ROLL CALL Present: Mayor Goh, Vice Mayor Gonzales (seated at 3:32 pm) Councilmembers Arias (seated at 3:36 pm), Weir, Smith, Freeman, Gray and Kaur 2. PUBLIC STATEMENTS a. Agenda Item Public Statements None. b. Non -Agenda Item Public Statements None. 3. REPORTS a. A status report on the 6th Cycle Housing Element as well as the release of the public draft. (Staff recommends that Council receive and file report.) Development Services Director Boyle made staff comments and provided a PowerPoint Presentation. Motion by Vice Mayor Gonzales to receive and file. Motion unanimously approved. 4. CLOSED SESSION a. Conference with Legal Counsel — Potential Litigation; Closed Session pursuant to Government Code Section 54956.9(d) (2) (e) (1) (One matter) Motion by Vice -Mayor Gonzales to adjourn to Closed Session at 4:46 p.m. Motion approved. PUBLIC STATEMENTS a. Agenda Item Public Statements None b. Non -Agenda Item Public Statements 1. Mary Helen Barro spoke regarding squatters in her neighborhood on Jefferson Street. Mayor Goh requested staff follow up with Mrs. Mary Helen Barrow regarding her concerns about 211 Jefferson St. 2. Sandra Plascencia, Amanda Johnson (written material provided), Lorna Eades (written material provided), Shar Thompson (written material provided), Wendell Wesley Jr. (written material provided), Connor Malone, Teresa Flores, Teresa Reyes, Emprezz Nontzikelelo, Michael King and Hector Hernandez, spoke regarding tenant rights and evictions. Mayor Goh requested staff follow up with the public speakers who provided comments regarding eviction protection services. In addition, she requested staff refer coordinate with the County to assist where appropriate. Vice Mayor Gonzales requested staff pursue a Renter Eviction Protection Service Program within the FY23-24 Budget and ensure an adequate allocation amount. APPOINTMENTS a. Two appointments to the Planning Commission due to the term expiration of Commissioner Candace Neal (Ward 1) and Commissioner Patrick Wade (Ward 7) whose terms expire April 30, 2023. APPOINTMENTS continued City Clerk Drimakis announced applications were received by Jordan Webster, Gutarpreet Kaur and Candace Neal. Councilmember Arias nominated Candace Neal as the Commissioner representing Ward 1. Councilmember Kaur nominated Gutarpreet Kaur as the Commissioner representing Ward 7. Motion by Vice Mayor Gonzales to appoint Candace Neal, Ward I and Gutarpreet Kaur, Ward 7, to the Planning Commission, terms expiring April 30, 2027. Motion unanimously approved. 7. CONSENT CALENDAR (Staff recommends adoption of Consent Calendar items.) Minutes: a. Approval of minutes of the April 12, 2023, Regular City Council Meetings. Payments: b. Receive and file department payments from March 31, 2023, to April 13, 2023, in the amount of $12,382,612.27 and Self Insurance payments from March 31, 2023, to April 13, 2023, in the amount of $434,814.37, totaling $12,817,426.64. Ordinances: None. Resolutions: C. Resolution confirming approval by the City Manager designee of the Code Enforcement Manager's report regarding assessments of certain properties in the City for which structures have been secured against entry or for the abatement of certain weeds, debris and waste matter and authorizing collection of the assessments by the Kern County Tax Collector. RES O48-2023 d. Resolution authorizing the filing of an application with the Kern Council of Governments for an allocation of Transportation Development Act Article 4 funds for Fiscal Year 2023-24 ($681,871) for the annual maintenance of the Amtrak Station. Resolution dispensing with bidding under Section 3.20.060 of the Bakersfield Municipal Code authorizing the Design/build approach for the Trade Show Power Project at the Bakersfield Convention Center. Labor Updates, and New Job Specifications and Changes to Salary Schedule: Resolution approving the Memorandum of Understanding for employees of the Blue and White Collar Units and adopting salary schedule and related benefits. AGR 2023-094 Amendment No. 1 to Agreement No. 2022-061 with Gridless Power Corporation ($6,969.93; revised not to exceed $97,573.87) for the purchase of two remote trailer solar -powered camera units. AGR 2022-061 (1) k. Amendment No. 3 to Agreement No. 2020-155 with DXP Enterprises, Inc. ($95,000; not to exceed $345,000), to provide pump maintenance and repair services for transfer pumps at Wastewater Treatment Plant No. 2. AGR 2021-127 (1) City Clerk Drimakis announced a staff memorandum was received for item 7.x., transmitting a bid protest. Motion by Vice Mayor Gonzales to adopt Consent Calendar items 7.a. through 7.ac. Motion was unanimously approved. 8. CONSENT CALENDAR PUBLIC HEARINGS (Staff recommends conducting Consent Calendar Public Hearing and approval of items.) a. Public Hearing to consider Fiscal Year (FY) 2023-24 Action Plan for the Community Development Block Grant (CDBG - $3,878,710), HOME Investment Partnerships (HOME - $1,801,273), Housing Opportunities for Persons with HIV/AIDS (HOPWA - $1,080,283), and Emergency Solutions Grant (ESG - $334,506) (Total-$7,094,772). b. (Staff recommends the City Council receive and file the report.) City Manager Clegg and Finance Director McKeegan made staff comments and provided a PowerPoint presentation. Vice Mayor Gonzales left the Dais at 7:23 p.m. and returned at 7:30 p.m. Motion by Vice Mayor Gonzales to receive and file. Motion unanimously approved. 12. NEW BUSINESS a. Resolution to accept the Affordable Housing Financing and Incentive Plan per the SB2 Planning Grant Program requirements. (Staff recommends that Council adopt the Resolution accepting the Affordable Housing Financing and Incentive Plan in accordance with the SB 2 grant application scope of work and direct staff to implement the deliverables.) RES 054-2023 City Manager Clegg made staff comments and Assistant Economic Development Director Byers provided a PowerPoint presentation. Motion by Vice Mayor Gonzales to approve staff recommendations. Motion unanimously approved. 13. COUNCIL AND MAYOR STATEMENTS Vice Mayor Gonzales requested accelerate the launch of the Business Security Funding Program and to include an element to include costs enhancing and securing windows and store fronts. Vice Mayor Gonzales requested staff identify potential community partners and explore the development of a Risk Pool for property owners who experience window smashing. Vice Mayor Gonzales requested staff develop a strategy to install camera units on every intersection throughout Downtown and Old Town Kern. Vice Mayor Gonzales requested staff include a report on the strategies being utilized to address property crime and retail crimes. The report to include strategies to prevent future crimes. Councilmember Freeman made comments suggesting metal window coverings paid for by the city for retailer's storefronts. Councilmember Arias requested other businesses outside the downtown area be included with Vice Mayor Gonzales request. Mayor Goh expressed her appreciation to staff and all volunteers for the success of the Great American Cleanup. Bakersfield, California, April 26, 2023 - Page 9 439' 14.
