Oncethecorrectionsnotedintheattachedsiteplancompliancelisthavebeenmade,theproposalwillmeetthe minimumrequiredcodes,policiesandstandardsfordevelopmentasadoptedbytheBakersfieldCityCouncil. TheSitePlanReviewCommitteewillreviewthesefinalplanswhilebuildingplancheckoccurstoensurethatyou satisfytheitemsintheSitePlanComplianceList.Pleasereadthemcarefully.Failuretosatisfyanitemmay delayyourobtainingabuildingpermitorcommencingyourproject. AfterconstructionofyourprojectbutbeforetheCitycanallowoccupancy,theBuildingDivisionmustinspect thedevelopmenttofindifitcomplieswiththeapprovedplans,andanyotherrelevantpermitsandcodes.Ifyou havesatisfiedalloftherequirements,theBuildingDirectorwillissueacertificateofoccupancy;ifnot,thearea inspectorwillgiveyouacorrectionnotice.Onceyouhavemadeallofthecorrections,theBuildingDirectorcan issueacertificateofoccupancy.YoumaynotoccupyadevelopmentuntiltheBuildingDirectorhasissueda certificateofoccupancy. INDEMNIFICATIONCONDITION InconsiderationbytheCityofBakersfieldforlanduseentitlements,includingbutnotlimitedtorelated environmentalapprovalsrelatedtoorarisingfromthisproject,theapplicant,and/orpropertyownerand/or subdividerΛͻ!ƦƦƌźĭğƓƷͼherein)agreestoindemnify,defend,andholdharmlesstheCityofBakersfield,its officers, agents,employees,departments,commissionersandboardsΛͻ/źƷǤͼherein)againstanyandallliability, claims,actions,causesofactionsordemandswhatsoeveragainstthem,oranyofthem,beforeadministrativeor judicialtribunalsofanykindwhatsoever,inanywayarisingfrom,thetermsandprovisionsofthisapplication, includingwithoutlimitationanyCEQAapprovaloranyrelateddevelopmentapprovalsorconditionswhether imposedbytheCity,ornot,exceptfor/źƷǤƭsoleactivenegligenceorwillfulmisconduct. ThisindemnificationconditiondoesnotpreventtheApplicantfromchallenginganydecisionbytheCityrelated tothisprojectandtheobligationsofthisconditionapplyregardlessofwhetheranyotherpermitsor entitlementsareissued. TheCitywillpromptlynotifyApplicantofanysuchclaim,action,orproceeding,failingunderthiscondition withinthirty(30)daysofactuallyreceivingsuchclaim.TheCity,initssolediscretion,shallbeallowedtochoose theattorneyoroutsidelawfirmtodefendtheCityatthesolecostandexpenseoftheApplicantandtheCityis notobligatedtouseanylawfirmorattorneychosenbyanotherentityorparty. REVISIONSTOTHEAPPROVEDPLAN Anytimeaftersiteplanapprovalbutbeforetheapprovalexpires,youmaysubmitrevisionstotheplan.Wewilltreat theserevisionsasanewsiteplanapplicationsubjecttoanewreviewandrequiredfees.ThePlanningDirectorcan onlyapproveminorchangestotheoriginalplanwithoutanewapplicationiftheyarenecessarytomeetacondition, mitigation,orresultfromphysicalobstaclesorothercomparableconstraints(SeeSection17.08.080.c.3oftheZoning Ordinance). EXPIRATIONOFPLANS Thissiteplanexpireson May10,2024(2yearsfromthedecisiondate),unlessbuildingpermitshavebeen issued,orwheretheusehascommencedonprojectsnotrequiringabuildingpermit.Theprojectmustbe completedwithin5yearsfromthedecisiondate.Ifthepropertyisrezoned,siteplanapprovalwillexpireupon theeffectivedatefortherezoningunlesstheuseispermittedinthenewzone. ThePlanningDirectormayextendtheexpirationdateuptoone(1)yearifyouresubmitnewplansforcheck againstthecoderequirementsineffectatthattimeandincludeawrittenrequestfortheextension.Wemust receivethisrequest before expirationoftheprojectapproval.Wewillnotrequireafeeforthisextension request;however,changestotheplansoriginallyapprovedforpurposesotherthancoderequirementsshallbe subjecttoanewsiteplanreview,includingpaymentofallrequiredfees(SeeSection17.08.080.DoftheZoning Ordinance). ENVIRONMENTALDETERMINATION ThissiteplanreviewhasbeenfoundtobeexemptfromtheprovisionsoftheCaliforniaEnvironmentalQualityAct (CEQA)accordingtoSection15303.ThisprojectisexemptbecauseitisaClass3projectconsistingoftheconversion ofexistingsmallstructuresfromoneusetoanotherwhereonlyminormodificationsaremadeintheexteriorofthe structure.ANoticeofExemptionhasbeenpreparedandisavailableforreviewatthePlanningDivision. SPR220169Page|2of5 APPEAL Anypersonmayappealthisdecision.Anappealislimitedtowhetherornotanadopteddevelopmentstandard, zoningregulation,mitigation,orpolicyappliedornotappliedtotheproject,wasdoneconsistentwiththe authoritygrantedbycityordinancesortheCaliforniaEnvironmentalQualityAct(CEQA).Theappealmustbein cisebasisorissueasnoted,mustincludetheappropriatefilingfee,andmustbefiled writingstatingthepre within 10days ofthedecisiondatetotheCityofBakersfieldPlanningCommission(c/oBakersfieldPlanning Director,1715ChesterAvenue,Bakersfield,CA93301).ThePlanningCommissionwillholdapublichearingon theappealandtheirdecisionwillbefinalunlesstheirdecisionisappealedtotheCityCouncil.
