A RESOLUTION OF THE BAKERSFIELD CITY
COUNCIL AUTHORIZING THE PURCHASE OF
CERTAIN TAX -DEFAULTED REAL PROPERTIES
FROM THE KERN COUNTY TREASURER TAX
COLLECTOR WHICH HAVE BEEN DESIGNATED BY
CITY AS CHRONIC NUISANCE PROPERTIES.
WHEREAS, on March 2, 2022, the City Council allocated Coronavirus State
and Local Fiscal Recovery Funds (SLFRF) (31 CFR Part 35 also commonly known as
American Rescue Plan Act or ARPA) funding for the purchase of blighted properties
for the purposes of the elimination of blight, including vacant and abandoned
properties citywide; and
WHEREAS, on March 2, 2022, the City Council allocated SLFRF funding for the
purchase of vacant or blighted properties in the downtown area and other
business districts within the City; and
WHEREAS, on June 13, 2022, the City Planning and Development Committee
directed staff to form a dedicated team to focus on Chronic Vacant Nuisance
Buildings (CNP), Posted Substandard buildings and buildings that sustained fire
and/or structural damage, and consider remedies including Abatement of
Dangerous Buildings or a Receivership or Purchase program; and
WHEREAS, on June 15, 2022, the City Council adopted the 2022-23 budget
which allocated funding for the purchase of and/or renovation of vacant,
abandoned or blighted properties; and
WHEREAS, on September 28, 2022, the City Planning and Development
Committee directed staff to bring the resolution of intent to City Council for
adoption; and
WHEREAS, the City Council on October 5, 2022 adopted Resolution No. 155-
2022, which gave staff direction for the acquisition of properties designated as
CNPs within the City of Bakersfield; and
WHEREAS, under the direction of City Council, the City Code Enforcement
Division has developed a list of CNP's; and
WHEREAS, California Government Code Section 37350 authorizes a city to
purchase, lease, receive, hold and enjoy real and personal property, and control

and dispose of it for the common benefit; and
WHEREAS, the City Charter authorizes the City to acquire and purchase
property for any municipal purpose; and
WHEREAS, the Kern County Treasurer and Tax Collector ("KCTTC") notified the
City of Bakersfield ("City") that it will offer for sale at public auction to the highest
bidder certain tax -defaulted properties located within the City of Bakersfield; and
WHEREAS, the City has reviewed the list of properties, provided by KCTTC,
and has identified properties that have been slated as CNF's by staff that are
included in the upcoming public tax sale on March 13, 2023 which the City desires
to purchase and are listed in Exhibit "A" attached hereto and incorporated by
reference herein; and
WHEREAS, the City Council desires to provide authorization to the City
Manager or designee to bid on and purchase properties listed in the attached
Exhibit "A" for the required minimum bids as set by the KCTTC below; and
WHEREAS, the City Council authorizes the City Manager or his designee to bid
on and purchase real property at the public tax sale being held March 13-15, 2023.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The Council of the City of Bakersfield authorizes the City Manager or his
designee to bid on and purchase any tax -defaulted properties at the
KCTTC tax sale between March 13-15, 2023, as set forth in Exhibit "A".
3. The City Manager or designee is authorized to bid the minimum bid as
set forth by the KCTTC for the purchase of the properties.
4. The expenditure of funds to the KCTTC for the purchase of said
properties shall not exceed One Million One Hundred Fifteen Thousand
Dollars ($1,115,000).

HEREBY CERTIFY that the foregoing Resolution was passed and adopted by
the Council of the City of Bakersfield at a regular meeting thereof held on
