RESOLUTION OF INTENTION TO 31YIPROVE
STREET DISTRICT NO. S$?-IN ThE
CITY OF BAKER SFIELD, CALIFURNIA,
AND TO ISSUE BONDS IN PAIMENT TiiERE-
FOR.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD,
as follows:
That it is the intention of the City Council of the City of
Bakersfield to order the following work to be done and improvement
to be made in said City, to -wit:
SECTION 1.
That 19th Street between the easterly line of N Street and
the westerly line of Union Avenue and East 19th Street between the
easterly line of Union Avenue and the westerly line of Baker Street,
be improved by the construction and installation thereon of an orna-
mental electrolier street lighting system with one hundred and five...
(105) electrolier standards and all necessary conduits and appurtenant
including electrolier standards of the Union Metal Manufacturing Compa
design No. 1891, built to obtain a light center of fifteen (15) feet
and ten (10) inches, complete as described, with catalogue No. 280382,
General Electric Form 12 Novalux Unit, and Catalogue No.'4X569 General
Electric 'rype I. L. Transformer. All electroliers to be set on
Portland Cement concrete foundations.
Also, that conduit be installed to transformer locations for
connection to current supply lines.
All of said work and improvement is to be done in acnordance
with the plans and specifications heretof ire and on the ?,0,6k day
of August, 1928, adopted by the City Council of Bakersfield, said
plans being entitled "PLAN FuR THE IMPRuVEmEN'i' OF STRICT DISTRICT
NO.,S�ooy " and said specifications being entitled "SPEC IN'iCATTU11S FOR
TEE IIvIPRuVEHENT OF STREET DISTRICT NO -ay" and which said plans and
specifications are on file in the office of the City clerk of the City
of Bakersfield, and are hereby referred to and by such reference made
a part and portion hereof.
Attention is called to the License Agreement of the Street
Lighting & Equipment Company of California, of date August i 9 , 1928,
and on file in the office of the City Clerk.
And Whereas, said contemplated work and improvement in the
opinion of the said City Council is of more than local or ordinary
public benefit, said Council hereby makes the costs and expenses of
said work and improvement chargeable upon_ a district, which district
said City Council hereby declares to be the district benefitted by
said work and improvement and to be assessed to pay the costs and
expenses thereof, and which said district is bounded and described
as follows;
Beginning at a point in the center line of N Street, 132 feet
northerly from the northerly line of 19th Street, thence easterly and
parallel with the northerly line of 19th street and the easterly
extension thereof to the easterly line of Union Avenue, thence
continuing easterly and parallel with the northerly line of East
19th Street to a point which is 275 feet, measured at right angles,
westerly from the westerly line of Sonora Street; thence Northerly and
parallel with the westerly line of Sonora Street to a point which is
160 feet, measured at right angles, northerly from the northerly line
of Grove Street; thence easterly and parallel with the northerly line
of Grove Street and the northerly line of East 19th Street to the
center line of Baker Street; thence southerly along the center line of
Baker Street to a point 160 feet southerly from the southerly line of
East 19th Street; thence westerly and parallel with the southerly line
of East 19th Street to the westerly line of Sonora Street; thence con-
tinuing westerly at right angles with the westerly line of Sonora Stre,
280 feet; thence southerly along a line which is 280 feet westerly froi
and parallel with the westerly line of Sonora Street to its intersecti,
with a line which is 152 feet southerly from and parallel with the
southerly line of East 19th Street; thence westerly and parallel with
the southerly line of East 19th Street, and the westerly extension

thereof to the westerly line of Union Avenue; thence continuing
westerly along a line 132 feet southerly from and parallel with
the southerly line of 19th Street to the center line of N Street;
thence northerly along the center line of N Street to a point 132
feet Northerly from the northerly line of 19th street and the
point of beginning.
All in the City of Bakersfield, California, as shown on
Maps thereof filed in the office of the County Recorder, as follows:
"Map of the City of Bakersfield, Kern County, California,"
filed November 25, 1898.
"Map of Bakersfield, Kern County, California, showing East
Bakersfield, formerly Sumner", filed January 12, 1889.
Notice is hereby given that serial bonds to represent unpaid
assessments, and bear interest at the rate of seven (7%) per cent per
annum will be issued hereunder in the manner provided by the Improve-
ment Bond Act of 1915, and all acts amendatory thereof, the last
installment of which bonds shall mature nine years from the 2nd day
of July next succeeding ten months from their date.
Except as hereinabove otherwise provided for the issuance
of said serial bonds all of the herein proposed work shall be done in
pursuance of an act of the Legislature of the State of California,
designated the "Improvement Act of 1911", approved`April 7th, 1911,
and all acts amendatory thereof.
Notice is hereby given that on 1!,ues3ay,'-jhe ZL day of
1928, at 8 o'clock P. M. at a regular meeting of the said City Counci
in the Council Chambers of said City Council in the City Hall of the
City of Bakersfield, any and all persons having any objections to the
proposed work or improvement may appear before said City Council and
show cause why said proposed improvement should not be carried out in
accordance with said Resolution.
The Cit7 Clerk of said City of Bakersfield shall cause this
Resolution of Intention to be published twice in the The Daily Report
a daily newspaper printed, published and circulated in said City of

Bakersfield, and hereby designated for that purpose by said City
Council.
The Street Superintendent of said City of Bakersfield shall
cause to be conspicuously posted along the lines of said contemplated
work and improvement and along all the open streets within said distr:
notice of the passage of this Resolution of Intention in the manner
and form required by law, and in said notice he shall call attention
to the License Agreement of the Street Lighting & Equipment Company of
California, of date August 18, 1928, on file in the office of the
City Clerk.
I HEREBY CERTIFY that the foregoing Resolution of Intention
was regularly introduced, passed and adopted by the Council of the
City of Bakersfield, at a regular meeting of said Council held on

(20) in number, in the aggregate sum of $3,789.08 and as set
out by number, denomination and dates of maturity in the order
providing for the issuance of street improvement bonds passed
by the Council of the City of Bakersfield on the 22nd day of

'r:TIEREAS, the Council of the City of Bakersfield, did c,n
the 20th day of August, 1928, pass its Resolution of Intention No.
582 for the construction of an electrolier slrstem on 19th Street
between N Street and Union hvenue, and on East 19th. Street between
Union �Ivenue and Baker Street, as described in :Resolution of Inten-
tion No. 582, under and pursuant to the provisions of the "Improve-
ment Pict of 1911", and amendments thereto and to the resolutions,
notices and other proceedings of said Council, duly adopted and
taken, reference to said resolution of intention being hereby
expressly made for further particulars; and
WHEREAS, the contract for said work and improvement was
duly awarded and thereafter duly completed to the satisfaction of
the Street Superintendent, and City Engineer of :Said City, and this
Council, whereupon an assessment, diagram and warrant were made,
recorded and delivered to the contractor in time, form and manner
as required by said act, any the contractor having made due return
thereon and the same _having been duly recorded; and
WHEREAS, on March 29th, 1929, the Street Superintendent
of said City made and filed with the Clerk of this City, a complete
list of all assessments unpaid thereunder upon the respective asses,
ment or diagram numbers thereon; whereupon said Clerk gave notice o:
the filing of said list, and fixed in said notice, T.onda7, the 8th
day of April, 1929, at the hour of 8 o+clock P. ivl. as the time when
interested persons might appear before the City Council and show
cause why bonds should not be issued upon the security of the unpaic
assessments shown on said list, said time being that of this regular
meeting of said board; and said board having 'ieard all objections
and having passed upon the same, it is'-'ereby determined that the
assessments unpaid thereunder and the aggregate amounts of the same

SECTION 2.
Said bonds shall be issued in series, and the unpaid
assessments as shown on said list filed by the Superintendent of
Streets and determined by the Council together with interest
thereon, shall remain and constitute a trust fund for the re-
demption and payment of said bonds and of the interest which may
be due thereon, which unpaid assessments shall be payable in
annual series corresponding in number to the number of series of
bonds issued, and an even annual proportion of each assessment shall

be _:gable in each year preceding the date of the maturity for
each of the several series of bonds issued, and such proportion of
each assessment coming due in any year, together with the annual
interest thereon, shall in turn be payable in installments as the
general municipal taxes of said City on real property are payable,
and shall become delinquent at the same times and in the same pro-
portionate amounts and bear the sane proportionate penalties for
delinquency.
Said bonds shall be signed by the Treasurer of said City
and countersigned by the Clerk who shall affix thereto the official
seal of said City; the interest coupons affixed thereto shall be
signed by the Treasurer or bear his engraved, printed or litho-
graphed signature: and such signing and. sealing of s^.id bonds by
said officers and signing of said coupons by said Treasurer shall
constituto and be a sufficient and_ binding execution of each and
every one of said bonds and all of the coupons thereof respectively.
Said bonds shall be substantially in the form set forth in said
Improvement Bond Act.
The interest coupons attached to each of said bonds and
evi-dencing the interest to accrue thereon shall be numbered con-
secutively and be substantially in the following form, to -wit -

We have just received your post card notice
concerning Assessments Nos. 13 and 14 under the Improvement
Bond Act of 1915 for electroliers on Nineteenth. Street, Bakers-
field. Being unable to appear before your City Council on the
evening of April 8th to show cause why bonds should not be is-
sued upon the security of the unpaid assessments now charged to
California Transit Company, I would thank you if you would sub-
mit to the Council, this letter with
the inclosures.
In February we received assessment notices
on Assessments 13 and 14 and they were returned to Municipal
Bonding Company, Los Angeles, with an explanation as to why
such assessments were not payable by this company. On March
first Municipal Bonding Company returned them to us claiming
that our tax exemption did not include such assessments. On
March 4th we wrote Municipal Bonding Company briefly stating
our position in this regard. Attorneys for Municipal Bonding
Company replied to this letter on March 14th and we replied to
these attorneys on March 18th, sending a complete copy of the
correspondence to the Board of Equalizabion for their informa-
tion and advice if they desired to give it. To date there
have been no replies to these letters of ours. That you may
understand the situation thoroughly, we are inclosing herewith
copies of all correspondence commencing March 4th.
In addition to this, we direct your atten-
tion to the provision of the statute concerning our payment of
a percentage of our gross receipts in lieu of all other taxes
and licenses which specifies that our property shall be taxable
to pay the principal and interest created and outstanding on
the first day of October, 1925. I understand that this bonded
indebtedness was not created until 1928 which furnishes an added

reason why, we having already paid the 4g% tax to the
State, our company should not have this assessment against
US. Whether, we having paid our taxes to the State, the
assessment is collectible from the State is a question be-
tween your city and the State on which it is unnecessary
to express an opinion.
We respectfully request that the assessments
above referred to so far as they relate to California Transit -
Company be cancelled.

of the City of Bakersfield, that street lighting system be
installed on certain streets in the City of Bakersfield; said
installation to consist of approximately 120 single light
electroliers with proper equipment for making a complete street
lighting installation, and
WHEREAS, the Street Lighting and Equipment Company of
California are the authorized local representatives of the
General Electric Company and"the Union DIetal Manufacturing
Company, who are the manufacturers of certain types of material
to be included in the plans and specifications for said system,
the Street Lighting and equipment Company of California
guarantees to furnish to the successful contractor on the
installation, or the City of Bakersfield, if it chooses to do
the work itself, or the property owners of the assessment
district, if they elect to install the equipment, the following
material manufactured by the General Electric Company and
the Union Mletal 17-lanufacturing Company at the prices herein
stated, provided that the order is placed with the Street
Lighting and Equipment Company of California by the successful

use any or all of the patents, trademarks, or trade names
now owned by the General Electric Company, or the Union Metal
Manufacturing Company, applying to this material, insofar as
such use may be necessary to the installation and operation
of this street lighting system.
It is understood that if by reason of fire, flood, or for
any other cause beyond the control of the Street Lighting and
Equipment Company of California, it is unable, after the
exercise of reasonable diligence to secure shipment of
materials or procure the necessary labor for doing the work
that a length of time will be granted to the Street Lighting
and Equipment Company of California in which to comply with
this offer corresponding to the length of time during which

it was unable, for any of the above causes, to proceed with its
undertaking.
The execution of -the contract for said work on the said
streets by the successful bidder and the City of Bakersfield
shall be deemed by the Street Lighting and Equipment Company of
California to bean acceptance of the proposal by the City
of Bakersfield and by the contractor and shall bind the under-
signed Street Lighting and Equipment Company of California
to this agreement.
The word "Contractor" as used herein shall be deemed to
include not only the successful bidder with whom such contract
may be made and entered into, but also property owners who may
elect to take any work and to enter into a contract therefor.
