AN ORDIINANCE AMENDING SUBSECTIONS
A, B AND C OF SECTION 17.52.080 OF
TITLE 17 OF THE BAKERSFIELD MUNICI-
PAL CO~E RELATING TO THE PUD
(PLANNED UNIT DEVELOPMENT) ZONE.
BE IT ORDAINED by the Council of the City of Bakers-
field as follows:
SECTION 1.
Subsections A, B and C of Section 17.52.080 of the
Bakersfield Municipal Code are hereby amended to read as follows:
17.52.080 Termination of zone.
A. Within eighteen months of the effective date of the es-
tablishment of both the PUD zone and the preliminary development
plan, a final development plan shall be submitted to the planning
commission. If a final development plan is not submitted within
the specified time period, the planning director shall notify the
planning commission of same and the commission shall initiate a
zone change pursuant to Sections 17.64.110 through 17.64.140 of
this code.
B. In the event that the applicant submits a final develop-
ment plan within the eighteen months specified in subsection A of
this section and such plan is approved by the planning commis-
sion, the applicant shall commence construction no later than two
and one-half years from the effective date of the zoning change.
If, within such period, the construction specified in said final
development plan has not been commenced, the planning director
shall notify the planning commission of same and the commission
shall initiate a zone change pursuant to Sections 17.64.110
through 17.64.140 of this code.
C. If a certificate of occupancy has not been issued for
100 percent of the dwelling units in the first stage of a PUD
zone within five years of the effective date of the PUD zone, the
Planning Director shall schedule a public hearing before the
Planning Commission to determine if the PUD zone and project are
still practicable for the first stage and the remainder of the
stages constituting the PUD site. Upon determination that the
PUD zone and project are no longer practicable, the planning
commission shall initiate a zone change pursuant to Sections
17.64.110 through 17.64.140 of this Code.
Where the first stage is 100 percent developed and the re-
maining stages are undeveloped or in various stages of develop-
ment and five years have lapsed since the effective date of the
PUD zone, the planning director shall schedule a public hearing
before the planning commission to determine if the PUD zone and
project are still practicable for the remaining stages of the PUD
site.
SECTION 4.
This Ordinance shall be posted in accordance with the
Bakersfield Municipal Code and shall become effective thirty (30)
days from and after the date of its passage.
