licensee with gross monthly receipts from bingo games, including
pull-tabs, exceeding $5,000.00 shall (1) conduct more than 25
games of bingo during that one period per week during which the
licensee is authorized to conduct such games, or (2) give away any
door prizes, raffle, food, bingo cards, pull-tabs, trips~, services,
merchandise or any cash prize or promotion of any kind except such
prizes as are authorized by subsection A. of this section.
D. The provisions of subsection C. of this section shall
not apply to any licensee which, during the preceding two-month
reporting period, (the first of which commences on March 1, 1989)
used or contributed at least ten percent (10%) of its gross
receipts from bingo games, including pull-tabs, for charitable
purposes not relating to the conduct of bingo games, provided such
licensee files the report required by Section 5.12.220.
SECTION 3.
If any section, subsection, sentence, clause or phrase
of this ordinance is for any reason held to be invalid or uncon-
stitutional, such decision shall not affect the validity of the
remaining portions of this ordinance. The Council hereby declares
that it would have passed this ordinance, and each section,
subsection, sentence, clause and phrase thereof, irrespective of
the fact that any one or more section, subsections, sentences,
clauses or phrases is declared invalid or unconstitutional.
SECTION 4.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
