HomeMy WebLinkAboutORD NO 3341ORDINANCE NO. 3341 AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE ADOPTING 1) ZONING MAP NO. 101-13 WITH THE APPROVED ZONING UPON ANNEXATION DESIGNATIONS LOCATED SOUTH OF REINA ROAD, WEST OF JEWETTA AVENUE, EAST OF ALLEN ROAD TO HAGEMAN ROAD, AND 2) ZONING MAP NO. 123-35 WITH THE APPROVED ZONING UPON ANNEX- ATION DESIGNATIONS LOCATED SOUTH OF HOSKING AVENUE, WEST OF WIBLE ROAD, EAST OF STINE ROAD TO TAFT HIGHWAY. WHEREAS, in accordance with the procedure set forth in Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to adopt the Zoning Maps No. 101-13 and No. 123-35 respectively of those certain properties in the City of Bakersfield located 1) south of Reina Road, west of Jewetta Avenue, east of Allen Road to Hageman Road and 2) south of Hosking Avenue, west of Wible Road, east of Stine Road to Taft Highway; and WHEREAS, by Resolution No. 3-91 on January 10, 1991, the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Municipal Code to approve: 1) Zoning Map No. 101-13 with the adopted zoning upon annexation designations and 2) Zoning Map No. 123-35 with the adopted zoning upon annexation designations, as herein described and as deline- ated on maps marked Exhibit "A" and Exhibit "B," attached hereto and incorporated herein as though fully set forth, by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted adoption of said zoning maps, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, the Planning Commission determined that this project is categorically exempt from the CEQA Act; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for adopting the said maps, that Zoning Maps No. 101-13 and No. 123-35 should be adopted; and WHEREAS, the required public notices have been given; and. WHEREAS, the City Council has considered and hereby makes the following findings: 1. That public necessity, convenience, general welfare and good zoning practice justify the adoption of said maps. 2. That the proposed maps are consistent with the Bakersfield Metropolitan 2010 General Plan. 3. The project is categorically exempt from CEQA. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by adopting Zoning Map No. 101-13 and Zoning Map No. 123-35 with the adopted Zoning Upon Annexation designations of those certain properties in said City, the boundaries of which properties are shown on the maps marked Exhibit "A" and Exhibit "B," attached hereto and made a part hereof, as follows: Zoning Map #101-13 Zoning Upon Annexation Districts are more particularly described as follows: FROM COUNTY A (EXCLUSIVE AGRICULTURE) TO CITY RS (RESIDENTIAL SUBURBAN) ZONE: A portion of Lots 7 and 18 of the Jewett and Raine Subdivision No. 1 in the unin- corporated area, County of Kern, State of California as per map recorded January 8, 1914 in Book 3, Page 3 of maps, in the Office of the Kern County Recorder, described as follows: Commencing at the southwest corner of Section 18, T29S, R27E, M.D.B.&M.; THENCE south 89054'48" east along the south section line of said section, 1710.60 feet; THENCE north 00°05'12" east, 55.00 feet to the True Point of Beginning: THENCE (1) north 00°40'49" east, 2539.83 feet; - 2 - THENCE (2) north 89°55'03" west, 240.01 feet; THENCE (3) south 00°40'49" west, 2539.81 feet; THENCE (4) south 89054'48" east, 240.01 feet to the True Point of Beginning.
