HomeMy WebLinkAboutRES NO 032-2022RESOLUTION NO. 0 3 2 0 2 0 2 2 A RESOLUTION DETERMINING THAT WINCHESTER AMMUNITION CANNOT BE REASONABLY OBTAINED THROUGH THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR, FOR A PERIOD OF ONE YEAR NOT TO EXCEED $400,000. WHEREAS, the Bakersfield Police Department has standardized on Winchester 9mm ammunition; and WHEREAS, Winchester ammunition is primarily the standard product used by most law enforcement agencies; and WHEREAS, the City desires to order large quantities of product to have on hand due to supply chain shortages; and WHEREAS, Winchester Ammunition has designated Dooley Enterprises, Anaheim, California is the authorized sole source, law enforcement distributor in the state of California; and WHEREAS, the Finance Director has determined and has recommended the Council find, that the purchase of Winchester Ammunition can only be reasonably obtained from one vendor, Dooley Enterprises, because of the manufacturer's designation and has recommended that this Council authorize dispensing with bidding requirements in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and incorporated herein by reference. 2. The Council hereby finds that the purchase of Winchester Ammunition, to be used exclusively by the Bakersfield Police Department, can only be reasonably obtained from one vendor (Dooley Enterprises) for the reasons set forth above. 3. The Finance Director is authorized to dispense with bidding therefore in Page 1 of 2 Pages accordance with Section 3.20.060 of the Bakersfield Municipal Code and to negotiate the purchase of same on a continuing basis, not to exceed budgeted amounts for a period of one year.
