HomeMy WebLinkAboutRES NO 109-2022RESOLUTION NO. 109-2022 RESOLUTION OF THE BAKERSFIELD CITY COUNCIL AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH FORMAL BIDDING PROCEDURES AND MAKE FINDINGS IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 4217.12 ET SEQ. TO ENTER INTO AN ENERGY SERVICE CONTRACT WITH ADVANCED LIGHTING SERVICES, INC. TO PROVIDE TURNKEY SERVICES TO CONVERT AND RETROFIT THE EXISTING LIGHT FIXTURES AT MECHANICS BANK ARENA AND THE BAKERSFIELD CONVENTION CENTER TO LIGHT EMITTING DIODE (LED) FIXTURES, NOT TO EXCEED $196,066.11 WHEREAS, Government Code section 4217.10, et seq., authorizes a public agency to enter into an energy service contract without going through a formal bid process if its governing body determines, at a regularly scheduled public hearing, public notice of which is given at least two weeks in advance, that (1) it is in the best interest of the City to enter into such energy service contract, and (2) if the City finds that the anticipated cost to the City for the electrical energy or conservation services provided by the energy conservation facility under the contract will be less than the anticipated marginal cost to the City of electrical energy that would have been consumed by the City in the absence of those purchases; and WHEREAS, the City of Bakersfield has approximately over 600 high pressure sodium, fluorescent or metal halide light fixtures in the Mechanics Bank Arena and the Bakersfield Convention Center that need to be converted to LED fixtures; and WHEREAS, Advanced Lighting Services, Inc. is a national firm that specializes in turnkey energy efficiency projects; and WHEREAS, Advanced Lighting Services, Inc. previously worked with the City of Bakersfield as Pacific Gas and Electric's sub -contractor who converted 12,860 high pressure sodium City of Bakersfield cobra head street light fixtures to LED in 2018; and WHEREAS, Advanced Lighting Services, Inc. previously worked with the City of Bakersfield to convert over 3,000 high pressure sodium, fluorescent or metal halide light fixtures in City Parks and facilities using PG&E's (Pacific Gas & Electric) On Bill Financing (OBF) Loan for funding; and WHEREAS, Advanced Lighting Services, Inc.'s pricing and costs provided to the City are based on working extensively with City staff to audit the existing light fixtures at the Mechanics Bank Arena and the Bakersfield Convention Center and determine C:\Program Files(x86)\neevia.com\docConverterPro\temp\NVDC\09FE1D11-CCA3-4771-BOAB- 00033779B92E\Bakersfield.28696.1.Reso for LED_ Conversion_ at Mechanics _Bank _ Arena_ and Convention_ Center 5-31-22.docx O4�aK6:tj' Page 1 of 3 Pages, 00RIGINAI_ the best and most economical and energy efficient LED conversion; and WHEREAS, based on the energy cost analysis provided by Advanced Lighting Services, Inc. attached to the proposed contract as Exhibit A, City staff estimates an annual ongoing energy savings of approximately $27,000 and an annual maintenance savings of $33,000 after all Mechanics Bank Arena and Bakersfield Convention Center light fixtures are converted or retrofitted to LED; and WHEREAS, the breakdown of Advanced Lighting Services, Inc.'s cost to convert and retrofit the light fixtures at the Mechanics Bank Arena and the Bakersfield Convention Center to LED fixtures is approximately not to exceed $190,066.11; and WHEREAS, the Public Works Department recommends the Council authorize the Finance Director to dispense with bidding for this energy efficient/conservation project and approve the agreement with Advanced Lighting Services, Inc. to convert the high-pressure sodium, fluorescent and metal halide light fixtures at the Mechanics Bank Arena and the Bakersfield Convention Center; and WHEREAS, the City Council finds and determines that it is in the best interest of the City to enter into a contract with Advanced Lighting Services, Inc. for the proposed improvements. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The City Council finds and determines that the above recitals are true and correct and incorporated herein by reference. 2. This resolution is adopted following a public hearing at a regularly scheduled meeting of the City Council for which a minimum of two weeks public notice has been duly given. 3. The City Council finds that (1) it is in the best interest of the City to enter into an energy service contract with Advanced Lighting Services, Inc. for the implementation of certain energy related improvements to City facilities, and (2) the anticipated cost to the City for electrical energy or conservation services provided by the conservation facility under the contract will be less than the anticipated marginal cost to the City of electrical energy that would have been consumed by the City in absence of those purchases. 4.
