RESOLUTION DISPENSING WITH BIDDING UNDER
SECTION 3.20.060(D)(5) OF THE BAKERSFIELD
MUNICIPAL CODE RELATING TO DESIGN/BUILD
CONSTRUCTION PROCUREMENT PROCESS FOR
THE MODIFICATION AND UPGRADE TO THE
ELECTRICAL INFRASTRUCTURE FOR THE
BAKERSFIELD CONVENTION CENTER
WHEREAS, the Convention Center has no trade show power infrastructure
that provides safe, industry standard access to electricity for vendors during
scheduled events; and
WHEREAS, the Convention Center Exhibit Hall needs an outside firm to
design/build the necessary electrical modifications and upgrades to the existing
designated hall so that vendors and staff can access electricity for booths,
equipment, lights, events, etc.; and
WHEREAS, the use of design/build methodologies has been shown to be
an effective method of reducing construction costs; and
WHEREAS, the use of design/build joins the construction and design of a
project under one single legal entity thereby reducing conflicts; and
WHEREAS, the City Council believes the use of design/build is appropriate
for certain unique projects where specialized design or construction methods
are necessary or special design expertise must be employed; and
WHEREAS, the City Council believes the public and the procurement
process can be adequately protected through the use of a fair competitive
process for choosing a design/build entity which best serves the interests of the
City.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The Convention Center Trade Show Power Project is appropriate for
design/build because of the specialized nature of the design and
construction of the project.
3. The Convention Center Trade Show Power justifies exception to the
bidding process and the City Council hereby determines that the

work, supplies equipment and material can best be obtained
through the design/build construction procurement process.
4. Upon adoption of this Resolution, the Public Works Director is
authorized to proceed with the design/build procurement process,
as set forth in the Bakersfield Municipal Code Section 3.20.060(D) (5),
for the Convention Center Trade Show Power Project.
5. The Public Works Director shall recommend a design/build entity
that combines appropriately licensed contracting, architectural
and engineering services, as needed, into one legal entity.
6. The Public Works Director shall invite no less than three appropriate
design/build entities to participate in the selection process.
7. The Public Works Director shall, in a timely manner, bring the
contract for award of the project to the, City Council for approval
with a report setting forth the reasons the award is recommended
to the chosen design/build entity.
HEREBY CERTIFY that -the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
APR 2 & 2023 , by the following vote:
