HomeMy WebLinkAboutRES NO 021-2023RESOLUTION NO. 02 1- 2 02 3 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD DISPENSING WITH BIDDING PROCEDURES DUE TO AN EMERGENCY REPLACEMENT AND REPAIR OF THE HEADERS FOR THE ICE RINK AT THE MECHANICS BANK ARENA, AND AUTHORIZING CIMCO REFRIGERATION, INC. TO PROVIDE SERVICES AND MATERIALS NECESSARY TO REPLACE AND REPAIR THE HEADERS, NOT TO EXCEED $461,640. WHEREAS, the existing steel headers for the ice rink at the Mechanics Bank Arena is the original headers when the facility opened in 1998; and WHEREAS, the existing steel headers have deteriorated and are at risk of leaking brine; and WHEREAS, the deterioration of the steel headers adversely affects the condition and safety of the ice for the Bakersfield Condors, Disney on Ice, and others using the ice rink; and WHEREAS, Staff contacted CIMCO Refrigeration, Inc. a commercial contractor experienced in the repair of ice rinks at National Hockey League and American Hockey League facilities and has the expertise and experience to furnish and install new steel headers; and WHEREAS, CIMCO Refrigeration, Inc. recently upgraded the ice rink and currently holds the service contract with the City to inspect and repair the upgraded equipment; and WHEREAS, CIMCO Refrigeration, Inc. requires a purchase order number prior to ordering the necessary parts and materials to replace the steel headers; and WHEREAS, getting bids for the repair of steel headers for the ice rink at the Mechanics Bank Arena through the normal bidding procedures will delay the ordering of parts and the repair of the headers, which will affect scheduled events and the safety for staff, guests and performers at the Mechanics Bank Arena. WHEREAS, the Public Works Director recommends the Council to dispense with bidding requirements in accordance with Bakersfield Municipal Code Section 3.20.060(D)(4(. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as o``Ba KF�N -- Page 1 of 3 Pages -- I ^ ORIGIN,.L I. The above recitals are true and correct and incorporaied herein by reference. 2. Based on the facts included in the above recitals, ordering of the necessary parts and the repair to be performed by an outside contractor and necessary ancillary services are of urgent necessity for the preservation of life, health or property, thereby allowing the dispensing of normal bidding procedures as set forth in section 136 of the City Charter and the Bakersfield Municipal Code Section 320.060. 3, The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060(D((4) of the Bakersfield Municipal Code. 4. The expenditure of funds- for said work, supplies, equipment or materials shall not exceed four hundred and sixty-one thousand, six hundred and forty dollars ($461,640). 1 HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regu lar meeting thereof held on FF8 2 2 2323 by the following vote: i ✓ ✓ ✓ ✓ AYESCOUNCIL MEMBER ARkS,GONZALES.
