RESOLUTION REPEALING RESOLUTION NO. 152-01 AND
ALL AMENDMENTS THERETO (COUNCIL POLICY 4.20).
WHEREAS, the Council of the City of Bakersfield adopted Resolution No. 58-
96 thereby adopting a City Council Policy and Procedural Manual ("Manual"
herein); and
WHEREAS, Manual serves as a guideline to govern the actions, conduct and
business of the City of Bakersfield and its City Council; and

WHEREAS, certain policies and procedures of Manual have become
antiquated and require either clarification, updating, or repeal; and
WHEREAS, City Council directed City Attorney to update Chapter Four of
Manual; and

WHEREAS, upon conducting a follow-up review of Chapter Four, it was
discovered that Resolution No. 152-01 (6) makes reference to Resolution No. 152-
01 and all of its amendments, including Resolution No. 152-01 (5), which was

inadvertently repealed; and
I
WHEREAS, Resolution No. 152-01 and all amendments thereto need to be
repealed in their entirety, in order to avoid any further confusion and replaced
with a new Resolution.
WHEREAS, Council Policy No. 4.20 is hereby reserved.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1 . The above recitals are true and correct and incorporated herein by
reference.
2. Resolution No. 152-01 and all amendments thereto re: FINANCIAL j
ASSISTANCE REQUESTS FROM NON-PROFIT GROUPS are hereby repealed in its
entirety as it will be replaced by another updated Resolution.
3. Chapter 4.20 is now reserved. -
4. This Resolution shall become effective and in full force upon final

passage.

RESOLUTION NO. 421 2023.
A RESOLUTION ESTABLISHING COUNCIL POLICY FOR
EVALUATING REQUESTS FOR FINANCIAL ASSISTANCE FROM
NONPROFIT GROUPS. (COUNCIL POLICY 4.20) j
WHEREAS, the City Council from time to time receives requests for financial j
assistance from nonprofit groups; and
i
WHEREAS, the City Council must evaluate these requests for financial
assistance to determine the ability of the City to consider such requests in k
accordance with Council goals and given limited City resources; and
WHEREAS, the City Council requested that the Budget, Finance and
Economic Development Committee of the Council review a policy for evaluating I
requests for financial assistance from nonprofit groups; and
WHEREAS, a resolution of the City Council is necessary to adopt Council
policy for financial assistance from nonprofit groups; and

WHEREAS, financial assistance is limited to five groups for ongoing
operations and maintenance purposes; and
WHEREAS, the five groups eligible to receive financial assistance for
ongoing operations and maintenance purposes from the City include the
Bakersfield Senior Center, Bakersfield Museum of Art, the Bakersfield Symphony
Orchestra, Bakersfield Music Theater and Bakersfield-Kern Regional Homeless
Collaborative, Inc. (BKRHC); and
WHEREAS, in light of recent funding requests from other nonprofit groups, on j
March 11, 2020, the City Council directed staff to strengthen the criteria related
to financial accountability and reporting from nonprofit groups seeking
contributions from the City.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:

1 . The above recitals are true and correct and incorporated herein by
reference.
2. Council may consider requests for financial assistance from Non-
Profit groups if the request for financial assistance meets at least one of the
following criteria:

2.1 . It is for one-time expenditures rather than ongoing costs;
2.2. It is for capital expenditures rather than operating costs;
2.3. It is for one-time activities which are tied to specific high priority
City Council goals;

2.4. It is for use of City facilities by the Non-Profit group.

3. Any requests for financial assistance from Non-Profit groups not j
meeting the criteria set forth in this paragraph will not be considered for funding.
4. Non-Profit groups requesting financial assistance shall provide the
i
following information:
4.1 . Any request shall be made in writing and shall be addressed to
the full City Council.
4.2. All requests shall include current financial information including
the Annual Operating Budget for the requested funding year,
current Balance Sheets, Profit and Loss Statements and other
pertinent financial information to support their funding request.
� I4.3. All requests shall include a copy of the applicable Business Plan
and/or Operating Plan.
4.4. All requests shall include evidence of matching funds from the
Non-Profit group so the City does not bear the entire cost of
the proposed project or activity.
4.5. If the request is granted, the Non-Profit group shall provide all
information as stipulated in the subsequent Agreement
between the City and the Non-Profit; including but not limited
to:
4.5.1 . An Initial Report within 90 days of Council approval of
Agreement, which includes an accounting of
expenditures of first quarter use of funds.
4.5.2. A Final Report within 30 days of the end of the requested
funding year, which includes an Accounting Report of
all expenditures.
5. The Council will not consider assistance to Non-Profit groups for
ongoing operation and maintenance purposes with the exception of the j

following groups with which the City has had an ongoing relationship, The
Bakersfield Senior Center, The Bakersfield Museum of Art, The Bakersfield
Symphony, The Bakersfield Music Theater and The Bakersfield Kern Regional
Homeless Collaborative. The sources and amounts of funds to be contributed
annually to these five groups is to be recommended by the City Manager as part i
of the City's annual budget, subject to City Council review and approval.

6. The Council authorizes the City Manager to notify groups who make
requests for financial assistance which do not conform to this policy, that their j
request is outside Council policy.
7. This resolution shall take effect immediately upon its passage.
