A RESOLUTION DECLARING INTENTION TO
ESTABLISH THE GOSFORD ROAD PLANNED
SEWER AREA AND PRELIMINARILY
APPROVING THE COST AND FEE SCHEDULE
AND THE BOUNDARIES OF THE AREA.
WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal Code
and Section 66483 of the California Government Code, provides for a
procedure by which the City Council may assess and collect fees for the
purpose of defraying the cost of constructing sewer facilities for local and
neighborhood sewer areas, and;
WHEREAS, The City of Bakersfield desires to provide sewer facilities for a
rapidly developing area as shown on the map entitled "Gosford Road Planned
Sewer Area" attached hereto as Exhibit "A", and incorporated by reference,
and;
WHEREAS, the parcels within the "Gosford Road Planned Sewer Area" will
receive a benefit from the sewer system shown in Exhibit "A".
WHEREAS, the developer of Tract 6859 will construct a portion of the sewer
system shown in Exhibit "A";
WHEREAS, the remaining parcels shall construct the sewer system along
their parcel frontage and/or fund their proportionate fair share of the sewer
system shown in Exhibit "A";
WHEREAS, the City desires to recoup the cost of constructing said sewer
line;
WHEREAS, the City has notified all affected property owners and is
proposing the formation of the Gosford Road Planned Sewer Area to reimburse
the cost of the improvements upon subdivision or development of property
within the Gosford Road Planned Sewer Area; and
WHEREAS, the fees and charges set forth in Exhibits "B" and "C" attached
hereto and incorporated by reference, are based on the actual cost of
providing the services for which the fees are charged.
WHEREAS, parcels which construct more than their proportionate fair share
of the sewer system shown in Exhibit "A" shall be reimbursed through credits
towards sewer fees of the corresponding project or fees collected as shown on
Exhibit "C." o0PQ,9

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
The foregoing recitals are true and correct and are incorporated
herein.
2. The Council hereby preliminarily approves the cost and fee
schedule attached hereto as Exhibits "B" and "C", and the boundary of the
"Gosford Planned Sewer Area" area of benefit and limits of improvements as
described on the map attached hereto as Exhibit "A". Subdivision or
development of property within such area will require payment of fees per the
attached schedule.
3. The City Council hereby fixes Wednesday, June 28, 2023, at 5:15 PM,
or as soon as thereafter as may be heard, at the Council Chambers of the City
Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for
hearing protests on the following matters:
