S$?-IN ThE CITY OF BAKER SFIELD, CALIFURNIA, AND TO ISSUE BONDS IN PAIMENT TiiERE- FOR. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: That it is the intention of the City Council of the City of Bakersfield to order the following work to be done and improvement to be made in said City, to -wit: SECTION 1. That 19th Street between the easterly line of N Street and the westerly line of Union Avenue and East 19th Street between the easterly line of Union Avenue and the westerly line of Baker Street, be improved by the construction and installation thereon of an orna- mental electrolier street lighting system with one hundred and five... (105) electrolier standards and all necessary conduits and appurtenant including electrolier standards of the Union Metal Manufacturing Compa design No. 1891, built to obtain a light center of fifteen (15) feet and ten (10) inches, complete as described, with catalogue No. 280382, General Electric Form 12 Novalux Unit, and Catalogue No.'4X569 General Electric 'rype I. L. Transformer. All electroliers to be set on Portland Cement concrete foundations. Also, that conduit be installed to transformer locations for connection to current supply lines. All of said work and improvement is to be done in acnordance with the plans and specifications heretof ire and on the ?,0,6k day of August, 1928, adopted by the City Council of Bakersfield, said plans being entitled "PLAN FuR THE IMPRuVEmEN'i' OF STRICT DISTRICT NO.,S�ooy " and said specifications being entitled "SPEC IN'iCATTU11S FOR TEE IIvIPRuVEHENT OF STREET DISTRICT NO -ay" and which said plans and specifications are on file in the office of the City clerk of the City of Bakersfield, and are hereby referred to and by such reference made a part and portion hereof. Attention is called to the License Agreement of the Street Lighting & Equipment Company of California, of date August i 9 , 1928, and on file in the office of the City Clerk. And Whereas, said contemplated work and improvement in the opinion of the said City Council is of more than local or ordinary public benefit, said Council hereby makes the costs and expenses of said work and improvement chargeable upon_ a district, which district said City Council hereby declares to be the district benefitted by said work and improvement and to be assessed to pay the costs and expenses thereof, and which said district is bounded and described as follows; Beginning at a point in the center line of N Street, 132 feet northerly from the northerly line of 19th Street, thence easterly and parallel with the northerly line of 19th street and the easterly extension thereof to the easterly line of Union Avenue, thence continuing easterly and parallel with the northerly line of East 19th Street to a point which is 275 feet, measured at right angles, westerly from the westerly line of Sonora Street; thence Northerly and parallel with the westerly line of Sonora Street to a point which is 160 feet, measured at right angles, northerly from the northerly line of Grove Street; thence easterly and parallel with the northerly line of Grove Street and the northerly line of East 19th Street to the center line of Baker Street; thence southerly along the center line of Baker Street to a point 160 feet southerly from the southerly line of East 19th Street; thence westerly and parallel with the southerly line of East 19th Street to the westerly line of Sonora Street; thence con- tinuing westerly at right angles with the westerly line of Sonora Stre, 280 feet; thence southerly along a line which is 280 feet westerly froi and parallel with the westerly line of Sonora Street to its intersecti, with a line which is 152 feet southerly from and parallel with the southerly line of East 19th Street; thence westerly and parallel with the southerly line of East 19th Street, and the westerly extension (page 2) thereof to the westerly line of Union Avenue; thence continuing westerly along a line 132 feet southerly from and parallel with the southerly line of 19th Street to the center line of N Street; thence northerly along the center line of N Street to a point 132 feet Northerly from the northerly line of 19th street and the point of beginning. All in the City of Bakersfield, California, as shown on Maps thereof filed in the office of the County Recorder, as follows: "Map of the City of Bakersfield, Kern County, California," filed November 25, 1898. "Map of Bakersfield, Kern County, California, showing East Bakersfield, formerly Sumner", filed January 12, 1889. Notice is hereby given that serial bonds to represent unpaid assessments, and bear interest at the rate of seven (7%) per cent per annum will be issued hereunder in the manner provided by the Improve- ment Bond Act of 1915, and all acts amendatory thereof, the last installment of which bonds shall mature nine years from the 2nd day of July next succeeding ten months from their date. Except as hereinabove otherwise provided for the issuance of said serial bonds all of the herein proposed work shall be done in pursuance of an act of the Legislature of the State of California, designated the "Improvement Act of 1911", approved`April 7th, 1911, and all acts amendatory thereof. Notice is hereby given that on 1!,ues3ay,'-jhe ZL day of 1928, at 8 o'clock P. M. at a regular meeting of the said City Counci in the Council Chambers of said City Council in the City Hall of the City of Bakersfield, any and all persons having any objections to the proposed work or improvement may appear before said City Council and show cause why said proposed improvement should not be carried out in accordance with said Resolution. The Cit7 Clerk of said City of Bakersfield shall cause this Resolution of Intention to be published twice in the The Daily Report a daily newspaper printed, published and circulated in said City of (Page 3) Bakersfield, and hereby designated for that purpose by said City Council. The Street Superintendent of said City of Bakersfield shall cause to be conspicuously posted along the lines of said contemplated work and improvement and along all the open streets within said distr: notice of the passage of this Resolution of Intention in the manner and form required by law, and in said notice he shall call attention to the License Agreement of the Street Lighting & Equipment Company of California, of date August 18, 1928, on file in the office of the City Clerk. Dear Sir: G U S E X ECVT OFFICES 20IL- x NIARKI:T STRUSTS LAKESIDE 9100 APR - 81929 We have just received your post card notice concerning Assessments Nos. 13 and 14 under the Improvement Bond Act of 1915 for electroliers on Nineteenth. Street, Bakers- field. Being unable to appear before your City Council on the evening of April 8th to show cause why bonds should not be is- sued upon the security of the unpaid assessments now charged to California Transit Company, I would thank you if you would sub- mit to the Council, this letter with the inclosures. In February we received assessment notices on Assessments 13 and 14 and they were returned to Municipal Bonding Company, Los Angeles, with an explanation as to why such assessments were not payable by this company. On March first Municipal Bonding Company returned them to us claiming that our tax exemption did not include such assessments. On March 4th we wrote Municipal Bonding Company briefly stating our position in this regard. Attorneys for Municipal Bonding Company replied to this letter on March 14th and we replied to these attorneys on March 18th, sending a complete copy of the correspondence to the Board of Equalizabion for their informa- tion and advice if they desired to give it. To date there have been no replies to these letters of ours. That you may understand the situation thoroughly, we are inclosing herewith copies of all correspondence commencing March 4th. It is understood that if by reason of fire, flood, or for any other cause beyond the control of the Street Lighting and Equipment Company of California, it is unable, after the exercise of reasonable diligence to secure shipment of materials or procure the necessary labor for doing the work that a length of time will be granted to the Street Lighting and Equipment Company of California in which to comply with this offer corresponding to the length of time during which - 3 - it was unable, for any of the above causes, to proceed with its undertaking.
