RESOLUTION APPROVING CONTINUED USE
OF THE EXECUTIME CLOUD ADVANCED X-Ref.aoao-a"l
SCHEDULING SOFTWARE AND AUTHORIZING
PAYMENT OF THE ANNUAL ACCESS FEES FOR
CONTINUED USE BY THE BAKERSFIELD POLICE
DEPARTMENT, NOT TO EXCEED W,349.00.
WHEREAS, on November 18, 2020, the City entered into Agreement No.
2020-241 for the purchase of Executime Advance Scheduling from Tyler
Technologies, Inc., to provide timekeeping functions for Bakersfield Police
Department (BPD) employees; and
WHEREAS, Tyler Technologies, Inc. is the sole source provider of the
Executime Advance Scheduling software and the only vendor capable of
providing upgrades, maintenance, and access to the purchased software as a
service; and
WHEREAS, Agreement No. 2020-241 remains in force and effect and renews
automatically for one-year periods unless terminated earlier by the parties, but
annual maintenance and access fees are invoiced separately in advance of a
renewal Term; and
WHEREAS, the City desires to continue its relationship with Tyler Technologies
and continue utilizing the Executime Advance Scheduling software in use by the
BPD pursuant to Agreement No. 2020-241; and
WHEREAS, purchases greater than $40,000 require City Council approval;

WHEREAS, the City Council therefore authorizes the Finance Director or his
designee to renew the Executime Advanced Scheduling software via payment
of the necessary annual access fees in order to continue use of the software as
a service pursuant to Agreement No. 2020-241.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein
by reference.
2. The Council finds that payment of the annual access fees for the
Executime Advanced Scheduling software is necessary for the City's continued

use and maintenance of the software purchased pursuant to Agreement No.
2020-241.
3. The Finance Director is authorized to pay annual access fees from
Tyler Technologies, Inc., in an amount not to exceed $45,349.
HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
MAR 2 2 2023 , by the following vote:
