3. REPORTS
a. Community Choice Aggregation (CCA) presentation and recommended
action.
(Staff recommends that Council receive and file presentation and consider undertaking a
feasibility study to examine its effectiveness.)
City Clerk Drimakis announced that a staff memorandum was received
correcting the recommendation to authorize staff to initiate a feasibility study
and to dispense with standard bidding procedures and solicit proposals.
Assistant City Manager Hollen provided staff comments and a PowerPoint
presentation was given by Woody Hastings, Phase Out Polluting Fuels Program
Manager and Rob England, Central Valley Regional Organizer.
CM Freeman asked staff to look at the three biggest cities that have done this
and ask what the other benefits are (other than or in addition to cost savings).
Motion by Councilmember Smith approve the feasibility study. Motion approved with
Councilmember Freeman voting no.
b. Public Safety Update - Police Department Calls for Service Priorities and
Response Times.
(Staff recommends the City Council receive and rile the update and report.)
Chief Terry made staff comments and provided a PowerPoint presentation.
Motion by Vice Mayor Gonzales to receive and rile. Motion unanimously approved.
4. ADJOURNMENT
Mayor Goh adjourned the 3:30 p.m. meeting at 5:11 p.m.

Councilmember Weir requested staff reach out to Mrs. Nadine Escalante to
discuss her concerns about a smoke shop located near Highland High School.
2. Michael Turnipseed spoke regarding Community Aggregation.
3. Paul Linfesty thanked staff for the housing plan that included the history of
Bakersfield's past segregation zoning.
4. Stacey Shepard spoke regarding flooding concerns and the lack of
communication by the City regarding this issue.
Mayor Goh requested staff reach out to Ms. Shepard regarding her concerns.
Vice Mayor Gonzales requested staff coordinate with Kern County Emergency
Response Services to effectively communicate clearly with the community
regarding the potential Flooding due to the water levels in the Kern River.

a. Approval of minutes of the April 26, 2023, Regular City Council Meetings.
Payments:
b. Receive and file department payments from March 31, 2023, to April 14, 2023,
to April 27, 2023, in the amount of $17,153,990.65 and Self Insurance payments
from April 14, 2023, to April 27, 2023, in the amount of $522,173.03, totaling
$17, 676,163.68.

C. Resolution approving the Fiscal Year 2023-24 Capital Project List to be funded
by Senate Bill 1, the Road Repair and Accountability Act of 2017.

Streets:
Resolution determining that CNG-powered dump trucks can most
efficiently be obtained through cooperative procurement bidding

Director to dispense with bidding thereof, not to exceed $566,000.

balance to the Public Works Department's Operating Budget to
complete the purchase of two units.
e. Dispense with bidding for the purchase of Polaris Off Highway Terrain Vehicle
for the Police Department:
1. Resolution determining that a Polaris off highway terrain vehicle, can
most efficiently be obtained through cooperative procurement bidding
procedures from Polaris Sales, Inc., and authorizing the Finance Director
to dispense with bidding thereof, not to exceed $42, 100.

Public Works Department's Operating Budget to fund the purchase

strong safety plan for businesses located in Old Town Kern.
Motion by Vice Mayor Gonzales to adopt Consent Calendar items 7.a. through 7.u.
Motion was approved with Councilmember Smith absent.

The applicant is Cornerstone Engineering, Inc., representing property owner
Timothy and Marilyn Banducci Family Trust.
Resolution adopting a Mitigated Negative Declaration per the

exceed $45,000,000 of the Authority's Revenue Notes (Notes) for the
benefit of Renaissance at Baker LP, a California limited partnership
(Borrower).
2. Adopt Resolution approving the issuance of the Notes by CEDA for the
purpose of financing the construction, installation and equipping of 85
multi -family units consisting of 84 low-income affordable housing units
and 1 manager unit at 1001 Baker Street, Bakersfield CA 93305 and
certain other matters relating thereto.

9. HEARINGS
a. Public Hearing to consider an appeal for General Plan Amendment/Zone
Change No. 22-0128 and Planned Development Review 22-0073. Cornerstone
Engineering, Inc., representing Ninedo, LP on behalf of The High Life
Investment, Olcese Water District, and Kirkorian Family Trust is proposing a
General Plan Amendment, Zone Change, and Planned Development Review
on 44.32 acres generally located north of State Route 178 between Valley
Street and Vista Montana Drive.
(City staff recommends denying the appeal and upholding the Planning Commission's
recommendation.)
The request includes:
1. Amendment of the land use designation of the Metropolitan
Bakersfield General Plan from Low Density Residential (LR) to General
Commercial (GC) on 44.11 acres and Low Medium Density Residential
(LMR) on 0.21 acres;

2. Amendment to the Bakersfield Municipal Code Section 17.06.020 by
changing the official zoning map from One Family Dwelling (I to
Regional Commercial/Planned Commercial Development (C-2/PCD)
on 44.11 acres, and Limited Multiple Family Dwelling (I on 0.21 acres;
and
3. A Planned Development Review for development of a self -storage
facility. Cornerstone Engineering, Inc. submitted an appeal to the
Planning Commission's denial of the request. A proposed Mitigated
Negative Declaration is available for consideration if the Council elects
to uphold the appeal.
City Clerk Drimakis announced a staff memorandum was received revising
staff recommendation to open the hearing and continue to the May 24, 2023,
Council Meeting.
Hearing item 9.a. opened at 6:09 p.m.

Patricia Newquist spoke in support of continuing the hearing.
Motion by Councilmember Weir to approve the revised staff recommendation.
Motion passed with Councilmember Smith absent.

13. COUNCIL AND MAYOR STATEMENTS
Vice Mayor Gonzales requested Animal Care Center item be brought back to the
Legislation and Litigation Committee meeting for discussion.
Councilmember Gray expressed her appreciation to Mayor Goh and the Garden
Pathway Tea Event honoring women of the community, recognizing and thankful for
all those who volunteer for the good of our community.
Councilmember Gray expressed a Happy Mother's Day to all women and requested
staff proactively enforce current policy and ensure street'Tlower'vendors are
licensed to operate and not encroaching on other businesses.
Councilmember Gray requested staff prepare letters of support for Assembly Bills 33
and 474 to combat the criminal networks trafficking opioids.

13. COUNCIL AND MAYOR STATEMENTS
Councilmember Kaur requested staff notify her of any potential projects for housing
development in Ward 7 to ensure the priority concerns of the area are addressed.
Mayor Goh thanked all city employees for Public Service Recognition Week.
