HomeMy WebLinkAboutORD NO 3222ORDINANCE NO. 3222 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED AT THE NORTHEAST CORNER OF CAMINO MEDIA AND OLD RIVER ROAD FROM AN A (AGRICULTURAL) ZONE TO A C-O (COMMERCIAL AND PROFESSIONAL OFFICE) ZONE. WHEREAS, in accordance with the procedure set forth in Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield located at the northeast corner of Camino Media and Old River Road to bring the zoning of said area into conformance with the Bakersfield Metropolitan General Plan; and WHEREAS, by Resolution 11-89 on March 16, 1989, the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Bakersfield Municipal Code to approve a change in land use zoning from an A (Agricultural) Zone to a C-O (Commercial and Professional Office) Zone, a3 delineated on the map attached hereto as Exhibit "A," by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmeatal i. mpact and a change of zoning of the subject properties from an A (Agricultural) to C-O (Commercial and Professional), and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed pro- ject; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said proper- ties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City cf Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: FROM AN A (AGRICULTURAL) ZONE TO A C-O (COMMERCIAL AND PROFESSIONAL OFFICE) ZONE: Being a portion of Section 6, Township 30 South, Range 27 East, ~.D.B.&M., City of Bakersfield, County of Kern, State of California, being more particularly described as follows: Commencing at the Northeast corner of Sec- tion 6; THENCE South 00021'23" West 747.30 feet along the East line of the Northeast Quarter of said section to the True Point of Beginning; THENCE South 00021'23" West, 1914.60 feet along said line to the East Quarter corner of said section; THENCE South 00°22'19" West, 1463.43 feet along the East line of the Southeast Quarter of said Section to a point on the North right-of-way line of Camino Media as per Parcel Map No. 6547 recorded in Book 29 of Parcel Maps at Page 83 in the Office of the Kern County Recorder and the beginning of a - 2 - non-tangent curve having a radial bearing of South 00049'53,, West and radius of 725.00 feet, concave Northeasterly through a central angle of 39002'47,, an arc distance of 494.08 feet; THENCE along a tangent line North 48053'26,, West, 320.07 feet to the beginning a non- tangent curve having a radial bearing of South 41°22'59" West and radius of 831.00 feet and concave Westerly; THENCE along said curve [brough a central angle of 22043'42" an arc distance of 329.64 feet to the beginning of a non-tangent curve having a radial bearing of North ~7°01'53" East, and a radius of 831.00 feet and concave Southwesterly; THENCE along said curve through a central angle of 16040'04", an arc distance of 241.74 feet; THENCE North 89°38'11" West, 11.00 feet; THENCE North 44°38,11,, West, 28.28 feet; T~ENCE North 00021'49', East, 309.00 feet; THENCE North 00°30'16" West, 330.04 feet; THENCE North 00°21,49- East, 811.00 feet; THENCE North 00o21'49" East, 150.00 feet; THENCE South 89°38'11" East 5.00 feet; THENCE South 44°38'11" East, 28.28 feet; THENCE South 89°38'11,, East, 235.00 feet; THENCE South 87°56'21" East, 342.58 feet, to the beginning of a curve having a radius of 20.00 feet and concave Northwesterly; THENCE along said curve through a central angle of 91041'50',, an arc distance of 32.01 feet; THENCE North 00o21'49- East, 477.95 feet to the beginning of a curve having a radius of 25.00 feet, and concave Southwesterly; THENCE along said curve through a central angle of 42050'00" an arc distance of 18.69 feet to the Point of Reverse Curvature of a curve having a radius of 50.00 feet and concave to the South; THENCE along said curve through a central angle of 174°57'14" an arc distance of 152.68 feet; THENCE North 42029'03,, Sast, 850.21 feet to the Point of Beginning.
