D3 ®� BAKERSFIELD THE SOUND OFsar✓0jil t3cucr MEMORANDUM April 27, 2023 TO: PLANNING AND DEVELOPMENT COMMITTEE Manpreet Kaur, Chair Bruce Freeman Bob Smith FROM: Christopher Boyle, Development Services Director Phil Burns, Building Director SUBJECT: Update of Chronic Nuisance Property Progress and Vacant Building Registry Information provided within this memorandum builds upon the update previously provided at the September 28, 2022, Planning and Development Committee meeting. At the previous meeting, the topic of the City of Fresno's vacant building ordinance related to commercial buildings was discussed as staff had completed a visit site to the City of Fresno at which time staff meet with Fresno Code Enforcement Staff to review best practices the city had deployed. Below are some of the goals of chronic nuisance property program: • Improve and address ongoing health and safety risks • Assist in reduction of the impacts on ongoing future city resources • Eliminate blight so that properties can start to be utilized for its highest and best purpose Chronic Nuisance Property Progress Our City Staff after that committee meeting in September 2022, implemented the recommendation and completed the proposed updates to the Municipal Code which have now been put in place. The Chronic Nuisance Property (CNP) committee continues to evaluate and review properties. The committee meets regularly to discuss appropriate action on the top "high touch" properties. Recently the committee members and a select group made efforts to purchase several of these top CNP properties and received authorization to make bids at the Kern County tax default property sale. While we were not successful in purchasing the properties, many of the properties targeted have new owners and the CNP team is engaging with new responsible owners. A detailed presentation on the progress and status of property acquisition program and the overlap of CNP was provided to the Budget, Finance and Economic Development Committee at its April 24, 2023 meeting. Below are highlights of the progress of CNP team over the last 6 months • Demolitions completed — 21 • Demolitions in progress with expectation to complete in the next three to six months - 22 • Acquisition properties targeted — 24 • Change of owner with new responsible owners after the tax sale —13 A detailed summary of all current actions is found in the tables and reports below. Vacant Building Registry Part of our proposed Code Enforcement Fiscal Year 2023-24 budget includes a request for an additional Code Enforcement Officer and Assistant Code Enforcement Officer for the purpose of implementing a commercial vacant building registry within the downtown and old town areas. The boundaries and scope of the program are still being discussed with the need for additional staff for full implementation. One of the lessons learned when City Staff met with Fresno was they initiated the registry, however the registry did not meet the objectives the Fresno Staff had hoped. Learning from others experience we can have a more targeted focus while still modelling some of Fresno's ordinance which is a high touch point process. With the requested staffing level, the city can have a targeted area and type of building that we can monitor. Staff will still have a major focus on eliminating the chronic vacant nuisance buildings to truly help our distressed neighborhoods. Special Project Team Update The following is an update on the Special Projects Team's activities through March 1, 2023. 171 follow-up inspections were completed on structures posted substandard and unfit for occupancy resulting in 30 cases being initiated and processed for various violations of the Bakersfield Municipal Code. One receivership case was initiated and is in process. The chronic nuisance property team group is currently working on the top high touch properties listed below as well as other properties to consider for acquisitions. Per previous discussions this team will apply the appropriate action of one of the following: Demolition, Acquisition/Tax sale/Rehab, Receivership or Foreclosure. The ultimate goal on each of the properties in question is to effectuate change by addressing blight within the impacted neighborhoods, address health and safety risks, leveraging city resources to return the property be utilized for its highest and best purpose. . The committee will continue to meet to assess appropriate action for the properties. NEXT STEPS Staff will take the direction of the Committee. Potential options include: 1. Direct staff to move forward with a proposed Vacant Building Registry Ordinance for Commercial Buildings, as laid out in the City of Fresno. 2. Provide Alternate direction to Staff.
