beengroupedbydepartmentsothatyouknowwhomtocontactifyouhavequestions.
Yournextstepistoeitherapplyfornecessarybuildingpermitstoconstructyourproject,orbeginyourbusiness
activitiesdependingontherequestsubmitted.YoumustsubmitfinalbuildingplanstotheBuildingDivision.The
SitePlanReviewCommitteewillreviewthesefinalplanswhilebuildingplancheckoccurstoensurethatyousatisfy
theitemsintheSitePlanComplianceList.Pleasereadthemcarefully.Failuretosatisfyanitemmaydelayyour
obtainingabuildingpermitorcommencingyourproject.
AfterconstructionofyourprojectbutbeforetheCitycanallowoccupancy,theBuildingDivisionmustinspectthe
developmenttofindifitcomplieswiththeapprovedplans,andanyotherrelevantpermitsandcodes.Ifyouhave
satisfiedalloftherequirements,theBuildingDirectorwillissueacertificateofoccupancy;ifnot,theareainspector
willgiveyouacorrectionnotice.Onceyouhavemadeallofthecorrections,theBuildingDirectorcanissuea
certificateofoccupancy.YoumaynotoccupyadevelopmentuntiltheBuildingDirectorhasissuedacertificateof
occupancy.
INDEMNIFICATIONCONDITION
InconsiderationbytheCityofBakersfieldforlanduseentitlements,includingbutnotlimitedtorelated
environmentalapprovalsrelatedtoorarisingfromthisproject,theapplicant,and/orpropertyownerand/or
subdividerΛͻ!ƦƦƌźĭğƓƷͼherein)agreestoindemnify,defend,andholdharmlesstheCityofBakersfield,itsofficers,
agents,employees,departments,commissionersandboardsΛͻ/źƷǤͼherein)againstanyandallliability,claims,
actions,causesofactionsordemandswhatsoeveragainstthem,oranyofthem,beforeadministrativeorjudicial
tribunalsofanykindwhatsoever,inanywayarisingfrom,thetermsandprovisionsofthisapplication,including
withoutlimitationanyCEQAapprovaloranyrelateddevelopmentapprovalsorconditionswhetherimposedby
theCity,ornot,exceptfor/źƷǤƭsoleactivenegligenceorwillfulmisconduct.
ThisindemnificationconditiondoesnotpreventtheApplicantfromchallenginganydecisionbytheCityrelatedto
thisprojectandtheobligationsofthisconditionapplyregardlessofwhetheranyotherpermitsorentitlements
areissued.
TheCitywillpromptlynotifyApplicantofanysuchclaim,action,orproceeding,failingunderthisconditionwithin
thirty(30)daysofactuallyreceivingsuchclaim.TheCity,initssolediscretion,shallbeallowedtochoosethe
attorneyoroutsidelawfirmtodefendtheCityatthesolecostandexpenseoftheApplicantandtheCityisnot
obligatedtouseanylawfirmorattorneychosenbyanotherentityorparty.
REVISIONSTOTHEAPPROVEDPLAN
Anytimeaftersiteplanapprovalbutbeforetheapprovalexpires,youmaysubmitrevisionstotheplan.Wewill
treattheserevisionsasanewsiteplanapplicationsubjecttoanewreviewandrequiredfees.ThePlanning
Directorcanonlyapproveminorchangestotheoriginalplanwithoutanewapplicationiftheyarenecessaryto
meetacondition,mitigation,orresultfromphysicalobstaclesorothercomparableconstraints(SeeSection
17.08.080.c.3oftheZoningOrdinance).
EXPIRATIONOFPLANS
Thissiteplanexpireson August21,2024(2yearsfromthedecisiondate),unlessbuildingpermitshavebeen
issued,orwheretheusehascommencedonprojectsnotrequiringabuildingpermit.Theprojectmustbe
completedwithin5yearsfromthedecisiondate.Ifthepropertyisrezoned,siteplanapprovalwillexpireupon
theeffectivedatefortherezoningunlesstheuseispermittedinthenewzone.
ThePlanningDirectormayextendtheexpirationdateuptoone(1)yearifyouresubmitnewplansforcheck
againstthecoderequirementsineffectatthattimeandincludeawrittenrequestfortheextension.Wemust
receivethisrequest before expirationoftheprojectapproval.Wewillnotrequireafeeforthisextensionrequest;
however,changestotheplansoriginallyapprovedforpurposesotherthancoderequirementsshallbesubjectto
anewsiteplanreview,includingpaymentofallrequiredfees(SeeSection17.08.080.DoftheZoningOrdinance).
ENVIRONMENTALDETERMINATION
ThissiteplanreviewhasbeenfoundtobeexemptfromtheprovisionsoftheCaliforniaEnvironmentalQualityAct
(CEQA)accordingtoSection15303.TheprojectisexemptbecauseitisaClass3projectconsistingaconversionof
asmallstructuremeetingtheconditionsdescribedinSection15303.ANoticeofExemptionhasbeenprepared
andisavailableforreviewatthePlanningDivision.

APPEAL
Anypersonmayappealthisdecision.Anappealislimitedtowhetherornotanadopteddevelopmentstandard,
zoningregulation,mitigation,orpolicyappliedornotappliedtotheproject,wasdoneconsistentwiththe
authoritygrantedbycityordinancesortheCaliforniaEnvironmentalQualityAct(CEQA).Theappealmustbein
ingtheprecisebasisorissueasnoted,mustincludetheappropriatefilingfee,andmustbefiledwithin
writingstat
10days ofthedecisiondatetotheCityofBakersfieldPlanningCommission(c/oBakersfieldPlanningDirector,
1715ChesterAvenue,Bakersfield,CA93301).ThePlanningCommissionwillholdapublichearingontheappeal
andtheirdecisionwillbefinalunlesstheirdecisionisappealedtotheCityCouncil.
Siteplanapprovalisbasedonthestatementsmadeintheapplicationandtheplansyousubmitted.Anyerrorsor
omissionsontheseplanscouldalterthecompliancelistand/orvoidthisdecision.Ifyouhavequestionsabout
anyoftheitemsnotedintheSitePlanComplianceList,youmustspeaktothecontactpersonrepresentingthe
departmentrequiringthatitem.
