HomeMy WebLinkAboutRES NO 073-2023RESOLUTION NO.0 7 3- 2 U 2 3 RESOLUTION ADOPTING INCREASES TO FISCAL YEAR 2023/2024 REFUSE AND RECYCLING RATES WHEREAS, Chapter 8.32 of the Bakersfield Municipal Code authorizes the City Council of the City of Bakersfield (City) to establish and increase fees and charges to recover costs for refuse and recycling services rendered; and WHEREAS, City contracted the services of HF&H consultants to prepare a cost -of -services analysis to ensure the Refuse Enterprise can equitably sustain solid waste operations; and WHEREAS, on February 28, 2022 consultant presented its findings to the Budget and Finance Committee. Consultants recommended a rate increase for the next five years to fund the operating expenses needed to maintain current service levels; and WHEREAS, on March 16, 2022, the presentation and proposed Proposition 218 ratepayer notice was presented to City Council; and WHEREAS, City staff prepared and mailed a notice of public hearing to residential and commercial users as required by Proposition 218 notifying them of the proposed rate increases (Cal. Constitution Article XIIID, section 6); and WHEREAS, on June 1, 2022, the City Council adopted increases to refuse and recycling rates for FY22/23-26/27 based on increases in the Consumer Price Index (CPI) in accordance with Proposition 218; and WHEREAS, a public hearing before the City Council was advertised twice in the Bakersfield Californian, a newspaper of general circulation; and WHEREAS, a public hearing was held in order to receive evidence and hear all persons interested in or objecting to the proposed rate increases; and WHEREAS, the adoption of solid waste increases is exempt from the California Environmental Quality Act (CEQA) under the California Public Resources Code Section 21080(b)(8); and WHEREAS, the City Council has considered the staff report, public and written comments, and information presented at the public hearing; and WHEREAS, Exhibit "A" summarizes both residential and commercial rates proposed for Fiscal Year 2023/2024, including flat rate fees collected on property tax bill. The above recitals and findings are true and correct and are incorporated herein by reference. 2. The Council ratifies the Proposition 218 process followed by the City. 3. The Council adopts the fees and changes established in Exhibit "A". 4. This Resolution is effective July 1, 2023.
