BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Chapter 17.58 of the Bakersfield Municipal Code is hereby amended to read as follows: CHAPTER 17.58 OFF-STREET PARKING Sections: 17.58.010 17.58.020 17.58.030 17.58.040 17.58.050 17.58.055 17.58.060 17.58.070 17.58.080 17.58.090 17.58.100 17.58.110 17.58.120 17.58.130 Facilities Required. Definitions. Minimum dimensions for required off-street parking and freight loading spaces. Rules for calculation of required off- street parking. General standards as to location and arrangement of off-street parking. Transit offsets. Parking Lots. Required off-street parking on the same lot as the structure or use served; exceptions. Joint or shared use of required off-street parking. Reduction of off-street parking and loading requirements where area requirements met for the "central district." Parking garages in the "central district." Schedule of off-street parking requirements Schedule of off-street parking spaces for the "central district." Schedule of off-street freight loading spaces. 17.58.010 Facilities required. For each new dwelling, new multiple dwelling, new business or new industrial establishment or other new or moved structures, or for any change of use on any existing structure, or for any addition to an existing use, there shall be provided and maintained off-street parking facilities to accommodate the motor vehicles required by the use of the property or structure as set forth in this chapter. 0RIGINAI~ B. All parking for residential uses shall be on the same lot or parcel. Parking for all other uses shall be located on the same lot or parcel as the use served or be immediately adjacent to the subject property subject to the provisions of Section 17.58.070 (A) and (C). 17.58.020 Definitions. A. An "accessory parking facility" is an attached or detached structure for the purpose of parking passenger vehicles which is secondary in nature and incidental to the primary use of the property. Said structures can be, but are not limited to, residential or commercial garages and carports. The "central district" means the "Central traffic District" as described in Section 10.08.020 (f) of Bakersfield Municipal Code. the A "compact parking space" is a parking space designed to accommodate a compact car as determined by the Traffic Engineer. "Driveway" is a way or place in private ownership which. leads to a loading zone or legal parking space and is used for vehicular travel by the owner and those having express or implied permission from the owner but not by other members of the public. Driveways and driveway connections to City streets must conform to all City ordnances, standards and policies. E. "Floor area" of a building or structure shall mean "conditioned floor area" unless otherwise specified. F. "Gross floor area" of buildings and structures, means the area as measured from outer wall to outer wall. A "parking lot" means an off-street open area solely for the parking of passenger vehicles. Such an area or portion thereof shall be considered a parking lot whether on the same lot as another use, whether required by Code for any structure or use, and whether classified as an accessory, permitted or conditional use. A "parking garage" means any structure for the parking of passenger vehicles, for short- or long-term periods which is not classified as an accessory parking facility. A "tandem parking space" is a parking space that is adjacent to the end of a legal off-street parking space, opposite the drive aisle. The orientation of the tandem ~ - 2 m parking space is the same as and only accessible through said legal off-street parking space. 17.58.030 Minimum dimensions for required off-street parking and freight loading spaces. A. Parking Spaces The minimum individual parking space or stall size shall be a minimum of 9 feet wide by 18 feet deep and shall be designed according to standards established by the Traffic Engineer. B. Loading Spaces Every required off-street loading space shall have a minimum length of 35 feet, a minimum width of 10 feet, and a minimum vertical clearance including entry and exit of 14 feet; except for the first such space required for any structure or use the minimum length shall be 25 feet and the minimum vertical clearance including entry and exit shall be 12 feet. These dimensions shall be exclusive of platform, driveways, and maneuvering areas. 17.58.040 Rules for calculation of required off-street parking. A. In the calculation of off-street parking and freight loading spaces, the following rules shall apply: Parking computations will be based on gross floor area of buildings and structures, unless otherwise stated in this Chapter. When, after computing the number of parking spaces required for a structure, there appears a fractional requirement of one-half or more of a parking space, one additional parking space shall be required. If, after such computation, the fractional requirement for a given number of spaces is below one-half space, no additional parking will be required for that fractional parking space. The requirements for off-street parking and loading for any use not specifically mentioned shall be the same as for a use specified which is similar, as determined by the Planning Director. 