The Fellowship will allow participants to work and learn alongside City staff in various departments. Individuals will earn $23 per hour, working approximately 20 hours per week. Eligible participants must be at least 18 years old by Sept. 6, 2022 and no older than 30 by Aug. 6, 2023. Applications are due to the Kern Community Foundation by 11:59 p.m., Friday, July 22. You can check out our social media posts about the program in both English and Spanish. Notable Items  The deadline for the Parks Master Plan survey is midnight Sunday, July 10. Everyone is encouraged to take the survey so the Recreation & Parks Department can receive valuable feedback about what the public wants to see in its parks moving forward. If you haven’t taken the survey yet, please do! Please feel free to share out this link to the survey to everyone you know: bit.ly/MyWishForBakersfieldParks. The more feedback we receive, the better our parks will be moving forward!  The Development Services Department and its General Plan Update consultant will host a virtual Visioning Workshop next week. You can sign up here, and check out our promotional video here (also posted on Visit Bakersfield’s Facebook and Instagram pages).  The City’s Solid Waste Division will host a pair of pop-up large trash item drive-thru events on Saturday, July 16 from 8 a.m. to noon. The events will be held at the parking lot of the Bakersfield Municipal Airport (2000 S. Union Avenue) and at 15050 Stockdale Highway. These events are part of Bakersfield’s Clean City Initiative and are only possible thanks to funding from the Public Safety & Vital Services (PSVS) Measure.  We’re getting into the hot summer months now and this is when the Water Resources Department tends to see increases in water use. We want to take a moment to remind all customers on the City’s Domestic Water System that we are still in Stage 2 of our drought mitigation plan. That includes restrictions on yard irrigation, including an even-odd address schedule: • Outdoor residential landscape and turf watering should be limited to no more than three days (recommended: no more than two); • Odd number addresses water on Tuesdays, Thursdays and Saturdays (or Tuesdays and Saturdays); • Even number addresses water on Wednesdays, Fridays and Sundays (or Wednesdays and Sundays); • No watering is permitted on Mondays; • Watering should be done between 6 p.m. and 9 a.m. for maximum General Information July 8, 2022 Page 3 efficiency. The California Water Resources Control Board also recently enacted restrictions for commercial businesses when it comes to watering non-functional turf. There is more information about resources for residents and businesses on the City’s website, including rebates, conservation kits and what the City is doing to combat the drought.  The parking lot of San Miguel Commemorative Grove will be closed from Tuesday, July 12 through Thursday, July 14 as a construction project is finished. Crews will be completing the installation of a perimeter barrier around the parking lot which will prevent unauthorized vehicle access. You may recall this project was started in March but was delayed due to the unavailability of some materials.  The City Clerk’s Office is accepting applications to fill vacancies on the Bakersfield Youth Commission: • Ward 3: regular appointment • Ward 4: regular appointment • Ward 5: regular and alternate appointments • Ward 6: regular and alternate appointments All applicants must be City residents, high school students, and have as close to a 3.0 GPA as possible. Applicants can apply in either the Ward in which they live and/or the Ward where their high school is located. Traffic Advisories  Overnight lane reductions planned on Allen Road Bridge Overnight lane reductions are planned for the Allen Road Bridge over the Kern River starting July 10 as the City of Bakersfield’s Public Works Department completes a joint sealing project on the bridge. Work on this project is expected to begin on Sunday, July 10. Traffic will be reduced to one lane in each direction over the river from 9 p.m. to 6 a.m. each night, Sunday through Friday. Work on this project is expected to be completed by Friday, July 22. Traffic delays are expected during these hours. Drivers are advised to use caution when travelling through the work zone and to allow for additional travel time, or to use alternative routes. The City thanks the public for its patience and understanding during the completion of these improvements. Please Note: Construction work may be postponed and rescheduled without notice due to inclement weather or other unforeseen conditions. One Item (All Wards) REGULAR MEETING – 5:15 p.m. CONSENT CALENDAR – ORDINANCES Item 7d. Second Reading of Shopping Carts Containment Ordinance (FR 06/15/22) (All Wards) On May 24, 2022, the Homelessness Ad Hoc Committee received a presentation, at the request of the Vice Mayor, about abandoned shopping carts and possible solutions. A draft ordinance was also presented, and the Committee voted unanimously to send the draft containment ordinance to Council. On June 15, the City Attorney once again presented a PowerPoint detailing the history of the containment ordinance. After discussion from Council, there was a Motion by Vice Mayor Weir to approve First Reading of the Shopping Cart Containment Ordinance; the motion passed unanimously. This is the second reading of an Ordinance Adding Chapter 9.29 to the Bakersfield Municipal Code Relating to Shopping Carts-Containment. The City Manager’s Office will present a subsidy program and contract for at least a one-time city-wide cart retrieval service at a later date. CONSENT CALENDAR – RESOLUTIONS Item 7f. Establishing Smart Cart Shopping Cart Containment Subsidy Program (All Wards) The containment ordinance requires all property owners of retail establishments within the City that provide shopping carts for use by their patrons. Each property owner will be responsible for developing, implementing, and complying with a shopping cart containment system. In order to assist businesses to comply with the new ordinance, the Economic and Community Development Department intends to develop a subsidy program to assist property owners with the required cost to comply with the new City standard. Existing property owners will be required to have systems in place by February 8, 2023. The resolution would authorize staff in the Economic and Community Development Department to build out the programs parameters and developing the required processes to facilitate the program. Item 7h. Designated Comparable Cities for Comparison Surveys of Employees’ Compensation. (All Wards) The framework of the City’s compensation plan has not been significantly restructured in over 30 years. Among other factors, this has affected the recruitment efforts of key positions and retention of highly qualified employees. To help address this issue, the City has agreed to conduct a salary survey for base salary and total compensation. To accomplish this, City Staff requested the contracted vendor for the classification and compensation study, Koff & Associates, review the 1991 comparable cities list for relevancy and possible updates. Koff & Associates assessed cities based on population, budget, staff size, cost of living, cost of labor, and geographic location. This list was presented to an internal staff committee, as well at the Personnel Committee. An overview of the study process and the recommended comparator list was then presented on the June 14, 2022 meeting. The recommend Survey Cities, in ranked order, are as follows: 1. City of Stockton 2. City of Fresno 3. City of Oxnard 4. City of Anaheim 5. City of Modesto 6. City of Sacramento 7. City of Burbank 8. City of Glendale 9. City of Pasadena 10. City of San Bernardino 11. City of Ontario 12. City of Clovis CONSENT CALENDAR - AGREEMENTS Item 7m. Memorandum of Understanding (Collective Partnership Agreement Letter) regarding the Community Economic Resilience Fund (All Wards). The State of California created the Community Economic Resilience Fund (CERF) to support regional economic development planning by investing in strategies and projects that help to diversify regional economies and develop sustainable industries that create high quality jobs. The City has been engaged with B3K which established a regional, inclusive planning process to map out the economic future of the Kern County region. This MOU will serve as an outline on how the City works with its partners in both the Planning and Implementation phases of the CERF Program. It is anticipated that the City’s significant investment in economic development and the strong connection between the City’s economic development strategic plan and regional economic initiatives will both leverage and support the CERF planning and implementation process. Consequently, the City will serve in a significant role in both the planning and implementation of the CERF strategy. Item 7u. Rapid Rehousing Services Grant ($112K) for Bakersfield Homeless Center. (All Wards) In 2019, the City received $3.27 million in Homeless Housing, Assistance and Prevention (HHAP) Program funds to be expended over a 2 – 5 year timeframe. From 2020 to 2021, the City approved plans for the use of HHAP funds and all but one grant was awarded at these meetings: the Bakersfield Homeless Center Rapid Rehousing Grant. This agreement provides $112,838.75 in additional funding for the Bakersfield Homeless Center’s Rapid Rehousing services and provide rental assistance and housing navigation case management services to people experiencing homelessness. Item 7Y. Additional $1.2 million for Community Action Partnership of Kern (CAPK) Food Bank (All Wards) The City amended an agreement with the Community Action Partnership of Kern (CAPK) for $1.2 million of Community Development Block Grant Coronavirus CARES (CDBG-CV) funds to expand the CAPK Food Bank. This project supports HUD’s Action Plan Goals No. 4 Foster community and economic development and No. 5 Enhance facilities and services for the non-homeless special needs population, including seniors, and persons with disabilities. Item 7z. Amended Agreement with Housing Authority of the County of Kern. (All Wards) The City of Bakersfield was allocated a total of four grants totaling $44.8 million through the Consolidated Appropriations Act of 2021 and the American Rescue Plan Act of 2021 (ARPA). The allocations are to be used for COVID related Emergency Rental Assistance (ERA) Programs. The City partnered with the Housing Authority of the County of Kern (HACK) to administer a unified local program under the four grants. At the start of the program, the City set aside one percent of the funds for City Administration of the four ERA grants. To date, the City still has $447,941.34 left in administrative funds. The City has amended its agreement with HACK to transfer the $447,941.34 to be used for direct emergency rental and utilities assistance. This amendment will add $447,941.34 to HACK’s established ERA Program for a total of $44,794,133.34. PUBLIC SAFETY/VITAL SERVICES MEASURE Item 7ak. Outlining the Administration of the Public Art Program (All Wards) With the adoption of the Fiscal Year 2022- 23 budget, City Council allocated $1.25 million in Public Safety & Vital Services funding for the purpose of establishing the City’s first Public Art Program. The purpose of this funding is to provide for the installation of public art projects to complement City Capital Improvement Program (CIP) projects. The resolution brought before Council designates all final approval authority to the City Council for all projects funded with the $1,250,000 Public Art allocation, including both CIP project installations and community grant awards. The administration structure of this program, including the assigned department and processing recommendations for soliciting, selecting, and approving all projects funded through this allocation, will be determined at a later date. Item 7an. Expanding Scope of Work for the Parks Department Master Plan Update (All Wards) On November 3, 2021, Council approved Agreement No. 2021-257 with MIG, Inc. (Design Consultant) for $522,085 for the Recreation and Parks Department Master Plan Update. As work progressed by the Design Consultant, Staff identified additional tasks which required the City expand the original scope of work. The additional tasks listed are as follows: • Kaiser Permanente Sports Village Engagement • Urban and Central City Tree Plan • Kern River Parkway Recommendations • McAllister Ranch Recommendations NEW BUSINESS 12a. Presentation by City Attorney’s Office on a Proposed Ordinance Prohibiting the Unlawful Possession of Catalytic Converters in the City (All Wards) The City Attorney’s Office will provide a presentation to City Council that explains the issue of unlawful possession of catalytic converters in the City. As directed, the City Attorney’s Office has drafted a proposed ordinance, which is modelled after the City of Artesia’s ordinance to make it a misdemeanor to possess a detached catalytic converter absent valid proof of lawful possession. It should be noted that none of the Top 10 Cities or Survey Cities appear to have adopted a local catalytic converter ordinance to date, and several are instead sponsoring and/or monitoring state legislation introduced by their respective local state politicians. Accordingly, staff recommends Council determination regarding the following options: 1. Provide direction to staff to bring back the attached proposed ordinance for First Reading at the August 17, 2022 City Council meeting; OR 2. Provide direction to staff to bring back a resolution in support of state legislation on the issue of catalytic converters; OR 3. Provide direction to staff to continue monitoring local ordinances and state legislation on the issue of catalytic converters and report back to Council and/or Committee at a future meeting. Prepared by: Gary Hallen, Assistant City Manager cc: Department Heads City Manager’s File City Clerk’s File News Media File The Rapid Response Team worked on several major encampment projects this week which included: The Sidewalk Under the Pacheco Bridge, The Kern River—West of Calloway Drive, and the Sump on Blue Mountain Way. RRT continues to be proactive in the parks around our city to maintain a clean and beautiful environment for the weekly Movies in the Park events. RRT increased efforts at Wilson Park this week for their showing of The Croods 2. Clean-up continues along the Kern River, this week focusing on the West Side of the Golden State Bridge, as well as the West side of Calloway Drive. Public encounters with the UTV’s continue to be positive. Instructors will be training additional city staff over the next few weeks to certify additional operators of the UTV’s . Panama Lane (Irrigation Repair – Vandalism) • The RRT replaced two irrigation backflow prevention assemblies that were vandalized and stolen. 2. MLK Park Community Center (Exterior Water Access Repair – Vandalism) • The RRT capped off 3 water access locations on the exterior side of the building due to ongoing vandalism. 3. Silver Creek Park (Fitness Equipment Removal) • The RRT assisted with removal of the damaged existing fitness equipment, as part of the fitness equipment renovation project. 4. Beach Park (Irrigation Repair) • The RRT repaired and relocated an irrigation line that was damaged during the construction of the skate park lighting project. 5. Mesa Marin Concession (Door Repair – Vandalism) • The RRT repaired two entry doors and installed two new locks for additional security on the doors, due to vandalism and forced entry. 6. Greystone Park (Trash Enclosure Repair – Vandalism) • The RRT repaired two damaged security locks on the trash enclosure doors, due to vandalism. 7. Yokuts Park (Drain Grate Replacement – Vandalism) • The RRT replaced a missing drain grate located on the northwest corner turf area. 8. Beach Park (Sink Replacement – Vandalism) • The RRT replaced the sink inside the women’s restroom due to vandalism. 9. Saunders Park (Homeless Encampment Clean-Up) • The RRT assisted Code Enforcement with trash removal from homeless encampments set up at the northwest side of the park. • 2 sites were addressed. • Trash loads were placed inside the rear loader truck for disposal, provided by Code Enforcement. 10. Aera Park (4th of July Fireworks Event) • The RRT temporarily removed the shade sails at the east ball field as part of the 4th of July Fireworks event. • The RRT will reinstall the shade sails on 7/5/2022. Miscellaneous: 1. 1218 Baker Street (Tree Grate Adjustment) • The RRT grinded down the tree roots and adjusted the existing metal tree grate opening. 2. The Park at Riverwalk (Mobile Restrooms) • The RRT delivered and assembled three mobile restroom units for the scheduled 4th of July Fireworks event. 3. Kaiser Permanente Sports Village (Storm Drain Line) • The RRT pumped out water from the storm drain outlet structure, into the lake, that was backed up in the storm drain line preventing the contractor from connecting the new line as part of the Phase 4 new construction.
