RESOLUTION OF INTE9''TIO TO IMPROVE
STREPT DISTRICT NO. ��/Y IN THE
CITY OF BAK7RSFTELD, A.__ RI`IA.
BE IT RESOLVED BY TH? C011NCTL OF THE 1ITY OF BAKrRSFI3D,
as follows:
That it is the intention of the City Council of the City
of Bakersfield, to order the followlrg ;pork to be done and improve-
ment to be made in said City, to -wit:
SECTION 1. (Bank Street)
To construct curbs, gutters and sidewalk where shown on the
plan for said work on either side of Bank Street between the east-
erly line of Oleander Avenue and the westerly line of H Street
SECTION 2. (Grades)
All of the above work on Bank Street is to be done to
such grades as are shown on the plan and profile for said work
and are hereby established as the offl.cial grades for the doing
of said work and the making of said improvement.
All in the City of Bakers-ield, County of Kern, State of
Califor,_ia.
All of said work and improvement is to be don^_ in accord-
ance with the plan and specifications heretofore and on the i�__k
day of March, 1929, adopted by the Council of the City of Bakers-
field, said plan being entitled "PLAN FOR THE IYPROVP'.PIv'T OF STREET
DISTRICT N0. S/ y ", and said specifications being entitled "SPEC-
IFI^.ATIOATS FOR THP IRIPROVE'i?NT OF STRE-,T DISTRICT NO. -9y "
and which said plan and specifications are on file in the office of
the City Clerk of the City of Bakersfield, and are hereby referred
to and by such reference made a part and port'_on hereof, and in
t',_is connection the said plan and specifications also show the exact
location of the aforesaid work.and improvement.
AND `+'HFREAS said contemplated work and improvement in the
opinion of said City Council is of more than local or ordinary
public benefit, said Council hereby makes the costs and expenses
of said work and improvement chargeable upon a district, :which dis-
trict said City Council hereby declares to be the district benefited
by said work and improvement and to be assessed to pay the costs
and expenses thereof, and which said district is bounded and des-
cribed as follows;
Beginning at a point in the easterly line of Oleander
avenue 150 feet southerly from the southerly line of Bank Street;
thence easterly and parallel with the southerly line of Bank
Street to the westerly line of H Street; thence northerly along
the westerly line of H Street to a point 124 feet northerly
from the northerly line of Bank Street;.thence westerly and parallel
with the northerly line of Bank Street to the easterly line of
Oleander avenue; thence southerly along the easterly line of Oleander
Avenue to the point of beginning.
All in the City of Baker Field, County of Kern, State
of California.
All of the herein proposed work shall be done in pursuance
of an act of the Legislature of the State of California, designated
the "Improvement Act of 1911" approved April 7th, 1911, and all
acts amen''_atory thereof.
Notice is hereby given that on Monday, the /r- `aay of
April 1929, at 8 o'clock P. M. at a regular meeting of the said
City Council in the Council Chamber of said lity Council in the
City Hall of the 01ty of Balrersfield, any and all persons having
any objections to the proposed work or improvement may appear before
said Citv Council and show cause why said proposed improvement should
not be carried out in accordance •with said Resolution.
The City Clerk of said City shall cause this Resolution of
Intention to be published twice in the The Daily Report, a daily
newspaper printed, publis'ed and circul4tel in said lity of Bakers-
field, and hereby designated for that purr•ose by said City Council.

The Street Superintendent of said City of Bakersfield shall
cause to be conspicuously posted along the lines of said contemplated
work and improvement and along the open streets within said district
notice of the passage of this Resolution of Intention in the manner
and form required by law.

And it is agreed and expressly understood by the parties to this agreement, that in no case will the City of Bakersfield, or any officer
thereof, be liable for any portion of the expense of the work aforesaid nor for any delinquency of persons or property assessed.
And it is further stipulated and agreed by the parties to this agreement that under it eight hours of labor shall constitute a legal
day's work, and the said party of the first part shall not require more than eight (8) hours of labor in a day from any person employed by
said first party in the performance of said work, except in case of extraordinary emergency caused by fire, flood or danger to life or property;
and it is further agreed that the party of the first part shall forfeit, as a penalty, to the City of Bakersfield, the sum of ten (10) dollars for
each laborer, workman or mechanic employed in the execution of this contract by him, or by any sub -contractor under him, for each calendar
day during which such laborer, workman or mechanic is required or permitted to labor more than eight hours in violation of the provisions
of Section 653-C of the Penal Code of the State of California or Section 143 of the Charter of the City of Bakersfield.
And it is further stipulated and agreed that the minimum compensation to be paid for labor upon all work performed under this con-
tract shall be three (3) dollars per day.