17.58.050 General standards as to location and arrangement of off-street parking. A. Every off-street parking or loading space shall have adequate means of ingress from and egress to a street or alley. Every required off-street parking or loading space shall be independently accessible. Access to off-street loading spaces shall be provided on private property for entrance of vehicles to off-street parking and loading spaces. The internal layout of off-street parking and loading spaces, driveways, aisles and maneuvering areas shall be clearly marked according to City standards. Ce Parking spaces for handicapped persons, as required by state law, shall be designed and designated for their use. Off-street parking and loading facilities shall be arranged so as to prevent encroachments upon street rights of way, adjacent properties, and landscaping areas required pursuant to Section 17.53.061 of this code. In approving the design of said parking and loading facilities the approving authority shall consider the maneuvering, standing and storage of vehicles, and layout of the facilities, and may require the use of curbing, bumper or wheel guards or other such devices as necessary to insure compliance with this section. Tandem parking will not be counted toward the requirement for legal off-street parking. If, in the opinion of the Board of Zoning Adjustment, the use of tandem parking will not be detrimental to the public welfare or injurious to the property or improvements of neighboring owners of property and said tandem parking is in harmony with the general purpose and intent of this title, tandem parking may be allowed subject to the approval of a modification therefor under Section 17.64.070 of the code. Compact parking will not be counted toward the requirement for legal off-street parking. If, in the opinion of the Board of Zoning Adjustment, the use of compact parking will not be detrimental to the public welfare or injurious to the property or improvements of neighboring owners of property and said compact parking is in harmony with the general purpose and intent of this title, compact parking may be allowed subject to the approval of a modification therefor under Section 17.64.070 of the code. Driveways crossing sidewalks shall be arranged, to the extent practical, to minimize the width and frequency of curb cuts, and conflicts with pedestrian and transit movements as determined by the Traffic Engineer. Every off-street parking or loading facility and access thereto shall be suitably graded, paved, drained, and maintained according to standards adopted by the City Engineer. Wherever corrosive materials are loaded or unloaded, docks, driveways, off-street loading and parking areas shall be equivalent concrete. Additions or alterations to existing off-street parking facilities shall obtain site plan review approval pursuant to chapter 17.53 of this code. The city shall process said site plan review application for parking lots not requiring a building permit as a Class "C" project pursuant to said chapter. J. No area credited as all or part of a required off-street parking space shall also be credited as all or part of a required off-street loading space, or used for off-street loading. No area credited as all or part of a required loading space shall also be credited as all or part of a required off-street parking space, or used for off-street parking. In no event shall any parking provided pursuant to Section 17.58.010 through 17.58.110 be situated in such a way that vehicles entering the parking area required by Sections 17.58.010 through 17.58.110 shall be allowed to back onto any street or thoroughfare in order to leave said property. 1. This provision shall not apply to any private residence in an area zoned for private residences. On streets which have not been designated by the traffic authority as arterial or collector streets, the traffic authority is granted the power to permit backing onto such streets for multiple dwellings where such backing will not adversely affect traffic and is similar to a single family residential driveway use. Neither the area of a required side yard abutting a street nor of a front yard shall be used for off-street parking required by this code except as allowed in Section 17.58.050(M). Such provisions shall not apply in the P zone. ORIGtNAL Notwithstanding the provisions of Section 17.158.110, the area of a required front yard or side street yard in an R-2, R-3 or R-4 zone may be encroached to the extent of four feet for off-street parking required by this chapter, subject to the following limitations and conditions: The encroaching parking space must be an extension of and parallel to a row of parking containing two or more spaces inclusive; 2. The prohibition against backing onto streets contained in Section 17.58.050(K) shall apply; 3. On corner lots or lots at intersecting streets, no such encroachment is permitted in a sixty foot corner cutoff area as measured along the intersecting street curb-lines extended; The landscaping or wall requirements contained in Subsection B of Section 17.34.020 shall apply. Any such landscaping or wall in the encroached area, or the sixty foot corner cutoff area must be approved by the City Traffic Engineer. N. Open air, temporary parking of automobiles, except trucks of over fifteen hundred pounds capacity shall be paved on surfacing material in accordance with standards adopted by the city engineer. Where the parking area, including driveways, is within ten feet of the property line of property zoned for R uses, it shall be separated therefrom by a continuous solid wall of masonry construction six feet in height or, upon approval of and at the discretion of the planning director, by a landscaped area seven feet in width, with or without a six-foot solid fence which effectively buffers and screens the parking from the residential uses in a manner similar to the above-described masonry wall. Subject to the limitations specified in Section 17.08.175, the wall or landscaping from the front property line to a depth equal to the required front yard on the abutting R classified property shall be four feet in height. Where parking areas are adjacent to each other on R zoned lots or where common, shared or joint use of parking or drive aisles exist; they may be facilitated by a waiver or modification of the wall or landscape requirement or both at the discretion of the planning director. The fence, wall and landscaping shall be maintained in good condition. (Ord. 2710 ~ 2, 1982: prior code ~; 17.40.020). O. For the "central district" the required number of parking stalls may be reduced by 50 percent for any commercial facility which operates only after 5 P.M. P. For the "central district" any off-street freight loading area located within 50 feet of any residential zoned or developed property shall be completely enclosed within a building if such freight loading is used in regular night operation. 17.58.055 Transit offsets. (THIS SECTION IS RESERVED FOR REQUIREMENTS GOVERNING PARKING WHEN TRANSIT OFFSETS ARE PROVIDED SUCH AS BUS STOPS AND TRANSIT TERMINAL FACILITIES.) 17.58.060 Parking Lots. ko Artificial lighting used to illuminate a parking lot shall be arranged to direct rays away from residential properties. The design of said lighting shall be subject to approval by the Building Director. No parking lot for any number of automobiles shall have conducted upon it any dead storage, dismantling, or sale of vehicles, or any repair or servicing of vehicles other than that of an emergency nature. Any parking lot in the "central district" for the parking of two or more automobiles which adjoins a residential lot in any zone, or which faces a lot in any residential zone across a street, shall be partially screened from view therefrom, except at driveways necessary for ingress and egress, by a landscaping screen, approximately 24 inches in height, and shall be approved by the Planning Director and Traffic Engineer. Any parking lot in the "central district" for the parking of 6 or more automobiles shall be partially screened from view from every street except at driveways necessary for ingress and egress, by a landscaping screen, approximately 24 inches in height, approved by the Planning Director and Traffic Engineer. 17.58.070 Required off-street parking on the same lot as the structure or use served; exceptions. The nonresidential parking requirements of Sections 17.58.010 through 17.58.110 may be satisfied by leasing the required parking spaces from properties immediately adjacent to the subject property. If parking is proposed on an adjacent parcel, said parking must be considered readily accessible to the subject property as determined by the Planning Director. If off-street parking is proposed on an adjacent parcel said parking shall conform to the requirements outlined in Section 17.58.070 (C) of this code. B. Off-site parking for uses within the "central district" shall be subject to the following exceptions and requirements: Required off-street parking spaces for one-family or two-family dwellings in Residential zones shall be located on the same lot as the dwellings served. Required off-street parking spaces for all other dwellings shall be located on the same lot as the dwelling served, as an accessory use, or within a walking distance of 500 feet, as either a permitted or a conditional use, depending upon the use provisions applicable to the zone in which such parking is located. Required off-street parking spaces for projects designed for senior citizens or the handicapped shall be on site. Required off-street parking spaces for all uses other than dwellings shall be located on the same lot as the use served, as an accessory use, or within a walking distance of 1,000 feet, as either a permitted or a conditional use, depending upon the use provisions applicable to the zone in which such parking is located. Walking distance for purposes of subsections B(2) and B(3) above shall mean the distance from an outside entrance of a structure or use or part thereof, to the nearest point of the off-street parking facility assigned to such structure or use or part thereof, along the shortest and most convenient pedestrian walkway open to the user or users of such off-street parking space. Whenever the Planning Director determines that sufficient spaces are available in a public parking facility within 1000 feet of a new business, he may accept a contract pursuant to Section 17.58.070 (C) for such spaces in satisfaction of the off-street parking requirements of this Chapter. In order to be credited toward the parking requirements of any development, use, or structure, any off-street parking space located on a lot other than the lot on which the structure or use to be served is located must meet the following