HomeMy WebLinkAboutRES NO 093-2022RESOLUTION NO. 0 9 3 v 2 0 2 2 RESOLUTION ADOPTING NEW SEWER RATES FOR FISCAL YEAR 2022/2023 WHEREAS, Chapter 14.12 of the Bakersfield Municipal Code authorizes the City Council of the City of Bakersfield (City) to establish fees and charges to recover costs for services rendered; and WHEREAS, the Wastewater Revenue Program for the City of Bakersfield Wastewater and Stormwater Facilities was developed in 1978 to establish sewer user rates for residential, commercial, and industrial users to cover costs incurred for the maintenance and operation of the City's two wastewater treatment plants, wastewater sewer, and storm sewer; and WHEREAS, the last review and update to the Wastewater Revenue Program was approved by the City Council on June 4, 2014; and WHEREAS, City selected HF&H Consultants through a formal Request for Qualifications/Proposal process to review and provide recommended updates to the Wastewater Revenue Program; and WHEREAS, HF&H Consultants completed their evaluation and provided recommendations; and WHEREAS, proposed changes were presented to the Budget and Finance Committee on February 28, 2022, and to City Council on March 16, 2022; and WHEREAS, City staff was given permission to move forward with the proposed changes; and WHEREAS, City staff prepared and mailed a notice of public hearing to residential and commercial users, as required by Proposition 218, notifying them of the proposed rate increases (Cal. Constitution Article XIIID, section 6); and WHEREAS, a public hearing before the City Council was advertised twice in the Bakersfield Californian, a newspaper of general circulation; and WHEREAS, a public hearing was held in order to receive evidence and hear all persons interested in or objecting to the proposed rate increases; and WHEREAS, the adoption of sewer fees is exempt from the California Environmental Quality Act (CEQA) under the California Public Resources Code Section 21080(b)(8); and ,� 1 F- Fn ORIGINAI `� WHEREAS, the City Council has considered the staff report, public comments, information presented at the public hearing, and written protests; and WHEREAS, the Rate Schedule for Fiscal Year 2022/2023, attached hereto as Exhibit A and incorporated by reference herein, summarizes both residential and commercial rates proposed for Fiscal Year 2022/2023, including the flat rate fees collected on the property tax bill. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals and findings are true and correct and are incorporated herein by reference. 2. The Council finds that insufficient written protests were presented to prevent the proposed changes. 3. The Council ratifies the Proposition 218 process followed by the City. 4. The Council adopts the fees and charges established in Exhibit A. 5. This Resolution is effective July 1, 2022. The minimum sewer charge for all properties is equal to the single family residence rate. Note 2: Sewer fees for commercial and industrial users are estimated using lower of (1) winter months annualized water consumption (sum of January, February and December multiplied by four) or (2) actual water consumption form prior calendar year.
