A RESOLUTION DISPENSING WITH BIDDING PROCEDURES
DUE TO NEED FOR EMERGENCY SEWER REPAIRS AT
CHESTER AVENUE AND RICHLAND STREET; AUTHORIZING
W.M. LYLES CO. TO PROVIDE SERVICES AND MATERIALS
NECESSARY TO REPAIR THE SEWER, NOT TO EXCEED
$250,000; AND AUTHORIZING RAIN FOR RENT TO INSTALL
TEMPORARY BYPASS, NOT TO EXCEED $50,000.
WHEREAS, on March 8, 2022, during planned work being performed at the
intersection of Chester Avenue and Richland Street, a large void was discovered
under the roadway due to a portion of the existing 39-inch sewer line that had
collapsed causing the sinkhole which forced the closure of the road at the
intersection; and
WHEREAS, City Street Maintenance crews responded and began repair
operations on this portion of the sewer line; and
WHEREAS, during this repair effort, it was discovered that the concrete
sewer line had deteriorated to a point that a cast in place liner was no longer an
option, and the existing sewer line was deteriorated to a point where a larger
sinkhole could occur in the near future without emergency action to remedy this
condition; and
WHEREAS, the Public Works Director determined that the repairs could not
be made by City staff alone; and
WHEREAS, after assessing the condition of the sewer line, the Public Works
Director declared these conditions to be an emergency requiring work, supplies,
equipment, and materials urgently necessary for the preservation of life, health,
and property; and
WHEREAS, W.M. Lyles Co. was authorized by the Public Works Director to
replace approximately 20 feet of 39-inch sewer line and 1 manhole on a time and
material basis since W.M. Lyles had the necessary resources and expertise to
timely repair the sewer line in order to get the sewer line back into operation as
soon as possible; and
WHEREAS, the Public Works Director authorized Rain For Rent to set up a by-
pass for the sewer line to keep the sewer system operational and to allow for the
replacement of the deteriorated sewer line; and

WHEREAS, the Public Works Director recommends the Council authorize the
proposed repairs and dispense with bidding requirements, in accordance with
subsection D.4 of Section 3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The foregoing findings and recitals are true and correct, and
incorporated by reference herein.
2. Based upon the facts included in the above recitals, the work is
hereby deemed to be of urgent necessity for the preservation of life,
health or property.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds to the W.M. Lyles Co. for the services and
materials shall not exceed $250,000.
5. The expenditure of funds to Rain for Rent for the services and material
shall not exceed $50,000.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
