BE IT RESOLVT'D BY TL'•E CJ UNCT L OF THE CITY OF BAKE'RS- FIELD, as follows: That it is the intention of the City Council of the City of Bakersfield, to order the following workto be done and improvement to be made in said City, to -wit: SECTION 1. To construct, reconstruct and repair cement concrete curbs and sidewalks where shown on the plan for said work on the following described streets, to -.:nit: (a) 21st Street from the easterly curb line of `pester Avenue to the westerly line of N Street, and from the easterly curb line of P Street to the westerly curb line of R Street; (b) 20th Street from the easterly line of Chester Avenue to the westerly curb 'line of R Street; (c) 19th Street from the easterly curb line of Chester Avenue to the westerly curb line of R Street. SECTION 2. All of the said work and improvement shall be done to such grades as established by Ordinance No. 175 to which reference is hereby made regarding such grades. All of such work and improvement is to be done in accordance with the plan and specifications heretofore and on the_�'day of &larch, 1928, adopted by the Council of the City of Bakersfield, said plan being entitled "PLAN FuR THE IMPROVEMENT OF STREET DISTRICTJ1� , and -said specifications being entitled "SPECIFICATIONS FUR THE T11PROVET0'17NT OF SIRE:�T DISTRICT No.�7�", and which said plan and specifications are on file in the office of the City Clerk of the City of Bakersfield, and are hereby referred to and by such reference made a part and portion hereof, and in this -1- connection the said plan and specifications also show the exact loca- tion of the aforesaid tirork and improvement. .zDID '°THFREAS said contemplated work and improvement in the opinion of said City Council is of more than local or ordinary public benefit, said Council hereby manes the costs and expenses of said work and improvement chargeable upon_ a distiri,t, which district said City Council hereby declares to be the district benefited by said virorl, and improvement and to be assessed to pay the costs and expenses thereof, and which said district is bounded and described as follows: Beginning at a point in the center line of Chester Avenue 132 feet southerly from the southerly line of 19th Street; running thence northerly along the center line of Chester Avenue to a point 132 feet northerly fry-n the northerly line of 21_st Street; thence easterly and parallel with the northerly line of 21st Street to the center line of N Street; thence southerly- along the center line of F Street to the center line of 20th Street; thence easterly along the center lire of 20bh Street to the center line of P Street; thence northerly along the center line of P Street to a point 132 feet norther- ly from the northerly line of 21st Street; thence easterly and parallel with the northerly line of 21st Street to the center line of R Street; thence southerly along the center lire of R Street to a point 132 feet southerly from the southerly line of 19th Street; thence westerly and parallel with the southerly line of 19th Street to the center line of Chester Avenue and the point of beginning. All in the City of Bakersfield, County of Kern, State of alifornia. All of the herein proposed work shall be done in pursuance of an act of the Legislature of the State of California, designated the "Improvement Act of 1911" approved .7pril 7th, 1911, and all acts amenda- tory thereof. Notice is hereby given that on Yonday, the day of Xd,4,, 1929, at a o'clock P. Y. at a regular meeting of the said City Council -3- in the City Hall of the City of Bakersfield, any and all persons having any objections to the proposed work or improvement may appear before said City Council and show cause why said proposed improvement should not be carried out in accordance with said Resolution. The City Clerk of said City shall cause this Resolution of ?ntention to be published twice in the The Daily Report, a daily n-esys- paper printed, published and circulated in said City of Bakersfield, and Hereby designated for that purpose by said City Council. The Street Superintendent of said City of Bakersfield shall cause to be conspicuously posted along the lines of said contemplated stork and improvement and along the open streets within said district notice of the passage of this Resolution of Intention in the manner and forrn required by law. And it is further stipulated and agreed by the parties to this agreement that under it eight hours of labor shall constitute a legal day's work, and the said party of the first part shall not require more than eight (S) hours of labor in a day from any person employed by said first party in the performance of said work, except in case of extraordinary emergency caused by fire, flood or danger to life or property; and it is further agreed that the party of the first part shall forfeit, as a penalty, to the City of Bakersfield, the sum of ten (10) dollars for each la- borer, workman or mechanic employed in the execution of this contract by him, or by any sub -contractor under him, for each calendar day during which such laborer, workman or mechanic is required or permitted to labor more than eight hours in violation of the provisions of Sec- tion 653-C of the Penal Code of the State of California or Section 143 of the Charter of the City of Bakersfield.
