A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING THE ECONOMIC OPPORTUNITY
AREA PLAN.
WHEREAS, on April 20, 2016, the City Council adopted Resolution Nos. 048-
2016, 049-16, 050-16, 076-16, 077-16, 078-16 and 109-16 establishing the City of
Bakersfield Economic Opportunity Area (EOA) Plan and establishing Economic
Opportunity Areas in the following areas: Airport EOA, Downtown EOA, Highway
58/Mt. Vernon EOA, 34th Street Corridor EOA, East Hills EOA, Old Town Kern EOA
and the Southeast EOA; and
WHEREAS, on July 17, 2019, the Economic Opportunity Area Plan was
amended by Resolution Nos. 048-16(1), 049-16(1), 050-16(1), 076-16(1), 077-16(1),
078-16(1) and 109-16(1) after the passage of the Public Safety and Vital City
Services sales tax increase to create a single financial incentives section,
enhance financial incentive options, extend the EOA Plan term to 15 years, and
increase the individual project threshold for Council approval to $25,000; and
WHEREAS, on September 9, 2020, the Economic Opportunity Area Plan was
amended by Resolution Nos. 048-16(2), 049-16(2), 050-16(2), 076-16(2), 077-16(2),
078-16(2) and 109-16(2) after the formation of the Economic and Community
Development Department to allow non-profit 501(c) (3) participation in the EOA
Incentive Program and removed specific grant limits to allow for the approval of
projects on a case -by -case basis; and
WHEREAS, staff has reviewed the Economic Opportunity Area Plan and
recommends amendment to all types of non-profit/tax-exempt entities to be
eligible under the EOA Plan and expand economic opportunities in the
established Economic Opportunity Areas (EOAs) .
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. Section 2.1 of the Economic Opportunity Area Plan is hereby amended
to read as follows:
2.1. The financial incentives are eligible for both for -profit
businesses and tax-exempt entities. Program applicants must
also be legal businesses or non -profits located or relocating KKF?�

within the designated Economic Opportunity Area (EOA) .
3. Except as amended herein, all provisions of the EOA Plan are in ful
force and effect.
4. This Resolution shall take effect immediately upon its passage.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
