RESOLUTION NO.
RESOLUTION DISPENSING WITH BIDDING
PROCEDURES DUE TO EMERGENCY PIPE
REPAIR AT WASTEWATER TREATMENT PLANT
NO. 2 AND AUTHORIZING GSE
CONSTRUCTION COMPANY, INC. (NOT TO
EXCEED $1,475,000), AND U.S. PEROXIDE, LLC
DBA USP TECHNOLOGIES (NOT TO EXCEED
$275,000)TO PERFORM NECESSARY REPAIRS.
WHEREAS, on December 21d, 2022, a sinkhole caused by the partial collapse of a
60-inch pipe was discovered at Wastewater Treatment Plant No. 2 (Plant 2); and
WHEREAS, assessment of the pipe revealed the full 295 ft length of pipe had
extensive corrosion damage, and over 20 ft of the pipe's crown was missing; and
WHEREAS, the Public Works Director determined that the repairs could not be
made by City staff alone; and
WHEREAS, after assessing the condition of the pipe, the Public Works Director
declared these conditions to be an emergency requiring work, supplies, equipment, and
materials urgently necessary for the preservation of life, health, and property; and
WHEREAS, GSE Construction Company, Inc. (GSE Construction) was authorized by
the Public Works Director to repair 295 ft of 60-inch pipe, mitigate imminent hazards inside
the primary effluent junction box, and mobilize a bypass since GSE Construction had the
necessary resources and expertise to timely repair the pipe In order to get the line back
in operation as soon as possible; and
WHEREAS, the Public Works Director authorized U.S. Peroxide, LLC dba USP
Technologies (USP Technologies) to mobilize and provide chemical enhanced treatment
to assist Plant 2 with waste discharge permit compliance during this emergency; and
WHEREAS, the Public Works Director recommends the Council authorize the
proposed repairs and dispense with bidding requirements, in accordance with
subsection D.4 of Section 3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above -recitals are true and correct and incorporated herein by reference.
2. Based on the facts included in the above recitals, the work is hereby deemed
to be of urgent necessity for the preservation of life, health or property.

The expenditure of funds to GSE Construction for the services and materials
shall not exceed $1,475,000.
The expenditure of funds to USP Technologies for the services and materials
shall not exceed $275,000.
5. The Finance Director is authorized to dispense with bidding in accordance with
Section 3.20.060 of the Bakersfield Municipal Code