criterion: Assurances as to the availability of remote parking spaces must be provided. Such availability shall be assured either by ownership of both the lot containing the structure or use to be served and the lot containing the off-street parking space by at least one common owner, or by a lease or other instrument providing for the availability of the parking space for not less than the actual lifetime of the structure or until a change of use or modification to an existing use occurs. An attested copy of any such instrument shall be filed with the Planning and Building Department prior to approval of any building permit application affected by this arrangement for provision of required off-street parking. In addition, in either case, a document in a form approved by the City Attorney shall be executed by the parties concerned, and recorded in the office of the County Recorder, serving as a notice of the restrictions under this Code applying both to the lot requiring and the lot containing the off-street parking space, by virtue of this arrangement for provision of required off- street parking. 17.58.080 Joint or shared use of required off-street parking. Joint use of off-street parking spaces at the same location to meet the requirements of two or more structures or uses may be permitted, where the total quantity of spaces provided is at least equal to the total of the required spaces for all such structures or uses when computed separately. Shared use of the same off-street parking spaces to meet the requirements of two or more structures or uses may be permitted, where the normal hours of operations of such structures or uses are such as to assure the feasibility of such joint use of parking, and where the total quantity of spaces provided is at least equal to the total of the projected parking demand for the structures or uses in operation at any given time. A standard shall be adopted by the Planning Director and Traffic Engineer establishing parameters for determining peak parking demand on shared uses. In order to be credited toward the parking requirements of this Chapter, an off-street parking space made available for joint use and located on a lot other than the lot on which the structure or use to be served is located, must be available for the actual lifetime of the structure or use to be served. Such availability shall be assured in the manner provided for in Section 17.58.070 of this ordinance. In addition, in the case of joint use of parking, an attested copy of a contract among all the parties concerned setting forth their agreement to such joint use shall be filed with the Planning and Building Departments prior to approval by said Department of any building permit application affected by the arrangement for joint use of parking. In any such case a notice of restrictions upon the affected properties shall be executed in a form approved by the City Attorney and recorded in the Office of the Kern County Recorder, making specific reference to said contract and describing the arrangement for joint use or parking. 17.58.090 Reduction of off-street parking and loading requirements where area requirements met for the "central district." In instances in which the Central District Development Agency as certified by resolution that the required off- street parking space requirements for uses in the "central district" will be satisfied in whole or in part by public off-street parking facilities constructed or authorized to be constructed, off-street parking required for an individual building and uses may be correspondingly reduced if the total off-street parking supply in the area will meet the requirements for all buildings and uses in the area. 17.58.100 Parking Garages in the "central district." Statement of Purpose. It is the purpose of this section to establish a procedure by which parking garages proposed for downtown Bakersfield may be reviewed as to the appropriateness of their location and arrangement, recognizing the need for continuing development of a unified transportation system conveniently serving the downtown area. Approval process. Review of the location and design of any parking garage shall be in accordance with the criteria set forth below, and no such garage shall be constructed within the central district but outside the redevelopment project area without a conditional use permit from the Board of Zoning Adjustment, or City Council on appeal, or, within the redevelopment project area, without the approval of the Central District Development Agency. Criteria for review. The following criteria shall be utilized by the Board of Zoning Adjustment, City Council, and/or Central District Development Agency in determining whether to approve a parking garage project: Accessibility to the area of the proposed site and to the proposed parking garage itself, from freeway ramps or from arterials; Convenient service to areas of concentrated development, by location of the proposed parking garage near or adjacent to, but not inside, such concentrated areas; Minimization of conflict of the proposed parking garage with pedestrian movements and amenities, resulting from the placement of driveways and ramps, the breaking of continuity of shopping facilities along the sidewalks, and the drawing of traffic through areas of heavy pedestrian concentration; 4. The service patterns