Chapter 17.20 of the Bakersfield Municipal Code is hereby amended to read as follows: Chapter 17.20 C-O Professional and Administrative Office Zone Sect ions: 17.20.010 17.20.020 17.20.030 17.20.040 17.20.050 17.20.060 17.20.070 17.20.080 17.20.090 17.20.100 17.20.110 Generally. Uses permitted. Uses permitted subject to planning director review and approval. Uses permitted subject to conditional use permit. Site plan review. Building height. Front yard. Side yards. Rear yard. Minimum lot area. Distance betweenbuildings on same lot. 17.20.010 Generally. The regulations set out in this chapter shall apply in the C-O profes- sional and administrative office zone unless otherwise provided in this title. The purpose of this zone is to designate areas suitable for busi- ness and professional office development. The C-O zone may also serve as a buffer between regional cc~mercial and residential areas. 17.20.020 Uses permitted. The following uses are permitted in a C-O zone: A. Any one or more of the following uses: 1. Accounting, auditing, tax preparation and bookkeeping services, 2. A~vertising agencies, 3. Banks, savings and loans, credit unions and other financial institutions, 4. Business and management consulting services, 5. Business and professional membership organizations, 6. C(m~ercial art and graphic design, 7. Co~m~ercial photography, including portrait studios, 8. Computer programming and data processing services, 9. Consumer credit reporting and collection services, 10. Day Care Nursery, 11. Detective and security systems services, 12. Direct mail advertising services, 13. Employment agency and help supply services, 14. Engineering, surveying, architectural and environmental planning services, 15. Family and social service, clinics and centers, 16. Governmental services and administration, including libraries, museums, galleries and judicial courts; except police, fire, and other emergency service alarm centers, 17. Insurance services, 18. Legal services, 19. Management and public relation services, 20. Medical, dental, psychiatric and other health practitioner offices and clinics, including chiropractic, accupuncture, massage therapy and bloodbanks, 21. Medical and dental laboratories, 22. Mortgage, loan and personal credit institutions, 23. Palm reading, fortune telling, astrologic and psychic services, 24. Pharmacy, in conjunction with medical clinic, 25. Public and private utility administration, 26. Real estate development, sales and property management services, 27. Secretarial and court reporting services, 28. Telecommunications administration, 29. Television, radio and cable broadcasting stations, 30. Title and escrow offices, 31. Travel agencies, 32. Trusts and investment agencies, B. Accessory buildings or structures necessary to such use located on the same lot or parcel of land. C. Temporary offices including portable, modular or prefabricated structures constructed in conformance with the uniform codes adopted by the city (Title 15 of this code) and not attached to permanent foundations may be allowed for a period not to exceed two years, plus one-year extension subject to the approval of the planning commission. D. Dwelling for use by caretaker or night security, or as accessory and incidental to the permitted use on the parcel. -2- 17.20.030 Uses subject to planning director review and approval. The following uses may be permitted in a C-O zone subject to review and approval by the planning director: A. Public utility structures. B. Water pump stations. 17.20.040 Uses subject to conditional use permit. The following uses may be permitted in a C-O zone subject to approval of a conditional use permit in accordance with the procedures provided for in Chapter 17.64: A. Any use listed in the Uses Permitted section in the R-I, R-2, R-3 and R-4 zones. B. Any of the following uses: 1. Bail Bond services, 2. Garment cleaning, pressing, alteration and repair, 3. Hair styling shop and beauty salon, including tanning salons, 4. Hotel, motel, 5. Photocopying and duplicating services, 6. Police, fire or other emergency service alarm center, 7. Post office and other courier or parcel delivery service, 8. Restaurants and related eating places, including on-site alcohol sales when served together with and incidental to the serving of food, or in a cocktail lounge or bar which is an accessory use to the restaurant, 9. Research and testing services, 10. Vocational and specialized schools providing technical or cultural training, 11. Veterinary (small animal only), excluding kennel services. C. Uses as specified in Section 17.66.020. 