WHEREAS, the Planning Commission of the City of
Bakersfield held a public hearing on the issue of the City's
intention to adopt the Sanwa Bank Development Agreement,
incorporated herein by reference, on July 5, 1990, and found as
follows:
]. The Development Agreement is consistent with the
objectives, policies and general land uses specified in the
General Plan;
2. The Development Agreement is compatible with the
uses authorized in, and the regulations prescribed for, the zone
~Ln which the real property is located;
3. The Development Agreement is in conformity with
public convenience, general welfare and good land use practice;
4. The Development Agreement will not be detrimental
to the health, safety and general welfare;
5. The Development Agreement will not adversely
affect the orderly development of property or the preservation of
property values; and
WHEP~J~, environmental reviews were conducted with
respect to impacts from future development based on the land use
designation for this project site and its surrounding area in
connection with general plan amendment for Sections 6 and 7 and a
subsequent zone change for the project site. Both were approved
with a negative declaration; and
WHEREAS, the negative declaration was based partly on a
1980 comprehensive Environment Impact Report (EIR) for the State
College Area General Plan Amendment and an EIR for the General
Plan Amendment (GPA) for Section 6 which was completed in 1984,
plus the subsequent initial studies for the November 1988 GPA for
Sections 6 and 7 and the April 1989 zone change for the project
site; and
WHEREAS, a negative declaration for the development
agreement was posted on June 13, 1990 and adopted by the Planning
Commission at a public hearing on July 5, 1990. Said negative
declaration gave consideration to previously completed
environmental assessments. Required mitigation relative to
public improvements necessitated by this project have been made a
part of the proposed development agreement; and

W~ERBAS, notice of the above hearings have been given
as required by law and City Council Resolution No. 122-85 and the
requirements of said resolution have been satisfied; and
WHEREAS, following the public hearing on said
Development Agreement before this Council held on W~R~E,%OA¥, JULY
25, 1990, this Council has found and determined that the
provisions of the proposed development agreement are consistent
with the Metropolitan Bakersfield 2010 General Plan.
NOW, T~EREFORE, BE IT ORDAIIgED by the Council of the
City of Bakersfield as follows:
SECTION 1.
1. The recitals set forth above are true and correct.
2. The Development Agreement between City of
Bakersfield and Sanwa Bank as Trustee Under Trust No. 27128-00-8
(dated 12/20/89) is hereby approved and adopted.
SECTION 2.
This Ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
