CALL TO ORDER Chairman Smith called the meeting to order at 12:02 p.m. 2. ROLL CALL Present: Chairman Smith, Member Freeman, Member Parlier Absent: None 3. PUBLIC STATEMENTS - None 4. MINUTES A. Approval of the Minutes of the Special Meeting of June 21, 2021. Motion by Member Freeman to approve the Minutes of June 21, 2021. UNANIMOUSLY APPROVED. 5. KERN RIVER LEVEE DISTRICT - None 6. REPORTS A. City's response to Governor's Drought Proclamation and Executive Order Daniel Maldonado, Water Resources Planner, presented an overview of the Governor's Proclamation and the City of Bakersfield's Domestic Water Conservation plan. The Governor's Proclamation on October 19, 20217 states: "To preserve the State's surface and groundwater supplies and better prepare for the potential for continued dry conditions next year, local water suppliers are directed to execute their urban Water Shortage Contingency Plans at a level appropriate to local conditions that takes into Bakersfield, California, November 10, 2021 — Page 2 account the possibility of a third consecutive dry year". Current shortage level for City of Bakersfield is Level 2 — multi year drought. The Governor's Executive Order on July 8, 2021, asks all Californians to reduce water usage by 15% from 2020 water usage. Mr. Maldonado provided current water usage and conservation data. The City of Bakersfield (COB) Domestic Water System observed an 8% reduction per capita in July 2021 and a 3% reduction per capita in August 2021. September and October 2021 observed an increase per capita water usage. Mandatory requirements for COB Domestic Water System Service Area include prohibit the use of potable water for washing down hard - surfaced areas such as sidewalks, driveways, buildings, patios, parking lots, etc. Require shut-off nozzles on hoses for vehicle washing with potable water. Limit outdoor landscape and turf water usage to three days per week, during the watering times reflected in the Municipal Code. Odd number addresses water on Tuesday, Thursday, and Saturday, even number addresses water on Wednesday, Friday, and Sunday with no watering on Monday. Prohibit outdoor water usage during and 48 hours after a rain event resulting in measurable precipitation. The COB provided a public information campaign and newsletter/bill insert to notify customers of water shortage level, encourage water conservation and information regarding implementation of water use restrictions. In addition, Mr. Maldonado reminded all that Water Conservation Rebates and Kits are available to the public via Cal Water's Website as well as City of Bakersfield's Website and the City of Bakersfield's Mobile App. Bakersfield Mobile is available to report a Service Request allowing residents to submit Service Request regarding Water Waste. Motion by Member Freeman to Receive and File Report UNANIMOUSLY APPROVE© 7. HEARINGS A. Public Hearing to consider adoption of City's 2020 Urban Water Management Plan (UWMP) Samuel Blue, Engineer III, presented an overview of the City's 2020 Urban Water Management Plan (UWMP). The UWMP was prepared in accordance with the California Urban Water Management Planning Act and the 2020 UWMP Guidebook provided by Department of Water Resources. Each urban water supplier providing over 3,000 acre-feet of water or serving 3,000 customers or more is required to prepare an UWMP. The City's 2020 UWMP combines both retail, which is the City's domestic water system, and wholesale, which is the City's Kern River supplies designated for urban use. A new requirement for the 2020 UWMP is that a Water Shortage Contingency Plan (WSCP) must be prepared as a separate document that can be modified and adopted more frequently than the UWMP. This hearing addresses both the UWMP and the WSCP. Mr. Blue explained the UWMP consists of 10 chapters with Chapter 8 providing a summary of the Water Shortage Contingency Plan, which is included as an appendix to the UWMP which can be updated and adopted more frequently than the UWMP. The City has coordinated with other local water purveyors in preparing this Plan and has also made the final draft Bakersfield, California, November 10, 2021 — Page 3 publicly available for review and comment. Staff recommends the Water Board approve and recommend both the UWMP and the WSCP for formal adoption at the December 15, 2021 City Council meeting via resolution. Upon conclusion of Mr. Blue's report, Kimberly Aleman, Water Board Secretary opened the public hearing. After receiving no person requesting to speak in favor or in opposition of the item. Ms. Aleman closed the public hearing and returned the item to the Water Board for comment and action. Motion by Member Freeman to recommend adoption of the City's 2020 Urban Water Management Plan (UWMP} to City Council via resolution. UNANIMOUSLY APPROVED 8. NEW BUSINESS A. RECOMMENDATION: Staff recommends that the Water Board refer agreement to City Council for approval. BACKGROUND.