HomeMy WebLinkAboutRES NO 58-99RESOLUTION NO. 5 8 ' g 9 A RESOLUTION DISPENSING WITH BIDDING UNDER SECTION 3.20.060 OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO THE REMOVAL OF HAZARDOUS MATERIALS AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFORE NOT TO EXCEED $50,000. WHEREAS, the City of Bakersfield has recently acquired certain property for the Q Street Grade Separation; and WHEREAS, during excavation of said property for the Q Street Grade Separation a concrete vault containing bunker oil was discovered on the project site; and WHEREAS, the vault as well as the materials contained therein were not on the original plans; and WHEREAS, bunker oil is considered a hazardous material; and WHEREAS, the original vault containing the bunker oil is now cracking and falling apart exposing the bunker oil to possible further distributions; and WHEREAS, the notice of the situation arose on or about April 27, 1999; and WHEREAS, the work, supplies, equipment and materials must be immediately supplied to this project for the removal of the hazardous materials the same being of urgent necessity for the preservation of life, health or property; and WHEREAS, the Public Works Director recommends the Council find that the work is of urgent necessity for the preservation of life, health or property; and WHEREAS, the Finance Director recommends the Council dispense with bidding under subsection D.4 of section 3.20.060 of the Bakersfield Municipal Code. -- Page I of 3 Pages -- NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD AS FOLLOWS: 1. The above recitals are true and correct and incorporated herein by reference. 2. The work, supplies, equipment and materials are of urgent necessity for the removal of hazardous materials for the preservation of life, health or property. 3. The Finance Director is authorized to dispense with bidding in accordance with subsection D.4 of section 3.20.060 of the Bakersfield Municipal Code. 4.
