HomeMy WebLinkAboutRES NO 165-2022RESOLUTION NO. 1 6 5- 2 02 2 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD APPROVING AND RATIFYING THE EXECUTION OF THE CONTRACT AWARDED TO GILLIAM & SONS INC. ($353,615), FOR THE ABATEMENT OF A 7,524 SQ FT URM BUILDING LOCATED AT 2011 CHESTER AVENUE WHICH SUFFERED CATASTROPHIC FIRE DAMAGE REQUIRING AN EMERGENCY DEMOLITION FOR THE PRESERVATION OF LIFE, HEALTH AND PROPERTY AND THE APPROPRIATION OF FUNDS NOT TO EXCEED $353,615 FROM THE ECONOMIC & COMMUNITY DEVELOPMENT DEPARTMENT'S URBAN REDEVELOPMENT FUND (PSVS) TO THE DEVELOPMENT SERVICES OPERATING BUDGET. WHEREAS, On September 7, 2022, at about 10:53 PM, Building Department on -call staff went to assist the Bakersfield Fire Department on a structure fire in the 2000 block of Chester Avenue to provide damage assessment and other support as needed for a large fire of two vacant, commercial, structures at 2001 and 2011 Chester Avenue; and WHEREAS, On September 8, 2022, at about 8:00 AM, the Building Director and staff completed the damage assessment of the building located at 2011 Chester Avenue and determined an emergency demolition of the building was needed and was urgently necessary for the preservation of life, health or property because of concerns of the structural integrity of the building; and WHEREAS, the structure was a 2-story retrofitted Unreinforced Masonry Building (URM), and due to the catastrophic fire the building's roof, second floor and first floor were completely burned and collapsed into the basement of the building, leaving unbraced, unreinforced masonry walls approximately 40' high that posed imminent threat of collapse immediately adjacent to public sidewalks and alley; and WHEREAS, the Building Director determined summary abatement and emergency demolition was of urgent necessity to preserve life, health and safety and coordinated the closure of the north alley of 20th Street, the # 1 soufhbound lane of Chester Avenue, and the installation of perimeter fencing around the buildings; and WHEREAS, a 48-hour Summary Abatement notice was provided to the record owners of the property who were incapable of completing the work; and WHEREAS, based upon bids received and requisite skill and experience, the City awarded an emergency demolition contract to Gilliam & 'ORIGIN," Sons Inc. in the amount of $353,615.00 for the emergency demolition; and WHEREAS, the funds not to exceed $353,615.00 were appropriated from the Economic & Community Development Department's Urban Redevelopment Fund (PSVS) to the Development Services Operating Budget to be reimbursed through the lien process or the emergency demolition. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield: 1. The foregoing findings and recitals are true and correct, and incorporated by reference herein. 2. Based upon the facts included in the above recitals, the emergency demolition work is hereby deemed to be of urgent necessity for the preservation of life, health or property, and therefore the City Council ratifies the decision to dispense with usual bidding procedures in accordance with Section 3.20.060, subsection (D) (4) of the Bakersfield Municipal Code. 3. The City Council hereby approves and ratifies the execution of the contract awarded to Gilliam & Sons, Inc. in the amount of $353,615 for the abatement of a 7,524 sq ft URM building located at 2011 Chester Avenue which suffered catastrophic fire damage requiring an emergency demolition. 4.
