Oncethecorrectionsnotedintheattachedsiteplancompliancelisthavebeenmade,theproposalwillmeetthe minimumrequiredcodes,policiesandstandardsfordevelopmentasadoptedbytheBakersfieldCityCouncil. Yournextstepistoeitherapplyfornecessarybuildingpermitstoconstructyourproject,orbeginyourbusiness activitiesdependingontherequestsubmitted.YoumustsubmitfinalbuildingplanstotheBuildingDivision.The SitePlanReviewCommitteewillreviewthesefinalplanswhilebuildingplancheckoccurstoensurethatyousatisfy theitemsintheSitePlanComplianceList.Pleasereadthemcarefully.Failuretosatisfyanitemmaydelayyour obtainingabuildingpermitorcommencingyourproject. AfterconstructionofyourprojectbutbeforetheCitycanallowoccupancy,theBuildingDivisionmustinspectthe developmenttofindifitcomplieswiththeapprovedplans,andanyotherrelevantpermitsandcodes.Ifyouhave satisfiedalloftherequirements,theBuildingDirectorwillissueacertificateofoccupancy;ifnot,theareainspector willgiveyouacorrectionnotice.Onceyouhavemadeallofthecorrections,theBuildingDirectorcanissuea certificateofoccupancy.YoumaynotoccupyadevelopmentuntiltheBuildingDirectorhasissuedacertificateof occupancy. INDEMNIFICATIONCONDITION InconsiderationbytheCityofBakersfieldforlanduseentitlements,includingbutnotlimitedtorelated environmentalapprovalsrelatedtoorarisingfromthisproject,theapplicant,and/orpropertyownerand/or subdividerΛͻ!ƦƦƌźĭğƓƷͼherein)agreestoindemnify,defend,andholdharmlesstheCityofBakersfield,itsofficers, agents,employees,departments,commissionersandboardsΛͻ/źƷǤͼherein)againstanyandallliability,claims, actions,causesofactionsordemandswhatsoeveragainstthem,oranyofthem,beforeadministrativeorjudicial tribunalsofanykindwhatsoever,inanywayarisingfrom,thetermsandprovisionsofthisapplication,including withoutlimitationanyCEQAapprovaloranyrelateddevelopmentapprovalsorconditionswhetherimposedby theCity,ornot,exceptfor/źƷǤ͸ƭsoleactivenegligenceorwillfulmisconduct. ThisindemnificationconditiondoesnotpreventtheApplicantfromchallenginganydecisionbytheCityrelatedto thisprojectandtheobligationsofthisconditionapplyregardlessofwhetheranyotherpermitsorentitlements areissued. TheCitywillpromptlynotifyApplicantofanysuchclaim,action,orproceeding,failingunderthisconditionwithin thirty(30)daysofactuallyreceivingsuchclaim.TheCity,initssolediscretion,shallbeallowedtochoosethe attorneyoroutsidelawfirmtodefendtheCityatthesolecostandexpenseoftheApplicantandtheCityisnot obligatedtouseanylawfirmorattorneychosenbyanotherentityorparty. REVISIONSTOTHEAPPROVEDPLAN Anytimeaftersiteplanapprovalbutbeforetheapprovalexpires,youmaysubmitrevisionstotheplan.Wewilltreat theserevisionsasanewsiteplanapplicationsubjecttoanewreviewandrequiredfees.ThePlanningDirectorcanonly approveminorchangestotheoriginalplanwithoutanewapplicationiftheyarenecessarytomeetacondition, mitigation,orresultfromphysicalobstaclesorothercomparableconstraints(SeeSection17.08.080.c.3oftheZoning Ordinance). EXPIRATIONOFPLANS Thissiteplanexpireson August5,2024(2yearsfromthedecisiondate),unlessbuildingpermitshavebeenissued, orwheretheusehascommencedonprojectsnotrequiringabuildingpermit.Theprojectmustbecompleted within5yearsfromthedecisiondate.Ifthepropertyisrezoned,siteplanapprovalwillexpireupontheeffective datefortherezoningunlesstheuseispermittedinthenewzone. ThePlanningDirectormayextendtheexpirationdateuptoone(1)yearifyouresubmitnewplansforcheck againstthecoderequirementsineffectatthattimeandincludeawrittenrequestfortheextension.Wemust receivethisrequest before expirationoftheprojectapproval.Wewillnotrequireafeeforthisextensionrequest; however,changestotheplansoriginallyapprovedforpurposesotherthancoderequirementsshallbesubjectto anewsiteplanreview,includingpaymentofallrequiredfees(SeeSection17.08.080.DoftheZoningOrdinance). ENVIRONMENTALDETERMINATION ThissiteplanreviewhasbeenfoundtobeexemptfromtheprovisionsoftheCaliforniaEnvironmentalQualityAct (CEQA)accordingtoSection15303.TheprojectisexemptbecauseitisaClass3projectconsistingofaconversion ofasmallstructuremeetingtheconditionsdescribedinSection15303.ANoticeofExemptionhasbeenprepared andisavailableforreviewatthePlanningDivision. SPR220328Page|2of5 APPEAL Anypersonmayappealthisdecision.Anappealislimitedtowhetherornotanadopteddevelopmentstandard, zoningregulation,mitigation,orpolicyappliedornotappliedtotheproject,wasdoneconsistentwiththe authoritygrantedbycityordinancesortheCaliforniaEnvironmentalQualityAct(CEQA).Theappealmustbein ingtheprecisebasisorissueasnoted,mustincludetheappropriatefilingfee,andmustbefiledwithin writingstat 10days ofthedecisiondatetotheCityofBakersfieldPlanningCommission(c/oBakersfieldPlanningDirector, 1715ChesterAvenue,Bakersfield,CA93301).ThePlanningCommissionwillholdapublichearingontheappeal andtheirdecisionwillbefinalunlesstheirdecisionisappealedtotheCityCouncil.