NOTICE OF THE FILING OF ASSESSMENT
AND THE TIME OF HEARING.
NOTICE IS HEREBY GIVEN that on Thursday the llth day of
July, 1929, there was filed with the undersigned 6it7 Clerk an as-
sessment to cover the sum due for the work performed and improvement
made by DEAN & STROBLE, contractors, under and in pursuance of the
provisions of the "Improvement Act of 1911", reference being made to
Resolution of Intention No. 592, of the City Council of said City
passed March 25, 1929, for the description of said work and improve-
ment, said assessment being made in conformity with the provisions of
Sections 20 and 21 of said Act, according to the character of the
work done;
Said assessment shows the amount to be paid on said contract
for the work contracted for and performed, together with all incident-
al expenses, the amount of each assessment against each lot or portion
or portions of a lot so assessed, and has attached thereto a diagram
exhibiting each street and street crossing, lane, alley, place or
court, property or rights of way on which any work has been done, show-
ing the relative location of each lot or portion of lot, to the work
done, numbered to correspond with the numbers of the assessments.
NOTICE IS HEREBY GIVEN that Monday, the 5th day of August,
1929, at the hour of S o'clock P. M. is the time fixed by the under-
signed Clerk when all persons interested in the work done, or in the
assessment may appear at the City Hall in the Council Chambers and
be heard by the City Council.
The owners, the contractor, or its assigns, and all other
persons interested in said work, or in the assessment, feeling ag-
grieved by any act thereto, or who claim that the work has not been
performed according to the contract, in a good and substantial
manner, or who claim that any portion of the work for any reason
was omitted or illegally included in the contract for the same, or
having or making any objection to the correctness of the easement
or diagram or other act, determination or proceedings of the Super-
intendent of Streets, or City Engineer, shall prior to the day fixed
for said hearing, appeal to the City Council by briefly stating in
the grounds of appeal.

Pursuant to a Resolution of the Council of the City
of Bakersfield, adopted the 15th day of April, 1929, direct-
ing this notice and to statute in such ease made and provided,
said Council hereby invites sealed -roposals or bids for doing
the 'work described in Resolution of Intention No. 592, passed
and a,,optod by the said City Council on the 25th day of March,
1929, which said Resolution of Intention is on file with the
City Clerk of the City of Bake°sfield.
For full and complete particulars regarding said work
and improvement to be made and the district to be assessed
therefor, reference is hereby made to said Resolution of Inten-
tion No. 592, "Plan for the Improvement of Street District Yo.
592", and "Snecifi.oations for the Improvement of Street District
No. 592", adopted by the Council of the City of Bakersfield on
the 25th dap of March, 1929, and are on file in the office of
the City Clerk.
All proposals nr bids shall be accomnanied by a check
payal,le to the City of Bakersfield, certified by a responsible
bank for an amount which shall not be less than ten per cent of
the aggregate of -the proposals, or else by a bond for the said
amount, payable as aforesaid, signed by the bidder and two
sureties, who shall justify before any officer competent to ad-
minister an oath, in double the said amount and over and a'-ove
all sta.tuto^v exemptions.
All sealed Tro.osal.s or bids shall be delivered to
the Clerk of said Council on or before 5 o1clock F. hi., V ondav,
the 29th day of A_wril, 1929, said time being not less than ten
days from the firt oubli+ation and posting of this notice; all
bids so received shall be opened by the said Council in open
session at 8 o'clock P. V1. of the said day.
All bids must be submitted on blanks to be furnished
by the City Clerk.
Bidders will state in their proposal the price of each
item separately as set forth therein, by which the bids will be
compared.
