Hearing opened for public comment. No one spoke for or against the items.
Motion was made by Commissioner Tkac, seconded by Commissioner McGinnis, to
approve the items on the public hearing portion of the Consent Calendar including the
memorandum from Stanley Grady dated November 7, 2002, regarding agenda item
4.2c. Motion carried by group vote.

PUBLIC HEARING - Tentative Tract Maps
6.1) Vestin.q Tentative Tract Map 6141 (Phased) (Pinnacle Engineering) (Ward 7)
Public portion of the hearing was opened. Staff report given recommending approval with
conditions attached to the staff report.
No one spoke in opposition of the project.
Matt VoVilla, representing Pinnacle Engineering, stated there are a couple of Public Works
conditions that he would like to clarify. Condition three requires construction of a median island
in Stine Road or other improvements as approved by the City Engineer. They would like the
developer to have the option of paying the in-lieu fees for the median island. They feel that a
median island on a rural road could be a safety issue. They have discussed this with staff from
the Public Works Department and have agreed that they pay the in-lieu fees along with
constructing a "pork chop" on Donna Street at the intersection of Stine Road.
Condition 11 states the developer is required to construct an improvement which is on the

facilities list for the Metropolitan Bakersfield Impact Fee but it does not state which improvement
and they have discussed this Public Works and the condition would be two lanes on Stine Road.
The reason he wants to clarify this is because in the general vicinity there are some traffic
signals on the fee list and they want to clarify that the improvement mentioned in the condition is
two lanes on Stine Road? They concur with the memorandum from Public Works regarding
condition number six.
Public portion of the hearing was closed.
Ms. Shaw said that if the "pork chop" is acceptable to the traffic engineer, he will not be required
to put in the median but he is required to pay his proportionate share of the median fee.
Condition number eleven improvements references the two lanes - not a traffic signal.
Commissioner Tkac stated that he listened to the Monday pre-meeting tape and will be
participating in tonight's meeting.
Commissioner Blockley asked what happens if they cannot reach an agreement with the two
property owners regarding the corner cutoff for the line of sight? Ms. Shaw said that if he cannot
obtain an additional right-of-way then they would need to add the reference for eminent domain
proceedings. Commissioner Sprague asked if they needed to include that in their motion to
which Ms. Shaw said yes.
Commissioner Tragish said that at the pre-meeting he indicated that he had a conflict of interest
on Consent Agenda Item 4.2a so that his vote tonight on the Consent Calendar did not include a
vote by him for Item 4.2a.
Commissioner McGinnis asked Mr. VoVilla if there are negotiations going on to acquire the other
two properties to which Mr. VoVilla said not to his knowledge. He has spoken to one of the
property owners and thinks the access could be easily remedied with drive approach along
Donna Street. Right now she has a drive approach to Stine Road and it would be more desirable
to eliminate this and he thinks she will work with them. Two drive approaches along her north
property line would satisfy her access concerns.
Commissioner Sprague asked if the developer will put an entrance into her property off of Donna
Street? Mr. VoVilla said yes if the Pubic Works Department agrees.
Ms. Shaw said that since she will be adding a condition regarding the corner cutoff at Donna and
Stine she will append the driveway requirement to that condition as well.
Commissioner Tragish asked when the motion is made do they need to include the eminent
domain election in case the properties are not sold and they needed a certain type of access?
Ms. Gennaro said no that it is standard operating procedure that once the city requires a
condition of development that that dedication be there. If the applicant cannot provide for it
through negotiation, then it must go through eminent domain. At a request by Commissioner
Tragish, Ms. Shaw showed on the overhead where the access would be located.
Motion made by Commissioner Tragish, seconded by Commissioner McGinnis, to approve and
adopt the Negative Declaration and to approve Vesting Tentative Tract Map 6141 with findings
and conditions set forth in the attached resolution and also the memorandum of November 1,
2002 from Marian Shaw to the Planning Commission and to include to condition 19 provide
required easement for line of sight and access road from Stine and provide drive approach from
Donna. Motion carried by the following roll call vote:
