AN ORDINANCE OF THE COUNCIL OF THE
CITY OF BAKERSFIELD ADDING
SUBSECTION B. TO SECTION 13.04.080
AND AMENDING SUBSECTION A. TO
SECTION 13.04.210 OF THE BAKERS-
FIELD MUNICIPAL CODE RELATING TO
CLASSIFICATION OF MAII~T~ANCE
DISTRICT AREAS INTO ZONES.
BE IT ORDAINED by the Council of the City of
Bakersfield as follows:
SECTION 1.
Subsection B. is hereby added to Section 13.04.080 of
the Bakersfield Municipal Code to read as follows:
13.04.080
Councilpowers - General.
B. The Council may classify various areas within a
maintenance assessment district into different zones where, by
reason of variations in the nature, location and extent of
improvements, the various areas will receive differing degrees of
benefit from the improvements. A zone shall consist of all
territory which will receive substantially the same degree of
benefit from the improvements and shall be described in the
resolution of intention preceding formation of any maintenance
district or, if an established district is to be divided into two
or more zones, such zone shall be described in the notice of the
annual hearing prescribed in Section 13.04.210 B. Where in this
Chapter the term "district" is used, said term includes each zone
within such district provided such zones were created at the time
the district was originally established during or following an
annual hearing held pursuant to Section 13.04.210.
SECTION 2.
Subsection A. of Section 13.04.210 of the Bakersfield
Municipal Code is hereby amended to read as follows:
13.04.210
Annual hearing.
A. After a maintenance district has been established
and finally determined, annual hearings will be limited to
protest to the amounts of the assessment, any changes in the
formula or formulae, and any division of the district into
benefit zones as authorized by Section 13.04.080 B. Protests
made may be made as provided in Section 13.04.180.
SECTION 3.
This Ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