of other forms of transportation; 5. The transportation section of the Redevelopment Element; 6. Street-level retail/commercial uses accommodated in design; and 7. Such other criteria as may be deemed appropriate in the circumstances of the particular case. A project not satisfying such criteria may be approved provided findings supporting a waiver are made. 17.58.110 Schedule of parking requirements. Off-street parking facilities shall be provided and maintained for the following specified uses or facilities follows: as PARKING REQUIREMENT SCHEDULE Specified Use One-family dwellings Multiple-family dwellings and condominium (efficiency and one bedroom units) Required Off-street Parking Facilities 2 spaces per dwelling unit 1-1/2 space per unit, plus an additional 10% for guest parking on parcels containing 6 or more units Specified Use 3. Multiple-family dwellings and condominiums (two or more bedrooms) 4. Dwellings designed for senior citizens which are restricted by recorded covenant requiring occupancy of at least one resident per unit aged 62 years or over or physically handicapped persons 5. Hospitals, medical in- patient clinics and other overnight treatment facilities; additional parking required for administrative offices, out-patient clinic, testing, teaching, research and other similar activities 6. Convalescent hospitals, and extended medical care facilities, nursing and convalescent homes, homes for the aged, conjugate care and extended care facilities; additional parking required for administrative offices, testing, teaching, research and other similar activities Hotels, motels; (additional parking required for meeting rooms, restaurants, bars and office space) Required Off-street Parking Facilities 2 spaces per unit, plus an additional 10% for guest parking on parcels containing 6 or more units 1 space per 2 units 1 space per bed 3/4 space per bed 1 space per sleeping unit Specified Use 8. Neighborhood shopping and regional shopping centers; freestanding satellite pads such as fast food restaurants or banks shall be computed separately unless satellite buildings contain two or more tenants 9. Convenience market with or without gas pumps 10. General retail and commercial 11. Restaurants not containing a separate bar or live entertainment area (including fast food restaurants) 12. Restaurants containing a separate bar or live entertainment area, night clubs and dancehalls Required Off-street Parking Facilities 1 space per 200 square feet of gross floor area up to and including 35,000 square feet, plus an additional 1 space per 250 square feet of gross floor area in excess of 35,000 square feet 1 space per 200 square feet of gross floor area, minimum of 10 spaces required; if use has one or more pump islands, credit for 2 parking spaces per pump island shall be given 1 space per 300 square feet of gross floor area 1 parking space per 75 square feet of gross floor area and 1 space for each 2 seats provided in an outdoor eating area; if use has one or more drive-up windows with drive-in lanes 24 feet in length, credit for 1 parking space per window shall be given; if such lane exceeds 44 feet, two space per window shall be credited, in computing parking requirements 1 parking space per 50 square feet of gross floor area and 1 space for each 2 seats provided in an outdoor eating area % OF:qG~NAt Specified Use Required Off-street Parking Facilities 13. Lodges, halls; banquet rooms, including those associated with a restaurant; churches; funeral homes; mortuaries; sports arenas; theaters; auditoriums, including high school and college auditoriums and similar places of assembly. Figure main meeting hall or rooms only 14. Stadium, sports arena, or exhibition hall 15. Bowling alleys; restaurants, video arcades, pro shops and other related uses shall be computed separately 16. Golf Courses; restaurants, video arcades, pro shops and other related uses shall be computed separately 17. tennis, raquetball and handball courts; restaurants, video arcades, pro shops and other related uses shall be computed separately 18. Health clubs, such as aerobics and gymnastics studios, private gyms, karate and judo clubs and other similar uses 19. All other recreational and amusement uses; parking to be determined by Planning Commission 1 space per 4 seats provided in accordance with applicable fire code occupancy standards 1 space per 6 seats 5 spaces per alley 10 spaces per tee 3 spaces per court 1 space per 300 square feet of gross floor area Specified Use 20. Day care center 21. Large family day care home 22. Warehouses and furniture stores office space for above 23. Savings and loans, and banks 24. General office - i.e. real estate, finance companies, architects, engineers, attorneys, C.P.A. and other similar uses. Offices may occupy vacated freestanding retail space less than or equal to 1450 square feet without being considered a change of use for the purpose of computing parking requirements if approved by the planning director. Required Off-street Parking Facilities 1 space per 6 children plus 1 space per staff member, with drop-off, pick-up area approved by the Traffic Engineer 1 space per employee (the residential driveway is acceptable if the parking space does not conflict with any required child drop-off, pick-up area pursuant to Section 17.67.020 B.2 and B.4 of this code 1 space per 1,000 