AN ORDINANCE OF THE BAKERSFIELD CITY COUNCIL
APPROVING AN AMENDMENT TO TITLE 17 OF THE BAKERSFIELD
MUNICIPAL CODE TO CHANGE THE ZONE CLASSIFICATION
FROM M-1 (LIGHT MANUFACTURING) TO R-4 (HIGH DENSITY
MULTIPLE FAMILY DWELLING), LOCATED AT 3300 RIO MIRADA
DRIVE (GPA/ZC NO.21-0326).
WHEREAS, Vision Housing Ventures is requesting: (1) an amendment to the land
use map designation of the Metropolitan Bakersfield General Plan from HC (Highway
Commercial) to HR (High Density Residential); and (2) an amendment to Title 17 of the
Bakersfield Municipal Code to change the zone classification from M-1 (Light
Manufacturing) to R-4 (High Density Multiple Family Dwelling) on 4.33 acres located at
3300 Rio Mirada Drive (the "Project"); and
WHEREAS, the Planning Commission held a public hearing on March 10, 2022,
and accepted public testimony both in support and opposition. Following deliberations,
the Commission approved Resolution No. 32-22, which recommended that the City
Council approve the Project; and
WHEREAS, the City Council held a public hearing on February 20, 2022 at which
time a related General Plan Amendment was approved for the Project; and
WHEREAS, the City Council considered all facts, testimony, and evidence
concerning the Project, including the staff report, and the Planning Commission's
deliberation, and action; and
WHEREAS, the Project is consistent with the Metropolitan Bakersfield General Plan.
SECTION 1.
NOW, THEREFORE, BE IT ORDAINED by the Bakersfield City Council as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The Planning Commission's findings as contained in its Resolution No. 32-22
are hereby adopted.
3. The Project is hereby approved incorporating the change into the official
zoning map as described in Bakersfield Municipal Code Section 17.06.020
as specifically described in Exhibit A and located on the map as shown in
Exhibit B, all of which are incorporated herein.
SECTION 2.
This ordinance must be posted in accordance with the Bakersfield Municipal
Code and will become effective not less than 30 days from and after the date of its
passage.

GENERAL PLAN AMENDMENT/ZONE CHANGE
FROM HIGHWAY COMMERCIAL (HC) TO HIGH DENSITY RESIDENTIAL (HR)
FROM M-1 (LIGHT INDUSTRIAL) TO MULTI -FAMILY (R-4)
Being a portion of Parcel 1 of Parcel Map No. 6774, recorded July 27, 1983 in Book 29 of Parcel Maps at
Page 171 in the Kern County Recorder's Office; excepting therefrom those portions of land conveyed to
the State of California by Grant Deeds recorded May 5, 2000 as Document No. 0200054384, O.R. and
Document No. 0200054385, O.R. Also being a portion of the East Half of the Southeast Quarter of
Section 14, Township 29 South, Range 27 East, M.D.M., City of Bakersfield, County of Kern, State of
California, more particularly described as follows:
BEGINNING at the Southeast corner of said Parcel 1, said point being on the Northerly right-of-way of
Rio Mirada Drive; thence along the boundary of said Parcel 1 and said Northerly right-of-way the
following three courses;
1) South 73°00'48" West, 47.00 feet to the beginning of a curve concave to the Northwest having a
radius of 270.00 feet;
2) Southwesterly along said curve through a central angle of 17°13'00" and an arc length of 81.13
feet;
3) North 89°46' 12" West, 236.07 feet;
Thence Leaving the boundary of said Parcel 1 and said Southerly right-of-way North 00°13'48"
East, parallel with the East line of said Parcel 1, a distance of 321.74 feet;
Thence North 89'46' 12" West, parallel with the South line of said Parcel 1, a distance of 188.67
feet to the Easterly right-of-way of Buck Owens Boulevard, per said Grant Deed recorded
as Document No. 0200054385, O.R., and the beginning of a non -tangent curve concave
to the Southeast having a radius of 496.46 feet to which point a radial line bears North
58°51'57" West;
Thence Along said Easterly right-of-way the following two courses;
1) Northeasterly along said curve through a central angle of 13°11'29" and an are length of
114.30 feet;
2) North 44°19'32" East, 129.43 feet to the boundary of said Parcel 1;
Thence Along the boundary of said Parcel 1 the following three courses;
1) Leaving said Easterly right-of-way South 79°24' 17" East, 331.94 feet;
2) South 89°46'38" East, 63.54 feet;
3) South 0093'48" West, 419.45 feet to the POINT OF BEGINNING.
