A RESOLUTION DETERMINING THAT MAXICOM
IRRIGATION CONTROL MODEMS CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR
TO DISPENSE WITH BIDDING THEREFOR, NOT TO EXCEED
$75, 765_
WHEREAS, the existing Moxicom Irrigation Control modems that ore utilized
by the Recreation and Perks Coepartrnm-rnt are running on 3G cellular network and
they will be phased out for a newer 4G cellular network; and
WHEREAS, the Moxicom Irrigotion Control modems provide wireless control
of irrigation operations throughout City owned parks and streetscopes; and

WHEREAS, the Recreation and Parks department hos o need to replace 50
existing Maxicom Irrigotion Control modems at various locations throughout the
City to prevent disruptions in operations; and
WHEREAS, Kern Turf Supply Inc_ is the preferred and authorized distributor of
the Maxicom Irrigotion Control modems; and
WHEREAS, Kern Turf Supply, Inc_, is the original supplier of the /vlaxicom
Irrigation Control system and modems; and
WHEREAS, the Recreation and Parks [Director has determined and hos
recommended the Council find that the purchase of Maxicom Irrigation Control
modems con only be purchased from o single vendor, Kern Turf Supply,
because they ore an authorized distributor of the modems and has
recommended that this Council authorize dispensing with bidding requirements
in accordance with subsection (D.2 of Section 3.20.060 of the Bakersfield Municipal
Code_
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of BC3Kersfield
as follows:
1 _ The above recitals are true and correct and incorporated herein by
reference.
2_ The Council hereby finds that the purchase of Moxicom Irrigotion
Control modems con only be reasonably obtained from one vendor, Kern Turf
Supply, Inc., for the reasons set forth above_
3_ The Finance [Director is authorized to dispense with bidding thereforeo<c"6",

in accordance with Section 3.20.060 of the Bakersfield Municipal Code and to
negotiate the purchase of same for an immediate purchase and installation not
to exceed $75,765.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Coyncil of the City of Bakersfield at a regular meeting thereof held on