square feet of gross floor area 1 space per 300 square feet of gross floor area 1 space per 300 square feet of gross floor area; if use has one or more drive-up windows with drive-in lanes 24 feet in length, credit for 1 parking space per window shall be given; if such lane exceeds 44 feet, two space per window shall be credited, in computing parking requirements 1 space per 230 square feet of gross floor area Specified Use 25. Beauty and barbershops 29. Contractor's storage yards, public buildings and grounds other than administrative offices 30. Museums, Libraries and Cultural Centers. Required Off--street Parking Facilities No parking required 1 space per 500 sqaure feet of gross floor area 1 space per 400 square feet of gross floor area 1 space per 350 square feet of gross floor area 17.58.120 Schedule of required off-street parking spaces for the "central district". A. Off-street parking for the "central district" will be provided for the following uses as specified below. All other uses not listed shall conform to the parking requirements as outlined in Section 17.58.110. CENTRAL DISTRICT PARKING REQUIREMENT SCHEDULE Specified Use Single family dwellings and multiple-family dwellings with 1 bedroom or less Multiple-family dwellings with 2 or more bedrooms Dwellings designed for senior citizens which are restricted by recorded covenant requiring occupancy of at least one resident per unit aged 62 years or over or physically handicapped persons Hospitals, medical in- patient clinics and other overnight treatment facilities; additional parking required for administrative offices, out-patient clinic, testing, teaching, research and other similar activities Required Off-street Parking Facilities 1 spaces per dwelling unit 2 space per unit 1 space per 4 units plus 1/2 space per employee 1 space per bed ~18 - Specified Use Convalescent hospitals, and extended medical care facilities, nursing and convalescent homes, homes for the aged, conjugate care and extended care facilities; additional parking required for administrative offices, testing, teaching, research and other similar activities 6. For meeting and ibanquet areas 1 space per 230 square feet of gross floor area. An additional one-half space shall be required per person employed at the hotel site. No additional space are required for ancillary retail and administrative offices. The number of employees shall be certified by the developer prior to issuance of a building permit for the hotel or inn 1 space per guest unit plus 1 space for the Manager's unit 1 space per 200 square feet of gross floor area up to and including 35,000 square feet, plus an additional t space per 250 square feet of gross floor area in excess of 35,000 square feet 1 space per 200 square feet of gross floor area, minimum of 10 spaces required; if use has one or more pump islands, credit for 2 parking spaces per pump island shall be given ~ 19 -- Specified Use 10. General retail and commercial 11. Restaurants not containing a separate bas or live entertainment area (including fast food restaurants) 12. Page 10 PUBLIC HEARING - AMENDING TITLE 17 OF THE BAKERSFIELD MUNICIFAL CODE RELATING TO PARKING STANDARDS AND REQUIREMENTS Planning Director Hardisty apprised Commission of an earlier meeting where several items of concern about the ordinance were received and it was continued to give the Zoning Ordinance an opportunity to meet with those who appeared and to allow them the opportunity to give more detail to their concerns and recommendations. The committee met with tbose concerned on January 18th. Mr. Hardisty reviewed changes in the ordinance that came about as a result of the committee meeting. Public hearing was opened. There being no one present wishing to speak either in favor or opposition, public bearing was closed. Chairperson Bjorn stated she was happy with the ultimate outcome~of the ordinance and congratulated the committee as well as staff and all those who participated. Mr. Hardisty commented that the transit agency requested some tradeoffs between transit facilities and parking and indicated the city agrees with that in concept. However, they would like to include that type of a study as part of the city's transportation management planning proc- ess for air quality and focus on that as an issue in itself. Commissioner Marino commented that everybody concerned did a real good job. Commissioner Milazzo applauded the input that was received from the development community and also commended David Dow for his diligent work. He then referred to the chart displaying the parking stall angles and pointed to the aisle width in column D, third item up from the bottom, 26.5 feet and stated the intent was not that the turning radius was needed to be increased and it was his understanding that the drive aisle width was not going to be increased. Traffic Engineer, Steve Walker explained that the chart was not a part of the Parking Ordinanoe. It is a reference in the Public Works design manual. He also pointed out they had a 20-foot stall with a 25-foot dr~ve aisle and there is now an 18-foot long stall with a 26-foot drive aisle. Also in column 2C+D the wall-to-wall module is 62 1/2 feet. With the old stall design that would have been 65 feet. Lengthy discussion took place as to drive aisle widths and parking stall widths in parking garages and shopping centers.