17.20.050 Site plan review. All permitted and conditional uses pursuant to this chapter shall be subject to site plan review as provided in Chapter 17.53. In addition, the following requirements shall apply to all c~L,,Lercial development subject to the site plan review: A. Landscaping shall be subject to the requirements of Section 17.53.061 of Chapter 17.53. B. Off-street parking and loading shall be subject to the requirements of Chapter 17.58, and subsection B of Section 17.34.020 for parking areas located adjacent to property zoned for residential development. C. Signs shall be subject to the requirements of Chapter 17.60. -3- D. Commercial development proposed adjacent to property zoned or des- ignated for residential development shall be required to be separated by a solid masonry wall constructed a minim~n height of six (6) feet from high- est grade. Any wall located within the front yard area shall not exceed a height of four (4) feet. Along street frontages, landscaping shall be required in-lieu of or in combination with a solid wall, to screen the com- mercial development from the residential uses. E. Open storage Of material and equipment permitted in this zone shall be surrounded and screened by a solid wall or fence, including solid gates where necessary, not less than six (6) feet in height. Materials shall not be stacked above the height of the screening. 17.20.060 Building height. Building height requirements in a C-O zone shall not exceed sixty (60) feet (approximately four (4) stories). 17.20.070 Front yard. Front yard requirements in a C-O zone shall be as follows: A. All buildings shall be located a minimum of ten (10) feet from the front property line. B. All buildings used exclusively for dwelling purposes shall comply with the provisions of the R-4 zone. 17.20.080 Side yards. Side yard requirements in a C-O zone shall be as follows: A. Where a lot abuts upon the side of a lot in any R zone, E z~, ~{ zone or PUD project of a residential nature, there shall be a side yard of not less than twenty (20) feet. B. On a corner lot, the side yard on the street side of the lot shall be not less than ten (10) feet. C. In all other cases, a side yard for a professional or administrative office building shall not tx required. D. All buildings used exclusively for dwelling purposes shall comply with the provisions of the R-4 zone. 17.20.090 Rear yard. Rear yard requirements in a C-O zone shall be as follows: A. There shall be behind every building a rear yard having a minimum depth of twenty feet. B. Where there is an alley at the rear of the lot, such rear yard may be measured to the center of the alley. C. All buildings used exclusively for dwelling purposes shall comply with the provisions of the R-4 zone. -4- 17.20.100 Minim~n lot area. The minimien lot area in a C-O_ zone shallbe as follows: none; however, all buildings used exclusively for dwelling purposes shall comply with the provisions of the R-4 zone. 17.20.110 Distance between buildings on the same lot. Distance requirements between buildings on the same lot in a C-O zone shall be as follows: none, except all buildings used exclusively for dwelling purposes shall comply with the provisions of the R-4 zone. SECTION 2. Chapter 17.22 of the Bakersfield Municipal Code is hereby amended to read as follows: Chapter 17.22 C-1 Neighborhood Commercial Zone Sections: 17.22.010 17.22.020 17.22.030 17.22.040 17.22.050 17.22.060 17.22.070 17.22.080 17.22.090 17.22.100 17.22.110 Generally. Rear yard. Minimunn lot area. Distance between buildings on same lot. 17.22.010 Generally. The regulations set out in this chapter shall apply in the C-1 neigh- borhood commercial zone unless otherwise provided in this title. The pur- pose of this zone is to provide an adequate variation of retail establish- ments and services that conveniently serve the needs of residents in the immediate neighborhood. It is highly desirable to blend uses into the area thereby protecting the residential character of the area; but not create architectural or traffic conflicts nor permit the commercial devel- opment to expand into a regional center of such scope and variety as to attract significant volt~nes of traffic frcmoutside the neighborhood. 17.22.020 Uses permitted. The following uses are permitted in a C-1 zeme: A. Any use listed in the Uses Permitted section in the C-O zone. B. Any one or more of the following uses: -5- 1. Apparel and accessory specialty s~hops, does not include large scale chain department stores, 2. Automobile service stations, including convenience markets but excluding truck stops, 3. Bakery, retail only, 4. Book and stationary store, 5. Candy, nut and confectionery store, 6. Christmas tree sales, limited between November 15 to December 26 each calendar year, 7. Church, excluding schools, 8. Cosmetic store, 9. Drugstore, pharmacy, 10. Fabric, yardage store, 11. Florist, 12. Fireworks sales, limited between June 1 and July 5 each calendar year, 13. Garment cleaning, pressing, alteration and repair, 14. Grocery stores, including meat, fish, fruit, vegetable, delicatessen and convenience stores, 15. P~ir styling shop and beauty salon, including tanning salons, 16. Interior decorating, including drapery, curtain and upholstery sales, 17. Jewelry, watch, clocks, silverware, coins and gemstones including repair, 18. Laundromat, 19. Liquor store, 20. Locksmith, 21. Newspaper, magazine store, 22. Pets and pet supply store, including grooming services, 23. Photocopying and duplicating services, 24. Photographic shops and developing services, 25. Physical fitness facility, 26. Private service clubs, lodges, 27. Restaurants and related eating places, excluding on-site alcohol sales, entertainment or drive-through service, 28. Resthome, convalescent home, adult care facility, residential care facility as defined in Section 1502 of the Health and Safety Code of the State of California, 29. Temporary promotional activity as defined in Section 17.04.610, 30. Tobacco store, 31. Video disk/tape rental. 32. Veterinary (small animal only), excluding kennel services, C. Accessory buildings or structures necessary to such use located on the same lot or parcel of land. D. Dwelling for use by caretaker or night security, or as accessory and incidental to the permitted use on the parcel. E. Temporary offices, including ~ortable, ~dular or prefabricated structures constructed in conformance with uniform code adopted by the city (Title 15 Of this code) and not attached to permanent foundations may be allowed for a period not to exceed two years, plus one-year extension sub- ject to the approval of the planning commission. F. The specified store, shops or businesses in subsection B above, shall be retail establishments selling new merchandise exclusively, except used merchandise clearly incidental to the regular business conducted on the premises, and shall be permitted only under the following conditions: -6- 1. Such stores, shops or businesses, except automobile service stations, shall be conducted entirely within an enclosed building. No out- side storage of materials is permitted. 2. Products made incidental to a permitted use shall be sold at retail on the premises. 3. All public entrances to such stores, shops or businesses shall be from theprincipal street upon which the property abuts or within one hun- dred feet thereof, except that a rear or side entrance from the building to a public parking area maybeprovided. 4. The accessory buildings or structures necessary to such use located on the same lot or parcel of land, including a storage garage for the exclusive use of the patrons and employees of the above stores or businesses. 17.22.030 Uses permitted subject to planning director review and approval. The following uses maybe permitted in a C-1 zone subject to review and approval by the planning director: A. Public utility structures. B. Water pu~p stations. 17.22.040 Uses permitted subject to conditional use permit. The following uses may be permitted in a C-1 zone subject to approval of a conditional use permit in accordance with the procedures provided for inChapter 17.64: A. Any use listed in the Uses Permitted section in the R-i, R-2, R-3 and R-4 zones. B. Any of the following uses: 1. Automobile accessory or part store, including stereo, phone, upholstery, and tires where all installation/repair work is con- ducted inside a building, 2. Automobile tuneup specialty shops providing electrical and carbure- tor tuneup services and related work, when not done as apart of, or incidental to, the operation of an automobile service stations, excluding heavy or major mechanical work such as would require removing the cylinder head or transmission, and excluding all body repair or paint work, 3. Carwash, including detailing, 4. Food and/or shelter service agency as defined in Section 17.04.285, 5. Funeral services, including a crematory provided it is incidental to the main use, 6. Hotel, motel, 7. Kennel, entirely contained within an enclosed building, 8. Mobilehome or travel trailer park, 9. Nurseries, lawn and garden supply, 10. Police, fire and other emergency service alarm center, 11. Post office and other courier or parcel delivery service, 12. Research and testing services, -7- 13. Restaurant and related eating places with on-site alcohol sales, entertainment or drive-through services, 14. Small appliance and electronic goods repair where there is no out- side storage of materials or goods, 15. Theater, cinema, excluding drive-in, 16. Trade, vocational or specialized school. C. Uses as specified in Section 17.66.020. 