RESOLUTION OF INTENTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD TO CONDITIONALLY APPROVE THE SALE OF CITY -
OWNED PROPERTY LOCATED AT 7821 WIBLE ROAD (APN: 515-
040-21) IN BAKERSFIELD, CALIFORNIA TO HABITAT FOR
HUMANITY TO DEVELOP QUALITY, AFFORDABLE HOUSING.
WHEREAS, the City owns a fee simple interest in property located at 7821 Wible
Road (APN: 515-040-21) on the west side of Wible Road between Amazon Drive and
Hosking Avenue in Bakersfield, California ("Property"); and
WHEREAS, the Bakersfield Planning Department found the sale of this Property to
be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to
Government Code Section 65402; and
WHEREAS, on June 16, 2022 the Bakersfield City Council declared the Property
Exempt Surplus Land because staff intended to initiate a competitive bid process
consistent with Government Code Section 54221(f) (1) (F) (i) to sell the Property for the
development of affordable housing; and
WHEREAS, on September 16 ,2022 staff released a request for proposals (RFP) to
solicit proposals from qualified affordable housing developers to build quality, affordable
housing at 7821 Wible Road; and
WHEREAS, three applications were received in response to the RFP; and
WHEREAS, city staff has recommended the Property be sold to Habitat for
Humanity - Golden Empire (HFHGE) to undertake the Wible Road - Homeownership
Project; and
WHEREAS, the Bakersfield City Council concurs with the recommendation of city
staff and desires to negotiate with HFHGE for the sale of the Property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield as
follows:
The above recitals are true and correct and incorporated herein.
2. The City Council finds and declares that it is necessary and in the best
interests of the City to negotiate with HFHGE for the sale of real property at 7821 Wible
Road, Bakersfield, California to develop quality, affordable housing to increase
affordable homeownership access.
3. This commitment is made with the following conditions:
3.1. The California Department of Housing and Community
Development (HCD) approves the disposition and the process undertaken by the City 0aK,
of Bakersfield in accordance with Government Code Section 54221(f) (1) (F) (i). Subject to
approval by HCD, City will begin negotiations with HFHGE for the disposition of the : o

property.
3.2. Upon approval of the sale by the HCD, HFHGE and the City of
Bakersfield agree to terms, as enumerated in a purchase and sales agreement, to
dispose of the property in the amount of $175,000 (or appraised value at the time of
negotiation) to develop at least six single-family homes for homeownership to lower -
income households as defined in California Health and Safety Code 50079.5.
3.3. Key components of the proposed project will not change without
the administrative approval of the City of Bakersfield.
3.4. This Resolution does not constitute a disposition action or a legally
binding agreement to dispose of the property to HFHGE. Further, such disposition and a
binding purchase and sale agreement, may only be entered into upon approval of the
disposition process by HCD, and both parties agreeing to terms as set forth in an
executed purchase and sales agreement, or similar instrument, approved by City
Council.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the
Council of the City of Bakersfield at a regular meeting thereof held on
