Theprojectissubjecttoavarietyofconditionsofapproval.TheseincludeconditionsbasedonadoptedCityplans andpolicies,thosedeterminedthroughsiteplanreview,andrecommendedconditionsfordevelopmentthatare notessentialtohealth,safety,andwelfare,butwouldonthewholeenhancetheprojectanditsrelationshipto theneighborhoodandenvironment.Thefollowingconditionsincludespecificitemsthatyouneedtoresolve beforeyoucanobtainabuildingpermitorbeallowedoccupancy.Inaddition,thereareinformationalitems includedtoalertyoutospecificfeesand/orrequirementsmovingthroughthedevelopmentpermittingprocess. Yournextstepistoapplyfornecessarybuildingpermitstoconstructyourproject REVISIONSTOTHEAPPROVEDPLAN Anytimeaftersiteplanapprovalbutbeforetheapprovalexpires,youmaysubmitrevisionstotheplan.Wewill treattheserevisionsasanewsiteplanapplicationsubjecttoanewreviewandrequiredfees.ThePlanning Directorcanonlyapproveminorchangestotheoriginalplanwithoutanewapplicationiftheyarenecessaryto meetacondition,mitigation,orresultfromphysicalobstaclesorothercomparableconstraints(SeeSection 17.08.080.c.3oftheZoningOrdinance). EXPIRATIONOFPLANS ThissiteplanexpiresonApril4,2022(2yearsfromthedecisiondate),unlessbuildingpermitshavebeenissued, orwheretheusehascommencedonprojectsnotrequiringabuildingpermit.Theprojectmustbecompleted within5yearsfromthedecisiondate.Ifthepropertyisrezoned,siteplanapprovalwillexpireupontheeffective datefortherezoningunlesstheuseispermittedinthenewzone. ThePlanningDirectormayextendtheexpirationdateuptoone(1)yearifyouresubmitnewplansforcheck againstthecoderequirementsineffectatthattimeandincludeawrittenrequestfortheextension.Wemust quireafeeforthisextensionrequest; receivethisrequest before expirationoftheprojectapproval.Wewillnotre however,changestotheplansoriginallyapprovedforpurposesotherthancoderequirementsshallbesubjectto anewsiteplanreview,includingpaymentofallrequiredfees(SeeSection17.08.080.DoftheZoningOrdinance). APPEAL Anypersonmayappealthisdecision.Anappealislimitedtowhetherornotanadopteddevelopmentstandard, zoningregulation,mitigation,orpolicyappliedornotappliedtotheproject,wasdoneconsistentwiththe authoritygrantedbycityordinancesortheCaliforniaEnvironmentalQualityAct(CEQA).Theappealmustbein writingstatingtheprecisebasisorissueasnoted,mustincludetheappropriatefilingfee,andmustbefiledwithin 10days ofthedecisiondatetotheCityofBakersfieldPlanningCommission(c/oBakersfieldPlanningDirector, 1715ChesterAvenue,Bakersfield,CA93301).ThePlanningCommissionwillholdapublichearingontheappeal andtheirdecisionwillbefinalunlesstheirdecisionisappealedtotheCityCouncil. GENERALCONDITIONS 1.InconsiderationbytheCityofBakersfieldforlanduseentitlements,includingbutnotlimitedtorelated environmentalapprovalsrelatedtoorarisingfromthisproject,theapplicant,and/orpropertyowner and/orsubdivider("Applicant"herein)agreestoindemnify,defend,andholdharmlesstheCityof Bakersfield,itsofficers,agents,employees,departments,commissionersandboards("City"herein) againstanyandallliability,claims,actions,causesofactionordemandswhatsoeveragainstthem,orany ofthem,beforeadministrativeorjudicialtribunalsofanykindwhatsoever,inanywayarisingfrom,the termsandprovisionsofthisapplication,includingwithoutlimitationanyCEQAapprovaloranyrelated developmentapprovalsorconditionswhetherimposedbytheCity,ornot,exceptfor/Lƭsoleactive negligenceorwillfulmisconduct.