17.22.050 Site plan review. All permitted and conditional uses pursuant to this chapter shall be subject to site plan review as provided in Chapter 17.53. In addition, the following requirements shall apply to all commercial development subject to the site plan review: A. Landscaping shall be subject to the requirements of Section 17.53.061 of Chapter 17.53. B. Off-street parking and loading shall be subject to the requirements of Chapter 17.58, and subsection B of Section 17.34.020 for parking areas located adjacent to proparty zoned for residential development. C. Signs shall be subject to the requirements of Chapter 17.60. D. The regulations set out in this chapter shall apply in the C-2 regional cfxa~ercial zone unless otherwise provided in this title. The purpose of this zone is to permit development of concentrated large-scale retail oper- ations providing a broad range of goods and services which serve the metro- politanmarket area. --9-- 17.24.020 Uses permitted. The following uses are permitted in the C-2 zone: A. Any use listed in the Uses Permitted section in the C-O and C-1 zones. B. Any one or more of the following uses: 1. Adult entertainment establishments as defined in Section 17.69.020 and subject to the regulations of Chapter 17.69, 2. Apparel and accessory stores, 3. Appliance store, including stoves, refrigerators, washers, dryers, and other electric or gas appliances, including repair, 4. Automobile accessory or part stores, including stereo, phone, tire, upholstery and tuneup specialty shops but excluding heavy or major mechanical work and all body or paint work, and where all work is conducted inside a building, 5. A~tor~bile dealership, new ar~ used, 6. Automobile rental agency, including limousine service, 7. Bowling center, billards, 8. Camera and photographic supply, 9. Card room, bingo parlor, 10. Carpet and upholstery cleaners, 11. Carwash, detailing, 12. Computers and computer software store, 13. Department store, 14. Floor covering store, 15. Funeral services, including a crematory provided it is incidental to the main use, 16. Furniture store, including rental, 17. Garage for public or commercial parking, 18. Gift, novelty and souvenir store, 19. Hardware store, including home building and garden supply, 20. Hobby, toy and game store, 21. Home furnishings, including kitchenware, glassware, lamps and lighting, and fireplace inserts, 22. Hospital, sanitarium, 23. Hotel, motel, including restaurants, bars and cocktail lour~es pro- vided they are incidental to the main use, 24. Luggage and leather goods, 25. Military surplus store, 26. Motion picture theater and auditoriums, excluding drive-in, 27. Motorcycle dealership, new and used, 28. Musical instrument store, 29. Nurseries, 30. Paint, glass and wallpaper store, 31. Pool and spa sales, provided there is no outside storage of material, 32. Radio, television and other consumer electronics store, including repair, 33. Record, tape, disk and other pre-recorded music and video store, 34. Restaurant and related eating places, including drive-through serv- ices and on-site alcohol sales when served together with and inci- dental to the serving of food, or in a cocktail lounge or bar which is an accessory use to the restaurant, including entertainment, -10- 35. Sewing, needlework and piece good store, 36. Skating rinks, 37. Sporting goods, including bicycles, camping equipment, firearms, skiing and golf, 38. Taxidermist, 39. Theater, cinema, excluding drive-in, 40. Trade, vocational or specialized school, 41. Used merchandise, including antiques, books, furniture, thrift shops, and pawnshops, 42. Variety store, 43. Video arcade. C. The accessory buildings or structures necessary to such use located on the same lot or parcel of land. D. Dwelling for use by caretaker or night security, or as accessory and incidental to the permitted use on the parcel. 17.24.030 Uses ~ermitted subject to planning director review and approval. The following uses may be permitted in the C-2 zone subject to review and approval by the planning director: A. Public utility structures. B. Water pump stations. 17.24.040 Uses permitted subject to conditional use permit. The following uses maybe permitted in a C-2 zone subject to approval of a conditional use permit in accordance with the procedures provided for in Chapter 17.64: and R-4 B. Any use listed in the Uses Permitted section in the R-i, R-2, R-3 zones. Any of the following uses: 1. Amusement park, including miniature golf, water parks, batting cages and miniature car tracks, 2. Automobile body and fender repair and painting; provided, that the same shall be conducted wholly within a building, provided further, that said uses shall not include the outside storage of junk or disabled vehicles or parts nor the outside storage of automotive supplies or accessories unless such storage is screened from public viewby a fence enclosure not less than six feet in height composed of masonry or chainlink with slats, 3. Auto, bile machine shops (machine work on automobile and/or light and medium size two-axle truck engines wholly within an enclosed building); in no event shall semi-truck engines be removed or installed on the premises, 4. Bars, cocktail lounges or other establishments selling alcoholic beverages for on-site consumption where said use is the primary business, including entertainment, 5. Boat and recreational vehicle dealership, new and used, -11- 6. Bus, train and other transit stations, provided that vehicles are not stored on-site and no repair work or servicing is conducted on- site, 7. Food and/or shelter service agency as defined in Section 17.04.285, 8. Golf driving range, 9. Kennel, 10. Mini-warehouses, for storage in an entirely closed structure by tenant, of commercial and personal goods, wares and merchandise, and secondary and incidental open storage for recreational vehicles, campers and boats, 11. Mobile home or travel trailer park, 12. Mobile home sales, new and used, 13. Pest control services, 14. Police, fire and other emergency service alarm center, 15. Post office and other courier or parcel delivery service, 16. Research and testing services, 17. Recycling collection center, limited only to the collection and assemblage of solid waste material, not including waste food products, for transport to other sites for processing, manufacture or treatment, 18. Swap meet, flea market and auction yards, 19. Tool, equipment and utility trailer rental establishments, 20. Truck stop, including truck repair as incidental to the main use. C. Uses as specified in Section 17.66.020. 17.24.050 Site plan review. All permitted and conditional uses pursuant to this chapter shall be subject to site plan review as provided in Chapter 17.53. In addition, the following requirements shall apply to all cc~mercial development subject to the site plan review: A. Landscaping shall be subject to the requirements of Section 17.53.061 of Chapter 17.53. B. Off-streetparking and loading shall be subject to the requirements of Chapter 17.58, and subsection B of Section 17.34.020 for parking areas located adjacent to property zoned for residential development. All buildings used exclusively for dwelling purposes shall comply with the provisions of the R-4 zone. 17.24.080 Side yards. Side yard requirements in a C-2 zone shall be as follows: A. Front yard. Side yards. Rear yard. Minimu~ lot area. Distance between buildings on same lot. 17.26.010 Generally. The regulations set out in this chapter shall apply in the C-C commercial center zone unless otherwise provided in this chapter. This zone is intended for those areas in the city that are planned for large- scale mixed use development centers consisting of commercial and high den- sity residential uses consistent with the "centers" concept as described in the general plan. Although the C-C zone is predominantly found in the city's downtown district where historically this type of development has been encouraged, it may also be utilized in conjunction with specific plans to create new "centers" as identified in the General Plan for the major geographic sections in the metropolitan area. 17.26.011 Specific plan approval required. No person shall undertake, conduct, use or construct, or cause to be undertaken, conducted, used or constructed any of the uses within this chapter without obtaining approval of a specific plan for development (pursuant to the regulations of Government Code Section 65450). Notwithstanding, the following is exempt from this section: -14- A. The downtown Bakersfield area as bounded by 24th Street on the north, California Avenue on the south, Union Avenue on the east and A Street on the west. B. Agricultural uses where no buildings or structures are permitted unless approved by the Planning Director. C. Continued operation of buildings, structures or uses that existed at the time of zoning reclassification subject to the requirements of Sections 17.08.060, 17.08.080 and 17.08.090 of Chapter 17.08. 