REVISIONSTOTHEAPPROVEDPLAN Anytimeaftersiteplanapprovalbutbeforetheapprovalexpires,youmaysubmitrevisionstotheplan.Wewilltreat theserevisionsasanewsiteplanapplicationsubjecttoanewreviewandrequiredfees.ThePlanningDirectorcanonly approveminorchangestotheoriginalplanwithoutanewapplicationiftheyarenecessarytomeetacondition, mitigation,orresultfromphysicalobstaclesorothercomparableconstraints(SeeSection17.08.080.c.3oftheZoning Ordinance). EXPIRATIONOFPLANS Thissiteplanexpireson July10,2024(2yearsfromthedecisiondate),unlessbuildingpermitshavebeenissued, orwheretheusehascommencedonprojectsnotrequiringabuildingpermit.Theprojectmustbecompleted within5yearsfromthedecisiondate.Ifthepropertyisrezoned,siteplanapprovalwillexpireupontheeffective datefortherezoningunlesstheuseispermittedinthenewzone. ThePlanningDirectormayextendtheexpirationdateuptoone(1)yearifyouresubmitnewplansforcheck againstthecoderequirementsineffectatthattimeandincludeawrittenrequestfortheextension.Wemust receivethisrequest before expirationoftheprojectapproval.Wewillnotrequireafeeforthisextensionrequest; however,changestotheplansoriginallyapprovedforpurposesotherthancoderequirementsshallbesubjectto anewsiteplanreview,includingpaymentofallrequiredfees(SeeSection17.08.080.DoftheZoningOrdinance). ENVIRONMENTALDETERMINATION ThissiteplanreviewhasbeenfoundtobeexemptfromtheprovisionsoftheCaliforniaEnvironmentalQualityAct (CEQA)accordingtoSection15332.Thisprojectisexemptbecauseitisaninfilldevelopmentthatisconsistentwiththe generalplanandzoningregulations,iswithinanareapredominantlydevelopedwithurbanuses,isnotidentifiedas criticalhabitatforendangeredorthreatenedspecies,willnotsignificantlyaffecttrafficnoise,airorwaterquality,and willbeadequatelyservedbyappropriateutilitiesandpublicservices.ANoticeofExemptionhasbeenpreparedandis availableforreviewatthePlanningDivision. AsdeterminedbytheCityofBakersfield,onlyprojectsreadytobe issuedanurban developmentpermit,gradingplanapprovalorbuildingpermitbeforethe2023expiration datewillbeeligibletopayfeesunderthecurrentMBHCP.Earlypaymentorprepayment ofMBHCPfeesshallnotbeallowed.TheabilityoftheCitytoissueurbandevelopment permitsisgovernedbythetermsoftheMBHCP.Urbandevelopmentpermitsissuedafter the2023expirationdatemaybesubjecttoaneworrevisedHabitatConservationPlan,if approved,orberequiredtocomplydirectlywithrequestsoftheU.S.FishandWildlife ServiceandtheCaliforniaDepartmentofFishandWildlife. b.BurrowingOwlNotification:Theburrowingowlisamigratorybirdspeciesprotectedby internationaltreatyundertheMigratoryBirdTreatyAct(MBTA)of1918(16U.S.C.703 711).TheMBTAmakesitunlawfultotake,possess,buy,sell,purchase,orbarterany migratorybirdlistedin50C.F.R.Part10includingfeathersorotherparts,nests,eggs,or products,exceptasallowedbyimplementingregulations(50C.F.R.21).Sections3503, 3503.5,and3800oftheCaliforniaFishandGameCodeprohibitthetaking,possession,or destructionofbirds,theirnestsoreggs.Toavoidviolationoftheprovisionsoftheselaws generallyrequiresthatprojectrelateddisturbanceatactivenestingterritoriesbereduced oreliminatedduringcriticalphasesofthenestingcycle(March1August15,annually).
