HomeMy WebLinkAboutRES NO 118-2022RESOLUTION NO. 11 8 m 2 0 2 2 RESOLUTION OF THE BAKERSFIELD CITY COUNCIL DISPENSING WITH FORMAL BIDDING PROCEDURES DUE TO THE URGENT NECESSITY FOR THE CONSTRUCTION OF THE BAKERSFIELD POLICE DEPARTMENT SHOOTING RANGE SOUND MITIGATION PROJECT AND AUTHORIZING SUPERIOR CONSTRUCTION, INC., FOR THE CONSTRUCTION OF SAID PROJECT, NOT TO EXCEED $1,000,000. WHEREAS, Bakersfield Police Department completed Phase 1 of the Shooting Range project, which constructed a pre-engineered metal building and a new baffling system, which greatly improved the safety and conditions of the site; and WHEREAS, Bakersfield Police Department would like to proceed with Phase 2 of the project, which would include sound mitigation at the shooting range facility which would bring the sound levels to within OSHA compliance levels, and protect the health and safety of the police officers at the facility; and WHEREAS, the Public Works Department and Bakersfield Police Department have worked together to find solutions for improving the existing sound conditions at the shooting range, and have been successful in finding a sound mitigation materials manufacturer and supplier, Troy Acoustics, that specifically works on law enforcement shooting range projects at the local, state and federal level, and have determined that using this materials supplier in conjunction with Superior Construction, Inc., is the most feasible solution; and WHEREAS, Bakersfield Police Department currently is unable to use the shooting range site due to sound safety concerns and currently has to find alternate solutions for training staff and weapons certifications; and WHEREAS, to meet the needs of the Bakersfield Police Department, the Police Shooting Range Sound Mitigation Project must be completed as urgently as possible, and the most feasible solution is to enter into a contract with Superior Construction, Inc., which is the same General Contractor who constructed the Shooting Range's pre-engineered metal building in Phase 1 of the project; and WHEREAS, the Public Works Director recommends the Council authorize the proposed construction and dispense with bidding requirements, in accordance with BMC Section 3.20.60(D) (4). The above recitals and findings are true and correct and are incorporated herein by reference. 2. The City Council finds that based on the facts included in the above recitals, the Police Shooting Range Sound Mitigation project is of urgent necessity for the preservation of life, health or property, thereby allowing the dispensing of bidding requirements as set forth in Section 3.20.060 (D) (4) of the Bakersfield Municipal Code. 3. The Finance Director or his designee is authorized to dispense with bidding in accordance with section 3.20.060(D) (4) of the Bakersfield Municipal Code. 4. The expenditure of funds for the construction of the Bakersfield Police Department Shooting Range Sound Mitigation Project shall not exceed $1,000,000. 5. The City Clerk shall attest and certify to the passage and adoption of this Resolution and it shall become effective immediately upon its approval.
