A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELO DEDICATING PUBLIC RIGHT-OF-WAY WITHIN
CITY PROPERTY FOR FUTURE KIRKCALDY nRIVE.
WHEREAS, the City of Bcalcersfieid (City) owns property, AP" 132-010-33, upon
which is the site of an existing City dro)noge sump, at the Northwest corner of Niles
Street Gond future Kirkcaldy Drive, being operated and maintained by the City of
Bakersfield Water Resource Department; and
WHEREAS, said property was deeded to the City per document recorded
September 16, 1985 and is described in Grant Deed filed with the Kern County
Recorder's office in Book 5797 of page 1 429 O.R., Document No. 01 SS0301 78; and
WHEREAS, the City hos received a request by the developers of o residential
project located of 7350 Willis Avenue to dedicate public road right-of-way for
Kirkccildy Drive as required by Conditions of Approval for Site Plan Review No. 21-
0208; a n d
WHEREAS, the street dedication is required in order to consiruct Kirkcaldy
Drive per said Site Plan Review conditions within and along the East side of City
property; and
WHEREAS, the City proposes to dedicate o portion of the City property as
o public street ("Dedicated Property"); and

A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DEDICATING PUBLIC RIGHT-OF-WAY WITHIN
CITY PROPERTY FOR FUTURE KIRKCALDY DRIVE.
WHEREAS, the City of Bakersfield (City) owns property, APN 132-010-33, upon
which is the site of an existing City drainage sump, at the Northwest corner of Niles
Street and future Kirkcaldy Drive, being operated and maintained by the City of
Bakersfield Water Resource Department; and
WHEREAS, said property was deeded to the City per document recorded
September 16, 1985 and is described in Grant Deed filed with the Kern County
Recorder's office in Book 5797 at page 1429 O.R., Document No. 0185030178; and
WHEREAS, the City has received a request by the developers of a residential
project located at 7350 Willis Avenue to dedicate public road right-of-way for

WHEREAS, the street dedication is required in order to construct Kirkcaldy

WHEREAS, said Dedicated Property is described in Exhibit "A" and "B"
attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as
follows:
1. The foregoing recitals are true and correct and are incorporated
herein by reference.
2. The City of Bakersfield hereby dedicates to the public a right-of-way
over the Dedicated Property as described in Exhibit "A", "B" for use as a public
street.
