RESOLUTION DECLARING REAL PROPERTY EXEMPT SURPLUS LAND
AND SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE
FINANCE DIRECTOR TO NEGOTIATE ITS SALE.
WHEREAS, the City owns a fee simple interest in property located on the west side of
Wible Road between Amazon Drive and Hosking Avenue in Bakersfield, California
("Property"); and
WHEREAS, City desires to sell the property located at 7821 Wible Road, Bakersfield,
CA (APN 515-040-21 ) to a qualified affordable housing developer to develop the property;
and
WHEREAS, the Bakersfield Planning Department found the sale of this property to be
consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government
Code Section 65402; and
WHEREAS, on September 1, 2021 the Bakersfield City Council adopted Resolution No.
158-2021 declaring Property (formerly known as 7721 Wible Road) surplus to the needs of the
City of Bakersfield in accordance with Government Code Section 54220-54234; and
WHEREAS, the Bakersfield City Council desires to rescind Resolution No. 158-2021 and
declare the Property exempt surplus land in order to conduct an open, competitive bid
process for the Property's disposition in accordance with Government Code Section
54221(f) (1) (F) (i); and
WHEREAS, the Property is exempt surplus land because staff intends to initiate a
competitive bid process consistent with Government Code Section 54221(f)(1)(F)(i) to sell the
Property.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows:
1. The foregoing findings and recitals are true, correct, and incorporated herein.
2. City Council Resolution No. 158-2021 declaring the property (formerly known as
7721 Wible Road) as surplus land in accordance with Government Code Section
54220-54234 is hereby rescinded and no longer in effect.
3. The City Council finds and declares that the Property is exempt surplus land
because staff intends to an initiate a competitive bid process in accordance with
Government Code Section 54221(f)(1)(F)(i) to sell the Property.
4. The Property is hereby declared surplus to the City's needs, and the Finance
Director is authorized to begin the competitive bid process to dispose of the Property.
