RESOLUTION NO.
RESOLUTION APPROVING CONTINUED USE
OF THE MAINTSTAR SOFTWARE AND
AUTHORIZING PAYMENT OF THE ANNUAL
SUPPORT FEES FOR CONTINUED USE, NOT TO
EXCEED $44,159.38.

WHEREAS, on August 15, 2007, the City entered into Agreement No. 07-290
for the creation of maintenance management software by MaintStar, Inc., which
is used by certain City departments to, among other things, create and track work
orders and schedule and organize work and resources; and
WHEREAS, on July 15, 2009, the City and MaintStar, Inc. amended
Agreement No. 07-290 to increase compensation for the development and
conversion of data to use multiple layers of GIS maps; and
WHEREAS, since the execution of Agreement No. 07-290(1), the City has
continued to use the MaintStor software, but annual maintenance and support
fees are invoiced separately in advance of a renewal term in order for City to
continue effectively using the software; and
WHEREAS, MointStar, Inc. is the sole source provider of the MaintStar
software created and purchased by City and the only vendor capable of
providing upgrades, maintenance, and access to the purchased software; and
WHEREAS, purchases greater than $40,000 require City Council approval;
and
WHEREAS, the City Council therefore authorizes the Finance Director or his
designee to renew the MaintStar software via payment of the necessary annual
maintenance fees in order to continue use of the software.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
The above recitals are true and correct and are incorporated herein
by reference.
2. The Council finds that payment of the annual support fees for the
MaintStar software is necessary for the City's continued use and
maintenance of the software purchased pursuant to Agreement No.
07-290(l).

3. The Finance Director is authorized to pay annual access fees from
MointStar, Inc., in an amount not to exceed $44,159.38.
I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
MAR 2 2 2023 by the following vote:
