RESOLUTION OF INTENTION NO. 1192 PRELIMINARILY
ADOPTING, CONFIRMING AND APPROVING PUBLIC WORKS
DIRECTOR'S REPORT FOR THE TRAFFIC SIGNAL
MAINTENANCE DISTRICTS AND THE 1999-2000 BUDGETS;
SETTING TIME AND PLACE FOR HEARING PROTESTS ON THE
AMOUNT OF ASSESSMENTS TO BE LEVIED THROUGHOUT
EACH OF THE TRAFFIC SIGNAL MAINTENANCE DISTRICTS.
(WARD 4)
WHEREAS, Chapter 13.04 of Title 13 of the Municipal Code of the City of
Bakersfield provides for an alternative procedure by which the City Council may provide for the
payment of the whole or any part of the costs and expenses of maintaining and operating any
public improvements which are local in nature, from annual benefit assessments apportioned
among the several lots or parcels of property within the maintenance district established
therefore; and
WHEREAS, the Council approved Resolution 161-94 on September 28, 1994,
which provides for the collection of maintenance and operating costs for "convenience" traffic
signals; and
WHEREAS, the Public Works Director has on this date filed with the Clerk of said
Council his Report, attached hereto and incorporated herein by reference as Exhibit "[",
containing the following:
(a)
descriptions of the property in each of the Traffic Signal Maintenance
Districts, attached hereto as Exhibits "A";
(b)
the improvements to be maintained by each district specifically are traffic
signals which benefit the areas within the boundaries as shown on Map
and Assessment Diagram for each of the Traffic Signal Maintenance
Districts, attached hereto as Exhibits "B";
(c) the benefit formulas for each district attached hereto as Exhibits "C";
(d)
budgets for each district, containing the matters specified in Section
13.04.130 of the Bakersfield Municipal Code, attached hereto as Exhibits
"D"; and
(e)
the amount of assessments to be levied against each parcel in each
district, attached hereto as Exhibits "E".
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Bakersfield, State of California, as follows:
1. The foregoing recitals are true and correct and are incorporated herein.
2. The City Council hereby reserves the right to perform the work of
maintenance and operation of the public improvements within each of the Traffic Signal
Maintenance Districts by City forces or by private contractor. Such determination and election
is to be made for each year at the time the budget and assessment is approved for the year in
question.
3. The City Council hereby preliminarily adopts and approves the Public
Works Director's Report and declares that the territory within the boundaries so specified and
described are the Traffic Signal Maintenance Districts which benefit from said local
improvements; that the expense of maintaining and operating said improvements is hereby
made assessable upon each district; and that the exterior boundaries of said Traffic Signal
Maintenance Districts are hereby specified and described to be as shown on those certain maps
now on file in the Office of the City Clerk of the City of Bakersfield and in the Office of the Public
Works Director, marked Exhibits "B," attached hereto and incorporated in this resolution as
though fully set forth herein, entitled "Map and Assessment Diagram for Traffic Signal
Maintenance District, Bakersfield, California" which maps indicate by a boundary line the extent
of the territory included in each district and shall govern for all details as to the extent of the
maintenance districts.
4. The City Council hereby sets WEDNESDAY, June 16, 1999, AT 7:00 P.M.,
or as soon thereafter as may be heard, at the Council Chambers of the City Council, 1501
Truxtun Avenue, Bakersfield, California, as the time and place for hearing protests on the
following matters:
FAIRNESS OF THE BENEFIT FORMULA;
THE AMOUNT OF THE ASSESSMENT ON ANY PARCEL OF PROPERTY TO BE
ASSESSED;
RESERVATION BY CITY OF RIGHT TO ELECT WHETHER TO PROCEED TO
PERFORM WORK BY CITY FORCES OR BY PRIVATE CONTRACTOR.
Any interested person may object to any of the above-listed matters by filing a
written protest with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California, at or before
said time set for the protest hearing; and said City Clerk shall endorse on each protest the date
and hour of its receipt, and at said time appointed for said hearing shall present to the Council
all such protests filed with said Clerk.
5. The City Clerk is hereby further directed to cause notice of said protest
hearing to be published, and mailed in the manner prescribed by Sections 13.04.150 through
13.04.170 of the Bakersfield Municipal Code, said notice to be completed not less than ten (10)
days prior to such hearing. The form of notice shall be substantially as follows:

NOTICE IS HEREBY GIVEN that the Public Works Director of the City of Bakersfield has prepared and filed with
the City Clerk a Report which provides the basis for the benefit assessment for maintaining and operating traffic
signal improvements to be bome by all parcels of property within each of the Traffic Signal Maintenance Districts
which includes your property. Said Report sets forth the amounts in the budget for maintenance and operation
of the above public improvements, a description of each parcel of property in each of the Traffic Signal
Maintenance Districts and the amount of assessment levied for fiscal year 1999-2000 against each parcel. Said
Report is open to public inspection.
The estimated revenue to be raised for this fiscal year for the Traffic Signal Maintenance District is:

On Wednesday, June 16, 1999, at 7:00 P.M., or as soon thereafter as the matter may be heard in the Council
Chambers at 1501 Truxtun Avenue, Bakersfield, California, the City Council will consider the above referenced
report and hold a protest hearing. At this hearing, protests will be heard regarding, the fairness of the benefit
formula, the reservation of right by the City to utilize either City forces or to contract with private industry for the
maintenance of the improvements, or the amount of the assessment on any parcel of property to be assessed.
Any interested owner objecting to any of these items may file a wdtten protest, signed by him/her, describing the
parcel of property so that it may be identified and stating the grounds of his/her protest. Any written protest shall
be filed with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California, 93301 at or before the protest
hearing. Individual property owners may also appear and be heard at the hearing.
Any person challenging in court the decision made at the conclusion of such public hearing may be limited to
raising only those issues raised at such hearing or in correspondence delivered to the City of Bakersfield prior
to close of such hearing.

BENEFIT FORMULA
Each parcel shall be assessed a percentage of the total operating and maintenance costs
proportional to the trips generated by that parcel using the signalized intersection, adjusted
for prior year fund balance or deficit.
The Marketplace shopping center is divided into 5 zones (see next page). The percentage
of trips of each zone using the signalized intersection is shown below:
Zone 1 20%
Zone 2 50%
Zone 3 25%
Zone 4 60%
Zone 5 45%

The amount to be assessed to each parcel is calculated as follows:
(1) Calculate the total number of trips generated by each building using the City
Average Daily Trips (ADT) rates.
(2)
Multiply the number of trips of each building by the percentage of the zone shown
above.
(3) Add the total number of trips (2) of all buildings in each parcel.
(4) Add the total number of trips (2) of all buildings in all zones.
(5)
Divide the total number of trips of each parcel (3) by the total number of trips in all
zones (4). This is the proportionate share of the total assessment for each parcel.
(6)
Multiply the result of (5) times the total cost of the district for each parcel. This is
the amount to be assessed to each parcel.

Each parcel shall be assessed a percentage of the total operating and maintenance cost

the amount to be assessed to each parcel.
Assessment amounts could vary substantially during the initial development of the
shopping center. Since only the developed parcels will generate traffic using the
signalized intersection, those parcels will be responsible for the entire cost. None of the
parcels were assessed in 1998-99 since the signals were not in operation at the beginning
of the fiscal year. The signals were energized in August 1998. The costs incurred in the
1998-99 fiscal year were carried over and added to the 1999-2000 costs.

BENEFIT FORMULA
Each parcel shall be assessed a percentage of the total operating and maintenance cost*
proportional to the trips generated by that parcel, adjusted for prior year fund balance or
deficit.
The amount to be assessed to each parcel is calculated as follows:
Calculate the total number of trips generated by each building using the City
Average Daily Trips (ADT) rates.
(2) Add the total number of trips (1) of all buildings in each parcel.
(3) Add the total number of trips (2) of all buildings in all parcels.
(4)
Divide the total number of trips of each parcel (2) by the total number of trips in all
parcels (3). This is the proportionate share of the total assessment for each
parcel.
(5)
Multiply the result of (4) times the total cost of the district for each parcel. This is
the amount to be assessed to each parcel.
* Since Rosedale Highway is a state highway, the state pays 2/3rds of the cost of the
signal on Rosedale and the district pays l/3rd. The district pays all of the cost of the
signal on Coffee Road.
Assessment amounts could vary substantially during the initial development of the
shopping center. Since only the developed parcels will generate traffic using the
signalized intersections, those parcels will be responsible for the entire cost.
At the beginning of the 1998-99 fiscal year none of the parcels were developed and the
costs were spread on a per acre basis. This year only two of the parcels are developed
and, therefore, only those parcels will be assessed.
The signals on Rosedale Highway were put into service in November 1997. The costs
incurred during the 1997-98 fiscal year were added to the 1998-99 costs. The signals on
Coffee Road are not yet in service. Any costs incurred during the 1999-2000 fiscal year
for the signals on Coffee Road will be added to the 2000-2001 assessments.

Fifty percent (50%) of the total operating and maintenance cost of the district, adjusted for
prior year balance or deficit, shall be assessed to the parcels east of Calloway Drive
(Parcel Map 10406, Parcels 1-4) and fifty percent (50%) shall be assessed to the parcel
west of Calloway Drive (Parcel Map 10263, Parcel 1 ).
Parcels east of Calloway Drive, (Parcel Map 10406) shall be assessed as follows:
