AN ORDINANCE ADDING CHAPTER 17.31
TO THE BAKERSFIELD MUNICIPAL CODE
RELATING TO M-3 (HEAVY INDUSTRIAL)
ZONES.
BE IT ORDAINED by the Council of the City of
Bakersfield as follows:
SECTION 1.
Chapter 17.31 is hereby added to the Bakersfield
Municipal Code to read as follows:

M-3 (Heavy Industrial) Zone

17.31.010 Generally.
The regulations set out in this chapter shall apply in the
M-3 (Heavy Industrial) Zone unless otherwise provided in this
chapter. The M-3 zone is intended to provide areas suitable for
the development of heavy manufacturing and industrial uses,
processing of animals for food or byproducts, waste recycling or
disposal processing, and processing or manufacture of undesirable
products. Uses allowed in the M-3 zone are incompatible with
other land uses and should be located in places substantially
removed from uses which may be impacted from M-3 uses.
17.31.020 Uses permitted.
A. The following uses are permitted in an M-3 zone:
1. Acetylene gas manufacture and storage,
2. Acid manufacture,
3. Alcohol and alcoholic beverage manufacturing and
distillation,
4. Beef, swine, poultry or rabbit slaughter,
5. Blast furnaces,
6. Cement and lime manufacturing when the manufacturing plant
is equipped capable of collecting at least ninety-seven
percent of all particulate matter from kiln gases,
7. Chemical manufacture,
8. Clay product manufacture,
9. Coke ovens,
10. Cotton gins or oil mills,
11. Creosote treatment or manufacture,
12. Curing, tanning, and storage of raw hide or skins,
13. Disinfectant manufacture,
14. Distillation of coal, wood, bones, or tar,
15. Drop forge industries manufacturing forgings with power
hammers,
16. Explosives, manufacture or storage,
17. Exterminator or insect poison manufacture,
18. Fat rendering,
19. Feed and fuel yards,
20. Fertilizer manufacture,
21. Forge plants,
22. Gelatin or size manufacture,
23. Glass or glass product manufacture,
24. Glucose or dextrine manufacture,
25. Glue manufacture,
26. Iron, steel, brass or copper foundries or fabrication
plants, and heavy weight casting,
27. Nonmineral oil extracting plants,
28. Ore reduction,
29. Paint, oil, shellac, turpentine or varnish manufacture,
30. Paper or pulp manufacture,
31. Petroleum refining, reclaiming plants, and associated
uses,
32. Rolling mills,
33. Rubber processing and manufacture,
34. Sawmills,
35. Smelting of tin, copper, zinc, or iron ores,
36. Scrap metal yards, junkyards,
37. Tar roofing or waterproofing or other tar products
manufacture.
38. Accessory buildings or structures necessary to such use
located on the same lot or parcel of land.
39. Dwelling for use by a caretaker or night security, or as
accessory and incidental to the permitted use on the
parcel.
17.31.030 Uses permitted by conditional use permit.
The following uses may be permitted in a M-3 Zone subject to
approval of a conditional use permit in accordance with the
procedures provided for in Chapter 17.64:
Any of the following uses:
1. Coal-fired cogeneration facility or steam generator,
2. Community septic disposal system,
3. Electrical power generator plant, nuclear or coal powered,
4. Hazardous waste disposal facility,
5. Mining and mineral extraction,
6. Nonhazardous oily waste disposal facility,
7. Sanitary landfill,
8. Septage disposal site,
9. Sewage treatment plant,
10. Transfer station, large volume,
11. Transfer station, small volume,
12. Waste-to-energy facility.
B. Uses as specified in Chapter 17.66.
17.31.040 Site Plan Review.
All permitted and conditional uses set forth in this chapter
shall be subject to site plan review as provided in Chapter
17.53. In addition, the following requirements shall apply to all
industrial development subject to the site plan review:
A. Landscaping shall be subject to the requirements of
Section 17.53.061 of Chapter 17.53.
B. Off-street parking and loading shall be subject to the
requirements of Chapter 17.58, and subsection B of Section
17.34.020 for parking areas located adjacent to property zoned
for residential development.
C. Signs shall be subject to the requirements of Chapter
17.60.
D. Industrial development proposed adjacent to property
zoned or designated for residential development shall be required
to be separated by a solid masonry wall constructed a minimum
height of six (6) feet. This requirement shall not apply along
any street frontage. Any wall located within the front yard area
shall not exceed a height of four (4) feet.
E. Open storage of material and equipment permitted in this
zone shall be surrounded and screened by a solid wall or fence,
including solid gates where necessary, not less than six (6) feet
in height. Materials shall not be stacked above the height of the
screening.
17.31.050 Building height.
Building height in an M-3 zone shall not exceed 210 feet
(approximately 14 stories).

17.31.060 Front yard.
Front yard requirements in an M-3 zone shall be as follows:
A. All buildings shall be located not nearer than ten (10)
feet from the front property line.
B. All buildings used exclusively for dwelling purposes
shall comply with the provisions of the R-4 zone.
17.31.070 Side yards.
Side yard requirements in an M-3 zone shall be as follows:
A. All buildings shall be located not nearer than 20 feet
from the side property line.
B. Side yard setback when property is adjacent to
residential zone: no industrial building shall be located nearer
than forty-five (45) feet if single story structure; no
industrial building shall be located nearer than sixty-five (65)
feet if multi-story structure.
C. Side yard setback areas may only be used for landscaping
and parking.
D. All buildings used exclusively for dwelling purposes
shall comply with the provisions of the R-4 zone.
17.31.080 Rear yard.
Rear yard requirements in an M-3 zone shall be as follows:
A. All buildings shall be located not nearer than twenty
(20) feet from the rear property line.
B. Rear yard setback when property is adjacent to
residential zone: no industrial building shall be located nearer
than forty-five (45) feet if single story structure; no
industrial building shall be located nearer than sixty-five (65)
feet if multi-story structure.
C. Rear yard setback areas may only be used for landscaping
and parking.
D. All buildings used exclusively for dwelling purposes
shall comply with the provisions of the R-4 zone.
17.31.090 Minimum lot area.
There shall be no minimum lot area in an M-3 zone.
17.31.100 Distance between buildings on the same lot.
There shall be no distance required between buildings on the
same lot in an M-3 zone, except all buildings used exclusively
for dwelling purposes shall comply with the provisions of the R-4
zone.
SECTION 2.
This Ordinance shall be posted in accordance with the
Bakersfield Municial Code provisions and shall become effective
thirty (30) days from and after the date of its passage.
