And it is further stipulated and agreed by the parties to this agreement that under it eight hours of labor shall constitute a legal day's work, and the said party of the first part shall not require -more than eight (8) hours of labor in a' day from any person employed by said first party in the performance of said work, except in case of extraordinary emergency caused by fire, flood or danger to life or property; and it is further agreed that the party of the first part shall forfeit, as a penalty, to the City of Bakersfield, the sum of ten (10): dollars for each laborer, workman or mechanic employed in the execution of this contract by him, or by any sub -contractor under him; for each calendar day during which such laborer, workman or mechanic. is required or permitted to labor more than eight hours in violation of the provisions of Section 653-C of the Penal Code of the State of California or Section 143 of the Charter of the City of Bakersfield. And it is further stipulated and agreed that the minimum compensation to be paid for labor upon all work performed under this con- tract shall be three (3) dollars per day.