17.26.020 Uses permitted. The following uses are permitted in a C-<2 zone: A. Any use listed in the Uses Permitted section in the R-3, R-4, C-O, C-1 and C-2 zones, except those uses permitted in the R-1 and R-2 zones as referenced. B. Any one or more of the following uses: 1. Apartment hotel, roominghouse, 2. Bus, train and other transit stations, provided that vehicles are not stored on-site and no repair work or servicing is conducted on- site, 3. Parking garage, 4. Police, fire, and other emergency service alarm centers, 5. Post office and other courier or parcel delivery service, 6. Street vendors. C. Mixed combinations of uses allowed in subsections A and B above are permitted. D. The accessory buildings or structures necessary to such use located on the same lot or parcel of land. 17.26.030 Uses permitted subject to planning director review and approval. The following uses may be permitted in the C-C zone subject to review and approval by the planning director: A. Public utility structures. B. Water pump stations. 17.26.040 Uses permitted subject to conditional use permit. The following uses maybe permitted in the C-C zone subject to approval of a conditional use permit in accordance with the procedures provided for in Chapter 17.64: A. Any of the following uses: 1. Bars, cocktail lounges or other establishments selling alcoholic beverages for on-site consumption where said use is the primary business, including entertainment, 2. Farmers market, -15- 3. Food and/or shelter service agency as defined in Section 17.04.285, 4. Kennel, entirely contained within the enclosed building, 5. Research and testing services, 6. Swap meet, flea market and auction houses. B. Uses as specified in Section 17.66.020. 17.26.050 Site plan review. All permitted and conditional uses pursuant to this chapter shall be subject to site plan review as provided in Chapter 17.53. In addition, the following requirements shall apply to all commercial development subject to the site plan review: A. Landscaping shall be subject to the requirements of Section 17.53.061 of Chapter 17.53. B. Off-street parking and loading shall be subject to the requirements of Chapter 17.58, and subsection B of Section 17.34.020 for parking areas located adjacent to property zoned for residential development. C. Signs shall be subject to the requirements of Chapter 17.60. D. Commercial development proposed adjacent to property zoned or des- ignated for residential development may be required to be separated by a solid masonry wall constructed a minimum height of six (6) feet. Any wall that may be located within the front yard area shall not exceed a height of four (4) feet. Along street frontages, landscaping maybe required in-lieu of or in combination with a solid wall to screen the cc~m~ercial development from residential uses. E. Open storage of material and equipment permitted in this zone shall be surrounded and screened by a solid wall or fence, including solid gates where necessary not less than six (6) feet in height. Materials shall not be stacked above the height of the screening. 17.26.060 Building height. Building height requirements in a C-C zone shall not exceed one hundred and eighty (180) feet (approximately twelve (12) stories). 17.26.070 Front yard. There shall be a front yard in a C-C zone not less than ten (10) feet. 17.26.080 Side yards. Side yard requirements in a C-C zone shall be as follows: A. Where a lot abuts upon the side of a lot in any R zone, ~q zone or PUDproject of a residential nature, there shall be a side yard of not less than twenty (20) feet. B. On a corner lot, the side yard on the street side of the lot shall be not less than ten (10) feet. C. In all other cases, a side lard shall not required. -16- 17.26.090 Rear yard. Rear yard requirements in a C-C zone shall be as follows: A. There shall be behind every building a rear yard having a minimum depth of twenty (20) feet. B. Where there is an alley at the rear of the lot, such rear yard may be measured to the center oi the alley. S~CTION 6.