* On September 21..2005.. the City entered into a Water Supply Agreement with Kern County Water Agency's Improvement District No. 4 (ID4) to receive treated State Water Project (SWP) water from the Henry C. Garnett Water Treatment Plant to serve parts of the City's domestic water system. This 2005 Agreement anticipated that the source of water would originate as surface water from the SWP. During an average water year, the City receives up to 6,,500 acre-feet of treated SWP surface water in annual entitlement from ID4. Due to the extreme, ongoing drought conditions, this 6,,500 acre-feet of SWP surface water is not expected to be available in 2022. This SWP surface water augments the supply required to provide potable water to residences and businesses within the City's Domestic Water Service area. Absent the annual entitlement of SWP surface water, either 1) state water supply needs to be pumped from the ground and/or 2) City's Kern River supply can be delivered and treated at the water treatment plant and potable water delivered to Bakersfield residents in the City's domestic service area. Both options are being planned for in the year 2022. The attached new Agreement to pump a dry year supply if approved will provide for some state water to be pumped from the ground and treated at the Henry C. Garnett treatment plant. In addition., a letter agreement is in place for 2022 to allow for City's Kern River supply to be delivered and treated at the water treatment plant. Therefore, both options are available and will be used in 2022. Funds are available in the 2021/2022 fiscal year Water Resources operating budget. No General Fund monies will be used. AGREEMENT FOR A DRY YEAR WATER SUPPLY BETWEEN IMPROVEMENT DISTRICT NO.4 AND THE CITY OF BAKERSFIELD This agreement entered this day of ,2021 between the Kern County Water Agency ("Agency").. individually and on behalf of Improvement District No. 4 ("ID41, and CITY OF BAKERSFIELD ("Customer") . RECITALS WHEREAS, the Agency has previously entered into long term water supply agreements with the Customer dated September 21, 2005 ("Water Supply Agreement No. 05-325"), a model of which is attached hereto as Exhibit A; WHEREAS, the Water Supply Agreement provides, pursuant to Article 12(A), that the Agency may use ID4 groundwater banking projects or in -district wells for reducing shortages subject to a separate agreement between the Agency and the Customer; WHEREAS, ID4 staff has investigated the recovery capacity of the ID4 groundwater banking projects and in --district wells to provide dry year supplies to reduce shortages to the Customer in years when treated water requests of the Customer for New Entitlement cannot be met by ID4's surface water suppliesil , WHEREAS, ID4 staff has provided the Customer with analyses showing the estimated costs of utilizing the recharge and recovery capacity of the ID4 groundwater banking projects and in -district wells to provide such dry year supplies; WHEREAS, the Customer desires to utilize the recovery capacity of the ID4 groundwater banking projects and in -district wells to receive a dry year water supply from ID4 to reduce shortages as provided for in the Water Supply Agreement. Incorporation of Water Supply Agreement. The provisions of the Water Supply Agreement, including but not limited to those that define the terms used in this agreement and those that describe the obligation and method of payments, are hereby incorporated by reference into this agreement. 2. Schedule for Dry Year Supplies. (a) By March i, 2022, the Agency Will provide the Customer with a preliminary estimate of IN's recovery capacity for dry year .supplies for the succeeding year. (b) By April L 2022, the Customer will provide the Agency with its preliminary dry year water supply request and delivery schedule for that year. (c) By May L 2022, the Customer will provide the Agency with its final dry year water supply request and delivery schedule for that year. (d) After May L 2022, the Customer may propose to amend its dry year water supply request and delivery schedule for that year. The Agency shall review any proposed amendments and provide an updated delivery schedule within two weeks of the request. (e) Agency shall endeavor to at all times keep the Customer apprised of State Water Supply anticipated allocations so that the Customer may make informed decisions about dry year supply needs. 3. Costs and Payments for Dry Year Supplies. (a) By December L 2021, the Agency will provide the Customer with a preliminary estimate and detailed breakdown of the costs for dry year supplies, including any IN administrative costs, for the succeeding year. (b) By March 1.. 2022, the Customer shall pay 25% of the dry year water supply charges due to IN for that year that are attributable to such Customer's preliminary dry year water supply request and delivery schedule. The remaining 75% of the dry year water supply charges due to IN for that year will be collected in equal installments on a monthly basis in those 2 DocuSign Envelope ID: 53685F77-556B-43C8-8B1C-85896EC3B8BF months for which the Customer has requested delivery of any dry year water supplies, (c) ID4 will reconcile all dry year water supply costs when final costs for the recovery of such supplies are available and by substituting actual deliveries for the requested deliveries made pursuant to 2(c) and 2(d). The Customer will be charged a melded rate for recovery over all ID4 groundwater banking projects and in -district wells used to meet dry year water supply requests. (d) The Customer may, upon reasonable notice,, reduce its dry year water supply request and delivery schedule, and shall not be obligated to make payments for dry year water supplies that are not delivered to Customer pursuant to such reduction. 4. Term of Agreement This agreement shall terminate on December 31, 2022.
