AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE SEVE~'r~.~ OF THE
BAKERSFIELD MUNICIPAL CODE BY CHANGING THE
LAND USE ZONING OF THAT CERTAIN PROPERTY
LOCATED AT THE SObT~WEST CORNER OF SOUTH
BROWN STREET AND EAST CALIFORNIA AVENUE IN
THE CITY OF BAKERSFIELD FROM AN C-1-D
(LIMITED CO~ERCIAL-DESIC=N OVERLAY) ZONE TO A
C-2 (GENERAL C~CIAL) ZONE.
WHEREAS, in accordance with the procedure set forth in
Title 17 of the Municipal Code of the City of Bakersfield, the
Planning Commission held a public hearing on a petition to change
the land use zoning map designation of that certain property in
the City of Bakersfield as hereinafter described as set forth and
designated upon the Zoning Map No. 103-33 incorporated within and
made part of Title Seventeen of the Bakersfield Municipal Code;
and
WHEREAS, by Resolution No. 10-90 on April 5, 1990, the
Planning Commission recommended approval and adoption of an
ordinance amending Title 17 of the Municipal Code to approve a
C-2 (General Commercial) Zone, as delineated on attached map, by
this Council and this Council has fully considered the findings
made by the Planning Commission as set forth in that Resolution;
and
WHEREAS, the City Council has determined after due
consideration of said petition and the recommendations of the
Planning Commission herein on file, together with the reasons
advanced at the hearing for changes in zoning of said properties,
that zone change should be authorized; and
WHEREAS, the site is land consisting of 14,300 square
feet of fenced property with a storage shed; and
WHEREAS, the property was incorrectly depicted as being
zoned C-i-D on the adopted zone map; and
WHEREAS, the correct zoning classification is C-2; and
WHEREAS, the City Council has considered and hereby
makes the following findings:
1. That the site is depicted as GC (General
Commercial) on the Metropolitan Bakersfield 2010 General Plan;
2. That the zone change is consistent with the land
use element of the Metropolitan Bakersfield 2010 General Plan;
3. That the zone change will correct an error on the
adopted zone maps;
4. That the correction to a mapping error is
categorically exempt from the California Environmental Quality
Act (CEQA).
NOW, THEREFORE, BE IT ORDAI~ED by the Council of the
City of Bakersfield as follows:
1. All of the foregoing recitals are hereby found to
be true and correct.
2. Section 17.06.020 (Zoning Map No. 103-33) of the
Municipal Code of the City of Bakersfield be and the same is
hereby amended by changing the zone district designation of
certain properties in said City, the boundaries of which
properties are shown on the map hereto attached and made a part
hereof, as follows:
FROM A C-1-D (LIMITED COMMERCIAL-DESIGN
OVERLAY) ZONE TOA C-2 (COMMERCIAL) ZONE:
Lots 43 and 44 of Tract 1320 in the City of
Bakersfield, County of Kern, State of California,
as per map recorded December 26, 1946, in Map
Book 5, Page 197, in the Office of the County
Recorder of said County.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
